In Article IX, section (5) of the Bylaws and Policies of the Board of Trustees of State Institutions of Higher Learning, the chancellor of The University of Mississippi is charged with the responsibility of maintaining appropriate standards of conduct for students and is authorized to expel, dismiss, suspend, and/or place limitations on continued attendance and/or levy penalties for disciplinary violations subject to procedures of due process. Thus, the University Judicial System is established pursuant to the delegation of authority. University Judicial Council will hear and decide all cases involving an interpretation of the M Book and any case assigned to it by the University’s judicial officer. The decision of the University Judicial Council regarding such matters will be final, subject to appeal. Ext. 5062 408D Union Committee on Student Organizations shall follow established procedures as outlined in the current M Book. The Committee on Student Organizations has concurrent jurisdiction with any other judicial council that may exercise jurisdiction over a student organization. Cases will be assigned to this judicial body by the associate dean of students Housing Judicial Council The Department of Student Housing and Residence Life has a system of behavioral standards that sanction students who do not adhere to policies within the residence halls. If a student is in violation of the policy, she or he has three recourses for hearings: (1) the administrative judicial officer, (2) the Housing Judicial Council, or (3) a peer judicial board (for lower-level violations). Disciplinary hearings shall follow established procedures as outlined in the University Judicial System. Filing a complaint: http://www.olemiss.edu/depts/dos/judicial/nadpro_init.htm To initiate disciplinary proceedings against a student or organization for a nonacademic violation of a disciplinary policy of The University of Mississippi, the Division of Student Life must receive a formal complaint against the student or organization from an individual or group outlining in detail the nature of the infraction and the specific incident(s) warranting disciplinary action. A formal complaint can be any one of the following: a) a University Police Department incident report; (b) a signed statement from a University faculty member, staff member, or student. Once a written complaint has been received by the Division of Student Life, the University Police Department and/or the Office of the Dean of Students or a designee thereof will make a preliminary investigation into the reported student or organization misconduct. If the investigation establishes just cause for disciplinary action, the case will be reviewed by the associate dean of students , and appropriate action(s) will be taken. Appeals process: http://www.olemiss.edu/depts/dos/judicial/nadpro_appeal.htm A student or organization wishing to appeal the decision of a University judicial body may do so by filing a Request for Appellate Consideration Form with the Office of the Dean of Students within 24 hours of the decision of the University judicial body or officer; this form may be obtained from the associate dean of students . On this form, the student or organization wishing to appeal must set forth the decision being appealed and detailed reasons supporting the appeal. At all levels of appeal, the review will make an assessment of the following: (a) whether prescribed University disciplinary procedures were followed that afforded the student or organization notice of the charges and an opportunity to prepare and present a defense to the allegations of misconduct. (b) whether the decision reached by the University judicial body was based on substantial evidence that established that a violation of the Code of Student Conduct occurred. (c) whether the sanction(s) imposed by the judicial body were appropriate for the violation that the student or organization was found to have committed. (d) whether new evidence exists sufficient to alter the original decision and why such evidence was not available or not presented at the original hearing. An appeal of a decision reached by any University judicial body or judicial officer will be referred to the Appellate Consideration Board with the exception of cases involving suspension or expulsion. Cases involving suspension or expulsion, when appealed, will be referred directly to the Vice Chancellor for Student Life. After reviewing the Request for Appellate Consideration and the record, the Appellate Consideration Board may request additional information from the appealing party or the University, remand the case back to the original judicial body or officer for reconsideration, uphold the decision of the hearing body, modify by increasing or decreasing the imposed sanctions, or reverse the decision of the judicial body or officer and dismiss the case. All decisions of the Appellate Consideration Board are final. For cases involving suspension or expulsion, if the vice chancellor for student life upholds the suspension or expulsion, the student may appeal to the chancellor. The decision of the chancellor is final.
