NISSAN TEST DRIVE CALIFORNIA JERSEY PROMOTION
TERMS AND CONDITIONS
NO PURCHASE NECESSARY TO REGISTER OR PARTICIPATE. VOID WHERE PROHIBITED. THE
JERSEY IS AVAILABLE ON FIRST-COME, FIRST-SERVE BASIS ONLY WHILE SUPPLIES LAST.
ONLY THOSE ELIGIBLE TO PARTICIPATE MAY REGISTER.
1.
The Promotion and Promotion Period: The promotion is the “Nissan Test Drive Jersey
Promotion” (the “Promotion”). The Promotion begins on May 1, 2013 and ends on June 15, 2013 (the
“Registration Period”). The first day a Test Drive (defined in Paragraph 2 below) may occur with a Dealer
(defined below in Paragraph 2) is May 1, 2013 and the final day a Test Drive may occur with a Dealer is
June 15, 2013 (such period being the “Test Drive Period” and together with the Registration Period being
collectively the “Promotion Period”).
2.
Eligibility To Participate: To be eligible to participate in the Promotion and receive the Jersey
(defined below in Paragraph 3) you must, during the Promotion Period: (i) fully complete the registration
form, including your first and last name, complete address (no Post Office Boxes), date of birth, telephone
number, email address, and Jersey size (unisex extra small, small, medium, large, extra large, 2XL, and
3XL (the “Registration Form”) and submit the Registration Form to the Dealer at the Test Drive during the
Test Drive Period; Registration Forms are available either as part of a third party event newsletters; an
email sent to you from Rodale Inc.’s Bicycling Magazine, another Rodale brand, or Amgen Tour of
California; or at the Nissan booth at the Amgen Tour of California event on May 12-19, 2013 or at the
L’Etape du California events on April 28 and May 11, 2013; (ii) be a natural and legal resident of one of
the 50 United States or the District of Columbia who (a) is age 18 or older as of date the Test Drive and
holds a current, valid, unrestricted driver’s license issued by your state of residence at the time of the Test
Drive, (b) owns or is covered by valid and fully paid automobile insurance policy in-effect at the time of the
Test Drive (evidenced by a valid, unexpired automobile insurance card or other documentation
satisfactory to Sponsor and/or the Dealer, in Sponsor’s and/or the Dealer’s sole and absolute discretion),
and (c) not an Ineligible Person (defined below); (iii) be among the first 1,000 persons to complete a test
drive of any new Nissan (model year 2013 or 2014) (the “Vehicle”) at a Dealer (the “Test Drive”), as
instructed below in this Paragraph 2 and have a representative from the Dealer validate your Registration
Form after conclusion of the Test Drive by completing “Dealer” section of the Registration Form; (iv) mail
the completed Registration Form, with the applicable U.S. postage affixed, in an envelope to: Rodale Inc.,
c/o Janet Larchey, 65 East Wacker Place, 11th Floor; Chicago, IL 60601; limit one (1) Registration Form
per person and Registration Forms by the same person in excess of the limits stated herein will be
disqualified; ALL REGISTRATION FORMS MUST BE POST MARKED BY JULY 15, 2013; and (v) fully
comply with these Nissan Test Drive California Jersey Promotion Terms and Conditions (the “Terms and
Conditions”) and any Additional Terms and Conditions (defined below in Paragraph 5) (the foregoing
registration process is referred to as “Register,” “Registered” or “Registration”). All persons who comply
with all the eligibility requirements set forth in this Paragraph 2 are collectively referred to as the “Eligible
Registrant”. For purpose of these Terms and Conditions, an “Ineligible Person” is any of the following: (i)
persons who violate these Terms and Conditions or Additional Terms; (ii) employees, officers, and
directors of Dealer, OMD, or Nissan North America, Inc. (“Sponsor”), and/or Rodale Inc. (the
“Administrator”), and each of their respective franchisees, parents, affiliated companies, subsidiaries,
distributors, retailers, advertising and promotion agencies, and any and all other companies associated
with the design or execution of this Promotion (collectively all such persons and/or entities being the
“Released Parties”), and all their Immediate Family Members of the households, whether or not related, of
any of the above; (iii) Immediate Family Members of any person who has already Registered for this
Promotion and collected a Jersey; or (iv) persons who are Household Members or Immediate Family
Members of persons who have Registered for the Promotion, participated in the Test Drive or have
received the Jersey, irrespective of mailing address or post office box provided in any Registration.
