Memorandum Of Understanding
Supplementing and Extending the Statewide Agreement of April 14, 1983
Supplemental Agreement No. 2 Between
Department of Fish and Game, Region 2
State of Idaho
Forest Service, Clearwater National Forest
U.S. Department of Agriculture
This Memorandum of Understanding, made this 22nd day of September, 1986, by and between the Idaho
Department of Fish and Game, Region 2, hereinafter called the “Department,” and the U.S. Forest Service
through the Forest Supervisor, Clearwater National Forest, Region 1, hereinafter called the “Forest Service,”
is entered into for the purpose of protecting, conserving and managing the fish and wildlife resources of the
State of Idaho within the Clearwater National Forest.
WHEREAS, Section 36-104(b) (10) Idaho Code, authorizes the Department to enter into cooperative
agreements to enforce road closures for the protection of fish and wildlife resources on National Forest and
adjacent private lands; and,
WHEREAS, 16 USC 551 through 36 CFR 261, subpart B, authorizes the Forest Supervisor to manage and
close roads and trails or restrict use on the National Forest to benefit wildlife and fish; and,
WHEREAS, the Regional Forests and Director, Idaho Department of Fish and Game, have entered into a
Memorandum of Understanding to cooperatively enforce road closures on National Forest lands within the
State of Idaho; and,
WHEREAS, all parties agree that the main objectives of this program of controlling access are to:
1. Protect wildlife and fish habitat.
2. Minimize harassment to wildlife and to prevent over-harvest of wildlife and fish.
3. Provide a more effective road management system.
4. Promote quality recreational hunting and fishing experiences.
5. Reduce erosion problems and minimize road maintenance costs due to hunter, fishermen
and other uses.
NOW, THEREFORE, all parties agree to amend the supplemental agreement dated March 13, 1985, to
provide for this cooperative road closure effort as follows:
A. The Forest Service agrees:
1. To enforce Federal laws and regulations closing or restricting use on National Forest roads
and trails.
2. To provide copies of the current Forest Supervisor’s Order and Clearwater National Forest
Travel Plan/Maps to Department personnel for official use at no charge.

3. To furnish and install appropriate signs for all road travel restrictions described in Exhibits A
and B.
4. To provide copies of regulations and policy that are pertinent to road closures and signing to
the Department.
5. To develop procedures to keep Forest Service Ranger District dispatchers, receptionists and
other key contacts informed of road closure status.
B. The Department agrees:
1. To enforce Idaho law pertaining to road and trail closures as specified in the Clearwater
National Forest Travel Plan or temporary Supervisor’s orders. Enforcement to be incidental to normal duties
unless approved by the Regional Supervisor or Regional Conservation Officer.
2. To maintain communications with local Forest offices regarding current status of road and
trail closures.
3. To honor permits issued by the Forest Service to enter closed areas.
4. To inform District Rangers when gates are found open, signs down, or other unusual
conditions on closed roads.
C. It is mutually agreed and understood by and between the said parties:
1. To have an annual workshop to discuss problems, share concerns and review/modify this
agreement as needed.
2. To develop a system to exchange information on citations issued as a result of this
agreement.
3. To cooperate in developing signs and processes for better posting notification, etc.
4. Cooperate in an effort to inform the public of our cooperative enforcement efforts.
5. Both agencies will assist each other in the enforcement of other applicable laws and
regulations by reporting violations, or suspected violations, to the responsible Conservation Officer or Forest
Officer. Such enforcement activities will be incidental to the regular work of the respective agencies.
6. The agreement may be modified by mutual written agreement of the Regional Supervisor,
Region 2, of the Department and of the Forest Supervisor, Clearwater National Forest. It may be terminated
by either the Forest Service or the Department by giving thirty (30) days notice, in writing, to the other.
Unless so terminated, it shall remain in force indefinitely.
IN WITNESS WHEREOF, recognizing that additional supplements may be required in the future, the parties
hereto have executed this agreement as of the last date written below.
