Republic of Latvia Cabinet Regulation No. 432 Adopted 9 October 2001 Procedures for the Issue, Extension and Cancellation of Waste Management Permits Issued pursuant to Section 11, Paragraph three, and Section 15, Clause 1, of the Waste Management Law I. General Provisions 1. These Regulations determine the procedures for the issue, extension and cancellation of waste management (except waste incineration) permits, and the requirements set out in a waste management permit (hereinafter – permit), as well as samples of the permit forms. II. Application for Receipt of a Permit 2. An applicant for a permit (a person who performs or wishes to perform treatment, burial, collection, storage, reloading or transportation of waste) shall submit, prior to the commencement of operations, a relevant application for a permit to the regional environmental board: 2.1. an application for a waste treatment permit (Annex 1); 2.2. an application for a waste burial permit (Annex 2); 2.3. an application for a waste collection, waste storage or waste reloading permit (Annex 3); and 2.4. an application for a waste transportation permit (Annex 4). 3. In order to receive a waste treatment permit an applicant shall submit to the regional environmental administration, in addition to the application referred to in Sub-paragraph 2.1 of these Regulations, the following information: 3.1. a description of the waste treatment technology; 3.2. a description of the waste treatment technological capacity (amount of treated waste per unit of time); 3.3. a copy of the permit for the use of water if such has been issued; 3.4. a copy of the permit for the emission of air pollutants from stationary air pollution sources if such has been issued; and 3.5. information regarding the qualifications of the personnel. In order to obtain a waste burial permit an applicant shall submit to the regional environmental administration, in addition to the application referred to in Sub-paragraph 2.2 of these Regulations, the following information: 4.1. a topographical map of the waste burial site, landfill site or waste dump, on a scale 1:5 000; 4.2. a description of the layout of the waste burial site or the waste dump: 4.2.1. engineering and geological site survey and hydrogeological (site) survey research data of the location of the waste dump; 4.2.2. a list of constructions and inventory materials; 4.2.3. engineering and communication systems connections and the technical specifications thereof; 4.2.4. a list of technical facilities utilised at the waste burial site or the waste dump; 4.2.5. the number and qualifications of employees of the waste burial site or the waste dump; 4.3. a description of technologies utilised at the waste burial site; 4.4. a description of the operations at the landfill site or the waste dump, including a description of the monitoring and control measures of the landfill site operations; 4.5. a closure plan of the landfill site or the waste dump, and a plan of monitoring and control measures after the closure of the landfill site or the waste disposal dump; and 4.6. a description of the engineering structures for environmental protection at the waste burial site or the waste dump: 4.6.1. a description of the infiltrate collection system; 4.6.2. the frequency of infiltrate monitoring and the parameters to be measured; 4.6.3. a brief description of the underground water monitoring system and the parameters to be measured; 4.6.4. a brief description of the air pollution monitoring system, and the parameters to be measured; 4.6.5. a brief description of the gas collection system; 4.6.6. a description of gas utilisation of the landfill site; 4.6.7. sewage and infiltrate treatment facilities and a description of the operation thereof; 4.6.8. a copy of the permit for use of water if such has been issued; and 4.6.9. a copy of the permit for emission of air pollutants from stationary air pollution sources if such has been issued. 5. In order to obtain a waste collection, storage or reloading permit the applicant shall submit to the regional environmental administration, in addition to the application referred to in Subparagraph 2.3 of these Regulations, the following information: 5.1. a description of the waste collection system; 5.1.1. the number of containers placed; 5.1.2. the types of containers placed; 5.1.3. the frequency of emptying of containers; 5.1.4. the location of the containers; Translation © 2002 Tulkošanas un terminoloģijas centrs (Translation and Terminology Centre) 2 5.1.5. the type of waste collection system if no containers are utilised (a brief description of the system); 5.2. information regarding the storage of waste: 5.2.1. the number of waste storage sites; 5.2.2. the addresses of the waste storage sites; 5.2.3. a description of the facilities utilised for waste storage at each waste storage site; 5.3. information regarding waste reloading sites: 5.3.1. the number of waste reloading sites; 5.3.2. the addresses of the waste reloading sites; 5.3.3. copies of the design sketches for waste reloading sites; 5.3.4. the equipment utilised for waste reloading (set out for each reloading site); 5.3.5. the amount of waste to be reloaded (cubic metres or tons) within a year (set out for each reloading site); 5.4. a list of specialised means of transport in conformity with the Latvian State Standard LVS-87, “Transportlīdzekļu tipi un to definīcijas” [Types of Means of Transport and their Definitions]. 