ORDER
The Delhi Medical Council examined a complaint of Shri Rajesh Kumar, alleging medical
negligence on the part of Dr. Charu Garg of Garg Hospital, AGCR Enclave, Opp. Karkardooma
Courts, Delhi, in the treatment administered to his daughter Baby Radha Aggarwal at Garg
Hospital
The Council perused the complaint, written statement of Dr. Charu Garg, Dr. S.S. Bhagat, Dr.
Dinesh Singhal, Dr. Atul Gupta, Dr. Sanjay Garg of Garg Hospital and copy of medical records of
Garg Hospital.
It is alleged by the complainant that Dr. Charu Garg made a wrong diagnosis and unnecessary
conducted exploratory laparotomy on the complainant’s daughter.
The Council notes that the patient was brought to the OPD of Garg Hospital for the complained of
pain abdomen, loose motions and vomiting for the last 4-5 days followed by constipation and
abdominal distension for the last 2 days. As per OPD slip, child was looking toxic and abdomen
distended with positive tenderness and generalized guarding and rigidity and absent bowel
sounds. A provisional diagnosis of Acute abdomen with SAIO with septicemia was made and
was advised urgent hospitalization. After admission patient was investigated and surgical opinion
was sought and treatment started. X-ray abdomen shows multiple fluid levels with no gas under
the diapnragm. Ultrasonography of abdomen was suggestive of Ascites in pelvis and left flank
The patient’s condition did not improve on conservative management and a needle aspiration of
ascitic fluid revealed pus in peritoneal cavity. A decision to conduct emergency laprotomy and
evacuation of pus from peritoneal cavity was taken by all three specialists. Child was transferred
to Sir Ganga Ram Hospital under medical supervision as requested by parents of the child.

After examination of the case, the Delhi Medical Council holds that the same was in accordance
with accepted professional practices in such cases.
In view of the findings made hereinabove, it is the decision of Delhi medical Council that prima
facie not case of medical negligence is made out against Dr. Charu Garg in the treatment
administered to Baby Radha Aggarwal at Garg Hospital.
Complaint stands disposed.
