TRANSPORTED COOLED SEMEN BREEDING CONTRACT 2006
This agreement is made this _______day of____________, 2006,
By and between Jeanne McDonald, owner of TANTRIS, and _______________________,
Owner of the mare _____________________________.
In consideration of $1800 ($1500 Stud Fee and $300.00 Non-refundable,
booking fee). I, Jeanne McDonald and Turning Point Farm, hereby agree to breed
the German Verband APPROVED OLDENBURG stallion TANTRIS (33-03134-89) (also North
American Oldenburg and International Sporthorse Registry approved, BUT no longer
active) to ______________________'s mare, ____________, Breed _________________,
registration # ________________________________. If the mare does not maintain
pregnancy, resulting in a live foal (lives 24 hours) as stated by a certificate
from a qualified veterinarian, I agree to grant additional COOLED SEMEN
deliveries for said mare from said stallion during that season. If this breeding
season is missed, additional deliveries will be sent next spring only upon a
veterinarian's certificate that the mare is in healthy and sound breeding
condition, including a current Negative uterine culture. This is a transferable
contract with written permission and a nominal transfer fee. The contract must
be fulfilled within three years or if the stallion becomes unfit for breeding;
the contract becomes null and void.
The mare owner also agrees to pay a collection and processing fee of
$150.00 per collection (and if less than 24 hours notice, an additional $50 fee
= $200) plus any shipping fee incurred from sending the COOLED semen. A
refundable container deposit of $300.00 is due before delivery of semen. The
other above expenses will be deducted from your $300 container deposit after the
container has been received back; the remainder will be returned to you.
Jeanne McDonald and Turning Point Farm, assume responsibility only to
deliver live, COOLED semen in viable condition at the time of delivery to the
Mare owner's farm, provided the mare owner complies with all items as stated
herein. A licensed veterinarian must administer the semen on the day of
delivery or the mare owner shall not be considered to have fulfilled the
contractual obligations herein and all privileges and guarantees in this
contract shall consequently not apply.
Mare owner agrees to return container, the ice packs and all cleaned
containers within 5 days of delivery or forfeit the container deposit.
The mare owner shall assume all responsibility for the condition of
The mare and shall bear all risk or loss or damage to the mare whether by
death, disease, injury, infection, or otherwise and by any case whatsoever,
And therefore agrees not to hold Jeanne McDonald or Turning Point Farm, and/
Or its agents or employees responsible for any and all damages associated
therewith.
To become valid and binding, this contract (executed in duplicate)
Must be signed by both parties and the original returned to Jeanne McDonald
at Turning Point Farm.
