Amend Burn Permit Procedures

ORDINANCE NO. 2014-11
AN ORDINANCE AMENDING ARTICLE 4-4-4 (Permit Requirements and Conditions: Fee) AND
ARTICLE 4-4-8 (Fire Inspection Required) AND REPEALING ARTICLE 4-4-7(G) (Domestic Household
Refuse) OF THE CODE OF THE CITY OF MCLOUD, MAKING FINDINGS OF FACT; PROVIDING
FOR SEVERABILITY; AND DECLARING AN EMERGENCY.
4-4-4 PERMIT REQUIREMENTS AND CONDITIONS: FEE:
A. NO CHANGE
B. Term of Permit: Such permit shall be valid for a 15 day period.
C. Notification: The permit holder must notify Police dispatch at least 30 minutes prior to each burn. The
permit holder is responsible for determining if there are any burn bans in effect and if the weather is
suitable for burning.
D. No burning is allowed if the wind speed equals or exceeds gusts of 15 m.p.h. The burning of household
trash and refuse within the city limits of McLoud is prohibited. Permits will not be issued for the burning
of combustible material other than normal brush, limbs, leaves and yard waste unless first inspected and
approved by the Fire Chief and/or Fire Marshal.
E. Burn Ban: If a burn ban is issued during the period of the permit the permit is no longer valid. A new
permit must be obtained once the burn ban is lifted or expires.
F. Permit Fee: The fee set for the permit required under subsection A of this section shall be as set by
resolution of the City Council from time to time.
G. Permits must be obtained Monday thru Friday, business hours at City Hall. Permits will not be issued on
weekends or holidays.
H. Failure to obtain the required permit shall be an offense subject to a fine of $200.00 plus court costs.
Article 4-4-8 of the Code is amended by changing Article 4-4-8 to read as follows:
4-4-8 FIRE INSPECTION REQUIRED: On all burns other than grass, leaves, brush, wood and agricultural
grasses, an inspection is required to be made by the Fire Chief, Fire Marshall or their designated deputy prior to
commencing the burn.
4-4-7 is amended by Repealing 4-4-7(G) (Domestic Household Refuse)
PASSED AND APPROVED and the emergency clause voted on separately this 9th day of October, 2014.
