On Organization and Operation of
Representative office of Ministry of Science and Technology
in Ho Chi Minh City
(Issued enclosed herewith Decision No. 459 /QD-BKHCN dated April 1, 2010
by the Minister of Science and Technology
Chapter I
FUNCTIONS, TASKS AND POWERS
Article 1. Position and Functions
The Representative Office of the Ministry of Science and Technology in Ho
Chi Minh City (renamed from the Representative Office in the South) is an agency
under the Ministry of Science and Technology, which assists the Minister to fulfill
State management functions of S&T; monitor, consolidate the status of activities in
fields under the Ministry’s State management scope and ensure facility conditions,
financial resources and means for the Ministry’s activities in provinces and cities
under the Central government in Southern areas (called Southern region).
The Representative Office of the Ministry of Science and Technology in Ho
Chi Minh City (hereinafter called the Ministry’s Representative Office) has its legal
status, own stamp and can bank account at State Treasury and Bank to operate and
have transactions as stipulated by laws. The Ministry’s Representative Office has its
head office in No. 31 Hàn Thuyên street, District 1, Ho Chi Minh City.
Article 2. Tasks and powers
1. Submitting to the Minister long-term work plans, 5-year and annual plans
of the Ministry’s Representative Office and organizing the implementation after they
are issued and approved;
2. Monitoring, consolidating information and regularly on monthly basis or
urgently report to the Minister the status of fields under the Ministry’s State
management scope in Southern region; submitting to the authorized level to solve
issues relating to the Ministry’s functions, tasks and authority as stipulated by laws;
3. Coordinating with agencies directly under the Ministry to advise and
propose with the Minister guidelines, policies and measures to fulfill the Ministry’s
State management functions in Southern region and providing guidelines and
organizing the implementation after they are issued, approved;
4. Ensuring logistic activities, coordinating with agencies directly under the
Ministry to organize the Ministry’s meetings, conferences, workshops, training
courses in Southern region; chairing the monthly review meetings and preparing the
contents for annual review meetings of the Ministry’s leaders with agencies under the
Ministry which are located in the region;
5. Being the focal point to consolidate, coordinate activities of agencies under
the Minister located in region to fulfill the Ministry’s tasks in Southern region;
consolidate, monitor and report to the Minister on the status of developing plans and
the implementation of S&T tasks which are directly managed by the Ministry in
Southern region;
6. Being the focal point to coordinate, assist the Ministry Inspectorate with
inspection activities and handle complaints and denunciations as guided by the
Minister and the Ministry’s Chief Inspector;
7. Being the focal point to link and coordinate activities among the Ministry,
localities, S&T organizations and enterprises in order to promote sources for S&T
use and development in Southern regions; provide direct supports for localities, S&T
organizations and enterprises in S&T activities as guided by the Ministry’s leaders;
8. Ensuring transportation, accommodation and logistics conditions for
officials and staff participating in the Ministry’s missions in Southern regions;
9. Participating in meetings, conferences, workshops organized by Ministries,
branches, localities, S&T organizations and enterprises in Southern region, when
being invited or delegated by the Ministry; consolidating, reporting to the Ministry
results of these meetings, conferences and workshops and informing agencies under
the Ministry of relevant contents.
10. Being the focal point to receive and coordinate with agencies under the
Ministry, localities in the organization of short-term training, professional training on
S&T in Southern areas; organizing the provision of S&T use and development
services within the assigned functions and tasks;
11. Following mechanisms and policies for the Ministry’s retired officials and
staff; carrying out receptions, compliments, visits, funerals in Southern region as
guided by the Minister;

12. Providing information, comments when there is a review for emulation
titles, forms of rewards for groups and individuals in Southern region; following
information and reporting systems as stipulated and guided by the Minister;
13. Efficiently managing the organization, personnel, financial resources,
assets and documents of the Representative Office of the Ministry; supporting
agencies under the Ministry located in Southern region with management of the
Ministry’s fixed assets assigned for use according to current regulations;
14. Carrying out other tasks assigned by the Minister or delegated by the
Chief of the Ministry’ Office and heads of agencies under the Ministry.
Chapter II
ORGANIZATIONAL STRUCTURE AND WORKING MECHANISM
Article 3. Leaders of the Ministry’s Representative Office organize its work
according to a mechanism in which the leadership integrates with collective
discussion.
The Director, head of Ministry’s Representative Office (hereinafter called the
Director) is appointed, dismissed by the Minister of Science and Technology and
responsible to the Minister for the entire organization and operations of the
Representative Office of the Ministry.
Deputy Directors, Deputy heads of Ministry’s Representative Office
(hereafter called Deputy Directors) are the people who assist the Director with the
Representative Office of the Ministry’s work, allowed to make decisions on issues
under assigned tasks and responsible to the Director for assigned tasks. Vice
Directors are appointed, dismissed by the Minister of Science and Technology based
on the Director’s proposals.
In case the Director is absent, one Vice Director is authorized to manage and
deal with Ministry’s Representative Office’s work on behalf of the Director.
Article 4. Organizational structure
1. Department of Administration and General Affairs
2. Department of S&T management
3. Department of Accounting Affairs
4. Center for S&T services.
The Director, head of Ministry’s Representative Office coordinates with the
Director of Department of Organization and Personnel to stipulate specific functions,

tasks and assign officials, experts working in departments directly under the
Ministry’s Representative Office based on assigned functions, tasks and personnel.
The appointment, dismissal of head, deputy head levels of departments
directly under Ministry’s Representative Office follows the Ministry’s regulations on
appointment and delegated authority on personal.
Chapter III
WORKING RELATIONS
Article 5. The Director, head of Ministry’s Representative Office manages the
Ministry’s Representative Office’s entire activities based on the Regulation on
Organization and Operation of the Ministry’s Representative Office.
Article 6. The Director of the Ministry’s Representative Office follows the
working regulations and relations with leaders of agencies under the Ministry
according to the Ministry's working regulations and other regulations issued by the
Minister.
The Ministry’s Representative Office chairs the coordination with functional
Departments, agencies under the Ministry to agree on delegated contents and
coordination mechanism to fulfill assigned tasks.
Article 7. The Ministry’s Representative Office is responsible for
coordinating with S&T management agencies of Ministries, branches, localities,
relevant organizations and individuals as stipulated in the implementation of
assigned functions and tasks.
Chapter IV
IMPLEMENTATION PROVISIONS
Article 8. The Director of the Ministry’s Representative Office coordinates
with the Director of Department of Organization and Personnel to implement this
Regulation.
Article 9. The amendment and supplementation of this Regulation is carried
out by the Director of the Ministry’s Representative Office in coordination with the
Director of Department of Organization and Personnel to submit to the Minister of
Science and Technology for review and approval.