5.5. information regarding the qualifications of the personnel; and 5.6. if municipal waste is collected – a confirmation by the local government that the contract referred to in Section 15, Paragraph two of the Waste Management Law shall be entered into with the applicant, or a notarised copy of the contract entered into. 6. In order to obtain a waste transportation permit the applicant shall submit to the regional environmental administration, in addition to the application referred to in Sub-paragraph 2.4 of these Regulations, the following information: 6.1. if hazardous waste is transported: 6.1.1. a copy of the civil liability insurance contract; 6.1.2. a list of the means of transport utilised for transportation of hazardous waste, and copies of certificates attesting to the suitability of such means of transport for transportation of hazardous waste; 6.1.3. a list of the drivers who have obtained a licence to transport hazardous loads; 6.1.4. the contract with the undertaking (company) to which the hazardous waste is transported (a copy); or 6.2. if municipal waste is transported: 6.2.1. a list of specialised means of transport in conformity with the Latvian State Standard LVS-87, “Transportlīdzekļu tipi un to definīcijas” [Types of Means of Transport and their Definitions]; 6.2.2. information regarding the qualifications of the personnel; and 6.2.3. a confirmation by the local government that the contract referred to in Section 15, Paragraph two of the Waste Management Law shall be entered into with the applicant, or a notarised copy of the contract entered into. 7. An application for a waste transportation permit shall be submitted to the regional environmental board in conformity with the destination of the transportation, but the applications for waste treatment, waste burial or waste collection, storage and reloading permits shall be Translation © 2002 Tulkošanas un terminoloģijas centrs (Translation and Terminology Centre) 3 submitted to the regional environmental board according to the location for the conduct of the activity. 8. In order to notify the city council (county council, parish council) of the waste management planned for the administrative territory thereof, the regional environmental board shall send a copy of the application to the city council (county council, parish council) in the administrative territory of which the operations referred to in the application shall be conducted, but a copy of the application for waste transportation – to the city council (county council, parish council) to the administrative territory of which the waste shall be transported. 9. If the local government has substantiated objections against the issue of a permit, or special requirements regarding the contents of a permit, the local government shall notify the regional environmental board thereof in writing within a time period of two weeks. III. Issuing and Extension of Permits and the Requirements Set Out in Permits 10. Prior to the issue of a waste treatment permit (Annex 5), waste burial permit (Annex 6), waste collection, storage and reloading permit (Annex 7) or waste transportation permit (Annex 8), a representative of the regional environmental board shall visit the waste management site indicated in the application or the destination of waste transportation, and the regional environmental board shall check the correctness of the information provided in the application. 11. A waste transportation permit shall be issued only after the person to whom waste is delivered has obtained one or more of the waste management permits referred to in these Regulations. 12. The regional environmental board shall indicate the following in the annexes of a permit: 12.1. the technical requirements for reduction of environmental pollution resulting from the treatment, burial, collection, storage, reloading or transportation of waste; 12.2. the necessary level of education for the persons who are responsible for the treatment, burial, collection, storage, reloading or transportation of waste; 12.3. measures for the prevention of accidents and consequences thereof; 12.4. the requirements for waste management control measures and environmental monitoring; and 12.5. the requirements for closure of the landfill site or the waste dump and for care after the closure thereof. 13. The regional environmental board shall issue a permit, or provide a substantiated written refusal for the issue thereof, within six weeks (if the term of validity of the permit is extended – within four weeks) pursuant to the receipt of the application. 14. A permit shall be prepared in two copies. One copy of the permit shall be issued to the applicant, and the other copy shall be kept in the regional environmental board. The regional environmental board shall send a copy of the permit to the local government in the administrative territory of which the operations set out in the permit shall be performed. A waste treatment permit, a waste burial permit and a waste collection, storage or reloading permit shall be issued for a period of five years, taking into account the type of waste treatment, burial, collection, storage or reloading, as well as the impact on the environment of the waste treatment facilities, landfill sites and waste dumps, and of waste collection, storage and reloading. 16. A waste transportation permit shall be issued for a period of five years. 17. In order to extend the term of validity of a permit, the applicant shall submit to the regional environmental board, not later than six weeks prior to expiration of the term of validity of the permit, the relevant application referred to in Paragraph 2 of these Regulations and the relevant information referred to in Paragraphs 3, 4, 5 or 6 of these Regulations. IV. Annulment of a Permit 18. The regional environmental board shall annul the permit, if the applicant does not comply with the requirements prescribed by regulatory enactments or in the permit. A waste transportation permit shall be annulled also in the case of annulment of a waste treatment permit, waste burial treatment, as well as waste collection, storage or reloading permit of the person to whom the waste is transported. 19. The regional environmental board shall notify the applicant and the relevant local government of the annulment of a permit and of the reasons for the annulment of the permit. The waste management operations referred to in the permit shall be discontinued within a week of sending the relevant notice. 20. If a permit is annulled, a new permit may be obtained, after the elimination of the reasons for the annulment of the permit, by submitting a new application to the regional environmental board in accordance with the procedures prescribed in these Regulations. 21. The regional environmental board shall register the applications received, the permits issued and annulled, and the refusals to issue a permit. V. Closing Provisions 22. The persons who are registered in conformity with the requirements of Cabinet Regulation No. 205 of 8 June 1999, Regulations on Registration of Natural Persons and Legal Persons who Perform Collection, Storage, Treatment, Reloading or Transportation of Municipal Waste, shall obtain a permit in accordance with the procedures specified by these Regulations. 23.
