2010 SELECT FUTURITY RULES
These rules apply to services sold at the 2010 Select Stallion Auction
(2011 Weanlings, 2012 Yearlings and 2013 2-Year-Olds)
I.
Select Futurity Committee
A. The committee shall consist of at least three (3) members, one of whom shall serve as Chairperson.
B. There will be an annual internal audit of the monies and records of individual nominations, sustaining
fees, penalties and payback, with the results to be kept on file with the Board of Directors.
C. There will be a quarterly report given to the Board of Directors. This report will include (but not be
limited to) total nominations, sustaining payments and total monies collected.
D. The Committee reserves the right, subject to approval of the Board of Directors, to reject any stallion
or mare submitted for nomination that does not qualify according to the Futurity Rules.
E. The Committee reserves the right, subject to approval of the Board of Directors, to cancel, postpone or
move the Select Futurity classes, or to amend these rules. All eligible exhibitors will be notified of any
change(s) at least 30 days prior to the futurity show.
II.
Responsibility of Person(s) Making Nomination(s)
A. It is the responsibility of the Select Futurity participants to know and abide by the rules as published.
B. Failure to meet futurity responsibilities (including but not limited to nomination, identification or
notification deadlines, submittal of required veterinarian statements, payment of fees, membership,
etc) is cause for disqualification.
III.
General Rules: Select Stallion Service Auction
A. A public auction will be held
B. The minimum bid to be entertained (hereinafter referred to as “the minimum bid”) will be $200 or ½
the regularly advertised stallion fee, whichever is greater, plus a $50 office fee. No chute or booking
fees allowed. No private treaty.
C. A successful sale of a stallion service entitles the following:
1. The winning bidder may nominate one mare serviced by that stallion to compete in the futurity.
2. Each stallion owner may nominate, at no charge, one mare serviced by that stallion to compete in
the futurity. Unlimited additional slots are available to the stallion owner, available for purchase at
the minimum bid (See III.B.).
3. If the stallion service sells at auction, all offspring from that stallion’s service year are eligible for
nomination to the weanling, yearling, or 2-year-old futurities in the appropriate year.
4. If the stallion service does not sell, no offspring from that stallion’s service year will be eligible for
subsequent select futurities.
D. Stallion service(s) may be resold or transferred by either the mare or stallion owner; however, written
notification must be submitted to the Select Futurity Committee to avoid disqualification.
E. If the stallion service does not sell at the time of the auction, the stallion service will be available for
purchase through June 1st at the minimum bid (See III.B.) plus a $50 late fee. The first person to
contact and make payment to the Futurity Auction Chairperson receives the service.
F. Mail-in bids (with a check made out to the MPHA Select Futurity with a specific dollar amount) will be
accepted until the time the auction begins. In the event of a mail-in bid, said bid will be the opening
auction bid. In the event of a tie mail-in bid, the opening bid will be the bid with the earliest postmark
(postage meters not accepted). In the event of a tie mail-in bid with the same postmark date, the
successful opening bid shall be determined by lottery. Service will be sold to the final highest bidder.
Non-awarded mail-in bids (checks) will be returned to the bidder.
G. Telephone bids will be accepted during the auction. Interested bidders should contact a futurity
representative prior to the auction and inform them of the selection of a stallion. During the auction a
futurity representative will contact the bidder by telephone, at which time a Visa or MasterCard credit
card number will be recorded. The representative will execute bids on behalf of the caller; upon a
successful bid the credit card transaction will be processed.
H. The signature of the successful bidder will be obtained on the MPHA Select Futurity Stallion Service
Agreement contract, along with the payment of the service fee, immediately following the auction. All
checks for service fees are to be made payable to the MPHA Select Futurity.
1. All checks returned for insufficient funds, etc., will be assessed a $20 fee payable to the MPHA
Futurity. Failure to provide full payment of bid within 15 days of auction will cause the bidder to
default and be ineligible to participate in that select futurity.
2. In case of an insufficient funds purchase check, the stallion owner will be notified and will have
until June 1st to purchase the service for the minimum bid (See III.B.) to stay eligible for the
futurity.
