REGULATION

ON ORGANIZATION AND OPERATION OF

REPRESENTATIVE OFFICE IN THE SOUTH

(Issued enclosed herewith Decision No. 189 /Q§-BKHCN dated February 14, 2006 by the Minister of Science and Technology

Chapter I

FUNCTIONS AND TASKS

Article 1 .

The Representative Office in the South (hereinafter called the

Office) is an agency under the Ministry of Science and Technology, has its legal status, own stamp and bank account, its head office is located in No. 31 Hàn Thuyên street, District 1, Ho Chi Minh City with following functions:

1. Service functions: to ensure facilities, finance and vehicles for the

Ministry’s operation in Southern provinces according to work plans of the Ministry, the Office of the Ministry, Departments and agencies under the Ministry.

2. Management functions: a) To coordinate with functional agencies under the Ministry of Science and

Technology to assist the Minister with State management and guidance on science and technology (S&T) activities and implementation results of tasks carried out in southern province by the Ministry of Science and Technology. b) To be the focal point for connecting and coordinating S&T activities among the Ministry, departments of Science and Technology, S&T organizations and enterprises in order to promote resources in the Southern area for S&T use and development. c) To coordinate activities of agencies under the Ministry in the area to carry out S&T tasks of the Ministry in the area.

3. Implementation functions: a) To be the focal point to receive and coordinate with agencies under the

Ministry of Science and Technology and localities for the organization of short-term training, professional training on S&T as required by emprises and localities.

b) To organize other services to support localities, S&T organizations and emprises in terms of S&T activities in the area.

Article 2. The Representative Office in the South has following tasks:

1. To follow the Office of the Ministry’s requirements on ensuring vehicles, accommodation and other services for the Ministry’s working delegations, logistics for workshops, conferences, training and other activities of the Ministry in the area.

2. To be the focal point for collecting, coordinating activities of agencies under the Ministry in the area, which consist of chairing monthly regular meetings and preparing contents for yearly meetings of the Ministry’s leaders with agencies under the Ministry in the area of Ho Chi Minh City, consolidating the status and reporting to the Ministry; coordinating with agencies to fulfill the Ministry’s tasks, linking with localities, S&T organizations and enterprises;

3. To monitor, understand the current situation, issues arising during the organization and implementation of S&T activities, report to the Ministry on regular or urgent basis on S&T progress in the area. To provide direct supports to localities,

S&T agencies and localities on S&T activities according to guidance of the

Ministry’s leaders when necessary;

4. To be the focal point for linking and coordinating S&T activities among the

Ministry, S&T organizations and enterprises, provide opinions for agencies under the

Ministry on proposing guidelines and measures for S&T activities in Southern provinces appropriate with current situations, assist agencies under the Ministry to consolidate information, proposals, problems of S&T organizations and localities relating to the Ministry’s functions, tasks and authorities for solutions.

5. To participate in meetings, conferences organized by Ministries, branches, localities and S&T organizations in the South, when being invited or delegated by the Ministry. To be responsible for consolidating, reporting to the Ministry conclusions of meetings, inform agencies under the Ministry of relevant contents.

6. To coordinate with functional Departments under the Ministry on monitoring and reporting to the Ministry the status of planning and implementation of S&T tasks under the Ministry’s direct management in the area;

7. To be the focal point to assist the Ministry Inspectorate with inspection and handling of complaints and denunciations according to guidance of the Ministry’s

Chief Inspector;

8. To be the focal point to implement tasks of S&T mass media. To provide legal and regulatory documents on S&T for localities, S&T organizations and southern enterprises when requested;

9. To coordinate with agencies under the Ministry and localities to implement

S&T services, organize S&T short-term training and professional fostering for southern localities when requested;

10. To efficiently manage and use facilities and assets of the Representative

Office in the South; support agencies under the Ministry with management of the

Ministry’s fixed assets which are assigned for use in the area.

11. To make payments from the allocated budget as stipulated.

12. To carry out other tasks assigned by the Minister, requirements of the

Chief of the Office and delegation of Departments’ leaders, heads of agencies under the Ministry.

Chapter II

ORGANIZATIONAL STRUCTURE

Article 3.

Leaders of the Representative Office in the South consist of one

Director in charge of the Office, Deputy Directors who assist the Director with management and leadership of agencies under the Office, are appointed by the

Minister of Science and Technology based on proposals of the Chief of the Office of the Ministry and Director of Department of Organization and Personnel;

Article 4. The Representative Office in the South consists of following departments:

1.

Department of Administration and General Affairs

2.

Department of S&T management

3.

Department of Accounting Affairs

4.

Center for S&T services.

Specific functions, tasks and power of the above-mentioned agencies are stipulated by the Deputy Director in charge of the agencies.

Article 5 . The Director in charge of the Representative Office in the South is responsible to the Minister for the implementation of tasks stipulated in Article 2, provision of professional guidance, management of officials, permanent staff and assets of the Representative Office in the South;

Permanent staff working in the Office carries out professional tasks assigned by the Director in charge of the Office and be responsible for implementation results of the tasks. In addition to the number of permanent staff and seconded staff with duration from agencies under the Ministry, when necessary the Office can recruit

contracted staff to carry out work, the signing of labor contracts is processed as stipulated by current laws.

Chapter III

WORKING RELATIONS

Article 6.

The Representative Office in the South follows the working mechanism in which staff and experts work directly with the Office’s leaders, the

Director in charge of the Office and manages the Office’s all activities based on the

Regulation on Organization and Operation of the Representative Office in the South and that of the Ministry of Science and Technology.

Article 7 . The Representative Office in the South chairs the coordination with functional Departments, agencies under the Ministry to agree on delegated contents and coordination mechanism to fulfill assigned tasks.

Chapter IV

IMPLEMENTATION PROVISIONS

Article 8 . The Director of the Representative Office in the South coordinates with the Chief of the Office of the Ministry and Director of Department of

Organization and Personnel to implement this Regulation.

Article 9 . The amendment and supplementation of this Regulation is carried out by the Director of the Representative Office in the South in coordination with the

Director of Department of Organization and Personnel to submit to the Minister of

Science and Technology for review and approval.
