JAPAN PATENT OFFICE Project: F025 May 2, 2014 IPC: E01F9/00 Rapporteur Report Ref : Annex 1: JP Revision request with proposal, March 13, 2014 Annex 2: SE comments, April 9, 2014 Rapporteur is grateful to SE for making useful comments and preparing the counter proposal. SE proposed in their comments to rearrange groups 9/011 - 9/03 with the help of three new two-dot head groups, "characterised by the purpose", "characterised by form or functional features" and "characterised by means for fixing or placement". R supports this SE proposal on the whole. In the initial proposal, groups relating various aspects were arranged in a disordered way. But R thinks the scope of the head group “characterised by the purpose” is not clear, because all subject matter under 9/011 have its own purpose. R, therefore, tried to rearrange groups 9/011-9/03 with the help of two head groups “characterised by form or functional features” and “characterised by means for fixing or placement”. The proposed arrangement with the help of the two head groups will sort out the groups and make it easy for user to understand the scheme. SE commented that the proposed subdivision of 9/04 and its subgroups is problematic, since it would introduce parallel groups in different places for subject matter that is almost indistinguishable. R surmises SE thinks the relation between E01F9/041-9/044 and E01F9/081-9/085 and the relation between E01F9/045 and E01F9/06-9/076 are parallel and cause the problem. Regarding the former relation, R has not changed the scheme as stated in the table below, but R would like to invite further comments on this point. Regarding the latter relation, R would like to propose to delete E01F9/045. Below you will first find a table about the initial proposal with SE and R comments, then a table about a modified proposal. The modified proposal is made by editing SE counter proposal in Annex 2, because the modified proposal adopts a lot of wordings proposed by SE and contains rearranged groups 9/30-9/69 also proposed by SE. Although R has removed some references which R thinks unnecessary in the modified proposal, R would welcome other offices comments. Provisional numberings are used in the modified proposal. M. R thinks that is not reasonable and, therefore, moves the reference from 9/016 to the main group 9/00. It is noted that there is the limiting reference “Barrier bollards 13/00” under the subheading of “This subclass/group does not cover:” in the CPC definition of the main group 9/00. OK We think the reference is informative. The title could be simplified: Marking means interacting otherwise than by visible means, e.g. using radar reflectors or radio transmitters R: R supports simplifying the wording but the scope of the proposed title seems too wide. It appears to contain the interacting means such as pressure sensors. R proposes a modified title in the left column. R thinks 9/00 and 11/00 have an overlap since “other sensitive devices” in the title of 11/00 contains receivers. So, R thinks the reference to 11/00 should remain. The title could be simplified: Marking means automatically reacting to atmospheric conditions, e.g. to signal icy roads or light up in fog; Marking or traffic control means characterised by heating or drying arrangements R: R supports simplifying the wording but R suggests changing the phrase “atmospheric conditions” proposed by SE to “adverse atmospheric conditions” in order not to change the initial scope. C N Expected IPC E01F9/011 E01F9/0111 Dots Initial title and modified title by R SE and R comments ・ Upright bodies, e.g. marker posts or bollards; Supports for road signs See the groups at the end of the scheme for our counterproposal for groups 9/011 – 9/03! ・・ Traffic guidance, warning or control posts or bollards, e.g. delineator posts or milestones Posts or bollards, e.g. milestones R: R supports SE proposal. We propose: Posts or bollards for guiding, warning or controlling traffic, e.g. delineator posts or milestones R: R surmises SE comment on 9/0175 is based on the observation that the phrase “Traffic guidance, warning or control” doesn’t have any important meaning. R thinks that almost all the markings classified under 9/00 are used for “Traffic guidance, warning or control”. Based on this observation, R proposes to delete the phrase “Traffic guidance, warning or control” of 9/0111. N E01F9/0112 ・・・ Special features of delineator posts, e.g. with parts cantilevered toward the roadway or fixed vertically on a tilted surface (E01F9/03, E01F9/053, E01F9/08 take precedence) Delineator posts Since “Posts or bollards” itself is not characterised by either “form or functional features” or “means for fixing or placement”, R proposes to set 9/0111 directly under 9/30. We are not in favour of this group. "Special features" is not a distinct borderline, delineator posts without special features aren't inventions! The group could perhaps be saved by changing the title to "specially adapted for marking road edges, e.g. with parts extending towards the roadway". We don't understand the second example and we don’t think the last two precedence references are necessary. R: R would like to propose the title “delineator posts”, since the scope of the title proposed by SE is rather different from that of the initial one. Since “delineator posts” itself is not characterised by either “form or functional features” or “means for fixing or placement”, R propose to set 9/0112 directly under the group 9/32. 3 N Expected IPC E01F9/0113 Dots Initial title and modified title by R SE and R comments ・・ Gantries or semi-gantries; Foundation means specially adapted therefor We propose: Overhead structures, e.g. gantries; Foundation means specially adapted therefor N E01F9/0114 ・・ Holders for traffic poles (E01F9/0112, E01F9/0113, E01F9/0118, E01F9/013 take precedence) Means for holding traffic poles N N E01F9/0115 E01F9/0116 ・・・ ・・・ N C N E01F9/0117 E01F9/0118 E01F9/012 E01F9/0122 ・・・ ・・ ・・ ・・・ R: R supports SE proposal. OK OK OK OK This group should not be created here! It should be a subgroup of 9/08 and a head group for 9/081, see 9/0805! R: R understands the first part of the title is related not only to 9/08 but to 9/06 because “road surface marking” in the first part is related not only to “Traffic lines” of 9/08 but to “Traffic studs; Marking” of 9/06. Thus, R deems that it is not appropriate to move the first part under 9/08 as proposed by SE. R understands the second part of the title is related not only to “Traffic lines” of 9/08, that is, the marking with the shape of “line”, but also to the making with the various shape. Thus, R deems that it is not appropriate to move the second part under 9/08 as proposed by SE. However, since there seems an overlap between the scope of the second part and that of 9/08, R proposes to change the references in the second part to “E01F9/047, E01F9/053, E01F9/06, E01F9/08 take precedence”. R has deleted the reference because a reference pointing to 9/08 has been added to the upper group 9/041. This group should not be created here! It should be a subgroup of 9/08, see 9/086! R: R has not moved this group, which is subgroup of 9/041. But, R has simplified the title of 9/044 taking account of the expression in the title which SE proposed as the title of 9/086. This should be a subgroup of 9/07, see 9/071! R: It seems that SE comment is based on the observation that the subject matter of 9/045 is covered in 9/06. It is certain that there is an overlap between the scope of 9/045 and that of 9/06, even if the former is not contained fully in the latter. Taking into consideration the fact there is less than 100 documents in 9/045 in the CPC, R suggests deleting 9/045 from the scheme to exclude the overlap. OK The example is unnecessary! R supports the title itself proposed by SE. Should be a subgroup of 9/071: flexible or rockable markers, e.g. resilient flaps R: In R’s view, SE proposed the title “flexible or rockable markers, e.g. resilient flaps”, based on the existence of the upper subgroup 9/071. However, since the subgroup 9/071 has not been established as mentioned above, R would like to suggest restoring the initial title. Although the initial title is restored, it may be necessary to modify it to clarify the scope. R would like to propose the title in the left column. As 9/045 has been deleted, the reference pointing to the group has been deleted. The title should be broadened: Traffic lines Markings on road surfaces, e.g. traffic lines R: If the title of 9/08 is changed to “Markings on road surfaces, e.g. traffic lines” as suggested by SE, the scope of 9/06 appears to be contained by that of 9/08.