“Immediate Family Members” includes, for purposes of this Promotion, parents (including step-parents
and in-laws), grandparents, siblings (including step-siblings), children (including step-children),
grandchildren (including step grand children) and each of their respective spouses, regardless of where
they reside. “Household Members” shall mean people who share the same Household (defined in
Paragraph 4 below) at least three months a year, whether related or not related.

A Test Drive under this Promotion generally lasts approximately 30 minutes. Prior to the Test
Drive an Eligible Registrant shall be required to present a valid driver’s license, and proof of automobile
insurance or other documentation satisfactory to Sponsor or the Dealer, in Sponsor’s or the Dealer’s sole
and absolute discretion. A Test Drive must be completed in full, such meaning to be determined in the
sole discretion of the Dealer, during the Test Drive Period and on or before June 15, 2013. Sponsor
and/or Administrator shall determine, within its or their sole and absolute discretion, those Eligible
Registrants who are among the first 1,000 to complete a Test Drive of the Vehicle. Any Test Drive
scheduled under this Promotion must be scheduled during the Test Drive Period and during the
applicable Dealer’s normal business hours and is subject to Sponsor’s and/or Administrator’s and/or
Dealer’s right to change such time period at its or their sole discretion without notice.
3.
The Jersey: Eligible Registrants (defined above in Paragraph 2) shall be eligible to receive one
(1) Special Edition Amgen Tour of California Nissan Cycling Jersey (the “Jersey”) with an approximate
retail value of $100.00 issued by Administrator.
4.
Condition to Receiving Jersey: JERSEY DISTRIBUTED TO ELIGIBLE REGISTRANTS ON A
FIRST-COME, FIRST-SERVED BASIS ONLY WHILE SUPPLIES LAST. LIMIT: One (1) Jersey per
person and per Household, only while supplies last, irrespective of the number of Test Drives
completed, provided however, a minimum of one (1) Test Drive of a Vehicle is required to be eligible to
receive a Jersey under this Promotion. Allow up to 16 weeks for delivery of the Jersey. All decisions of
Sponsor and/or Administrator are final and binding on all matters relating to this Promotion. For purposes
of this Promotion, “Household” means a shared residential address or living unit where an Eligible
Registrant makes his or her residence.
5.
Additional Terms and Conditions & Restrictions: Eligible Registrant’s eligibility to participate
in the Test Drive and receive the Jersey may be subject to additional terms, conditions, and/or legal
requirements required by Sponsor or Administrator or Dealer, and Eligible Registrant may be required to
sign a disclaimer, release and/or other legal documents presented by a Sponsor or Dealer prior to
commencing a Test Drive in connection with this Promotion (such additional terms, conditions, and/or
legal requirements, and/or legal documents being (“Additional Terms”)). Any and all Additional Terms
must be executed, and/or complied with, as applicable, by Eligible Registrant as a condition of eligibility to
receive the Jersey. This Promotion is subject to all applicable federal, state and local laws and
regulations and is void where prohibited. The Jersey is not redeemable for cash or any other
substitutions except as may be determined by Sponsor and/or Administrator, in its or their sole discretion
as applicable, from time-to-time during the Promotion Period. Any income, federal, state and local taxes
are the sole responsibility of the Eligible Registrant who receives the Jersey. Jersey is non-transferable.
Failure to collect, claim or accept the Jersey will result in forfeiture of the Jersey. If forfeited for any
reason, Eligible Participant will not receive any substitution or compensation. In the event any Eligible
Registrant is later found to violate these Terms and Conditions after receipt of the Jersey he/she will be
required to reimburse Sponsor and/or Administrator for the stated value of the Jersey.
6.
Publicity and Use of Personal Information: By participating in this Promotion, including by
Registration, a Test Drive and receipt of the Jersey, Eligible Registrants agree to Dealers’, Sponsor’s
and/or Administrator’s use of his/her name, cities and states of residence, any testimonials, voice, and/or
photos, images, and likenesses for purposes of advertising and trade in any and all media now or
hereafter known worldwide in perpetuity without limitation or further compensation, notification,
opportunity for review, or permission, unless prohibited by law. In addition, such personal information
shall be used for administration of the Promotion. In addition, by participating and submitting a
Registration for this Promotion, Eligible Registrants agree that Sponsor and Administrator are authorized
to contact any person participating in the Promotion via email, mail, or phone to advise such participant of
information pertinent to the Promotion and/or to distribute information regarding Sponsor’s and/or
Administrator’s featured products or services, special events or sales offers, or purchase incentives or
discount offers. Participants may opt-out of any further email communication at any time by following
the provided opt-out instructions. By participating in this Promotion you are also subject to the Privacy

7.
