Annexation (Stanley, Morse) Zoning and Development Standards

RESOLUTION NO. 1896
WHEREAS, the City of Overland Park has petitioned the Johnson County Board of
Commissioners to annex certain territory south of its existing City limits; and
WHEREAS, certain concerns have been raised as to the City's intentions as to application of
City standards in the areas of zoning and development in the event annexation is approved; and
WHEREAS, it is the desire of the Governing Body to respond to these concerns by formal
resolution.
NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
OVERLAND PARK that in the event annexation is approved, the City proposes the following:
1.
To accept the current zoning classifications, uses and standards under the existing
County/township regulations for all annexed properties; provided however, any rezoning or
land use change subsequent to annexation will be subject to the procedures and standards of the
Overland Park Municipal Code.
2.
To accept the County development standards in conjunction with City building codes for all
nonresidential tracts and for all residential final plats approved by the County and recorded with
the Register of Deeds prior to the County approval of the proposed annexation.
3.
To recognize the character and individuality of the Stanley and Morse communities and
preserve the historical significance of these communities as future development occurs.
4.
The property subject to annexation will be included in the City's annual Master Plan schedule
which is a series of public hearings held each year to develop the City's Master Plan. This Plan
is used to guide officials and property owners in future zoning, rezoning and land use matters.
