The following checklist was developed by the Texas Commission on Environmental Quality (TCEQ), Air Permits
Division, to assist applicants in determining whether or not a facility needs to comply with 40 CFR 60, New Source
Performance Standards (NSPS) Subpart WWW, and correspondingly obtain an Air General Operating Permit 517.

§60.751? If “NO,” then Subpart WWW is not applicable and this checklist need
not be completed.

on or after May 30, 1991?
If “NO,” then Subpart WWW is not applicable and this checklist need not be
completed. Go to 30 TAC Chapter 113, subchapter D, to determine if the MSWLF
site is subjected those provisions

Note: Physical or operational changes made to an existing MSW landfill solely to
comply with 40 CFR, Subpart Cc of this part are not considered construction,
reconstruction, or modification for the purposes of this section. Activities required
by or conducted pursuant to a CERCLA, RCRA, or State remedial action are not
considered construction, reconstruction, or modification for purposes of this
subpart.