Administration: Sponsor and/or Administrator expressly reserve the right to amend, suspend or
terminate this Promotion at any time without prior notice or consent. Administration of this Promotion is at
the sole discretion of Sponsor and/or Administrator. Any questions relating to eligibility, these Terms and
Conditions or any other questions concerning this Promotion will be resolved at the sole discretion of
Sponsor and/or Administrator and their decisions will be final and binding with respect thereto.
8.
Release and Waiver of Liability: By participating in this Promotion, participants agree to
release, defend, indemnify and hold harmless Sponsor, Administrator and the Dealers, and each of their
respective parent corporations, subsidiaries, advertising and promotion agencies, affiliates, directors,
officers, employees, representatives and agents (“Released Parties”) from and against any and all liability
claims or actions of any kind whatsoever (however named or described) for injuries, death, damages or
losses to persons and property which may be sustained in connection with (i) participant’s participation in
the Promotion; and (ii) the receipt, use or misuse of the Jersey, the Test Drives or while preparing for,
participating in, and/or traveling to any Test Drive activity. Released Parties expressly disclaim any
responsibility or liability for injury or loss to any person or property relating to the delivery and/or
subsequent use or misuse of the Jersey or the Test Drive.
9.
DISCLAIMER OF WARRANTIES/LIMITATION OF LIABILITY: TO THE FULLEST EXTENT
PERMISSIBLE PURSUANT TO APPLICABLE LAW, INDIVIDUALS WHO PARTICIPATE IN THE
PROMOTION AGREE THAT ANY JERSEY RECEIVED IS PROVIDED AS-IS WITHOUT ANY
WARRANTY, REPRESENTATION, OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW,
WHETHER NOW KNOWN OR HEREINAFTER ENACTED, RELATIVE TO THE USE OR ENJOYMENT
OF THE JERSEY, INCLUDING, WITHOUT LIMITATION, ITS QUALITY, MERCHANTABILITY, OR
FITNESS FOR A PARTICULAR PURPOSE. SOME JURISDICTIONS LIMIT OR DO NOT ALLOW THE
DISCLAIMER OF IMPLIED OR OTHER WARRANTIES SO THE ABOVE DISCLAIMER MAY NOT
APPLY TO THE EXTENT SUCH JURISDICTION’S LAW IS APPLICABLE TO THESE TERMS AND
CONDITIONS. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, SPONSOR,
ADMINISTRATOR AND DEALERS ARE NOT RESPONSIBLE OR LIABLE FOR ANY DIRECT,
INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, ECONOMIC, EXEMPLARY, PUNITIVE OR
OTHER DAMAGES UNDER ANY CONTRACT, NEGLIGENCE, STRICT LIABILITY, ANY TORT OR
OTHER THEORY ARISING OUT OF OR RELATING IN ANY WAY, DIRECTLY OR INDIRECTLY, TO
THE PROMOTION, THE TEST DRIVE OR JERSEY EVEN IF FORESEEABLE OR EVEN IF SPONSOR,
ADMINISTRATOR OR DEALERS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH
DAMAGES.
10.
Miscellaneous: No waiver of any of the provisions of these Terms and Conditions shall be
deemed or shall constitute a waiver of any other provisions hereof, nor shall waiver constitute a
continuing waiver unless otherwise expressly provided. If any provision of these Terms and Conditions is
found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed
from the remainder of these Terms and Conditions, which will otherwise remain in full force and effect.
Except where prohibited, all issues and questions concerning the construction, validity, interpretation and
enforceability of these Terms and Conditions, or the rights and obligations of participants, Eligible
Registrants or in connection with the Promotion, Sponsor or Administrator shall be governed by, and
construed in accordance with, the laws of the Commonwealth of Pennsylvania without giving effect to any
choice of law or conflict of law rules (whether of the Commonwealth of Pennsylvania, or any other
jurisdiction), which would cause the application of the laws of any jurisdiction other than the
Commonwealth of Pennsylvania. In addition, any dispute relating to the Promotion (including these Terms
and Conditions) shall be brought in the appropriate state or federal court having jurisdiction over the
subject matter located in the County of Lehigh, Pennsylvania. Participants and Eligible Registrants
hereby irrevocably consent to the personal jurisdiction of said courts and waive any claim of forum non
conveniens or lack of personal jurisdiction they may have.