I. Beginning in 2008, 15% of the auction proceeds will be set aside for the Select Yearling Futurity to be
held two years later, at which time the monies will be added to the class.
J. Beginning in 2008, 15% of the auction proceeds will be set aside for the Select 2-Year-Old Western
Pleasure Futurity to be held three years later, at which time those monies will be added to the class.
IV.
General Rules: Nominations and Breeding
A. No substitutes will be allowed (mare, foal, halter or performance) after the nomination has been made
EXCEPT in the case of death of the original mare or should she prove unbreedable, a substitute mare
will be accepted. NOTE: If a mare is proven unbreedable, the use of this mare is then prohibited
entirely in MPHA. Notification with veterinarian statement must be submitted with substitution. The
stallion service fee from the auction will remain with the year purchased, but the foal will move to its
year of eligibility.
B. Service must be used the year purchased/donated. Should the mare not “settle,” or not produce a
live, viable, normal foal (as verified by veterinarian statement sent to Futurity Chairperson by
August 1st of foaling year), the mare will be allowed a return service the year after purchase only.
Should a mare produce a “lethal white” foal (as verified by veterinarian statement sent to Futurity
Chairperson by August 1st of foaling year), owner may reclassify the same mare or substitute a
different mare for reclassification into the next year’s futurity.
C. Should other unforeseen circumstances arise, such as the death of the stallion or mare, written
statement of such circumstances must be sent to the Futurity Chairperson by August 1 st of the year of
purchase, preferably as soon after such circumstances arise as possible. MPHA Board of Directors will
make a ruling based on information available and past practices.
D. In the event of the death of the stallion prior to the breeding of said mare, the purchaser of stallion
service will have the option to apply the money toward the purchase of a stallion service the following
year, or to receive a refund less 10% office fee.
E. In the case of embryo transfers, only one foal resulting from the nominated mare and the purchased
stallion will be eligible.
F. In the event that a horse is withdrawn from the futurity (by failure to provide sustaining payments,
disqualification, or injury) all fees remain in that horse's originally designated class purse.
G. In the event that a nominated horse dies of natural causes, or is destroyed for humane purposes, all
nominating and sustaining payments will be returned. This is contingent upon verification by a
veterinarian’s report citing, but not limited to, the date of the examination and the cause of death/reason
for destruction of the horse. Report is to be submitted to the Futurity Committee prior to the Futurity show.
V.
Stallion Owner
A. Stallion owner refers to one party, regardless of whether that party is an individual, syndicate, or
partnership.
B. Nomination of stallion service may be made only by the stallion owner or acting agent.
C. Stallions nominated must be on record with the APHA (AQHA, TB or Paint). A copy of the
registration papers or copy of the official lease agreement (which must be on file with the APHA)
must accompany the stallion contract.
D. Nominations for a stallion service will be accepted until one week prior to the auction. Early
nominated stallions will be identified in the MPHA Newsletter and on the MPHA website.
E. A stallion owner may donate the service of as many stallions as desired; however, each stallion
may have only one service auctioned. Each stallion must be on a separate nomination form.
F. Stallion owner agrees to take proper care of the mare/foal at all times when boarded for breeding.
Stallion owner reserves the right to call a veterinarian when deemed necessary, at the mare
owner’s expense.
VI. Mare Owner
A. Mare owner refers to one party, regardless of whether that party is an individual, syndicate or
partnership.
B. Mare selected must be registered with APHA, AQHA or Jockey Club of America (TB) and all resulting
foals must be eligible for APHA registration.
C. The mare selected to use the purchased stallion service must be nominated (identified), along with
the last date bred, to the Select Futurity Chairperson by December 1 of the service year, by the
mare owner. A $100 late fee will be imposed if nominated after December 1 through December
31st. No postage meters accepted. Failure to notify the Chairperson by December 31st will
disqualify the mare/colt from participating in the Select Futurity in subsequent years.
D. Mare must be broke to lead and tie, and must be in good general health. (Stallion owner reserves
the right to require additional agreements per routine farm or ranch breeding contract, which will
be noted on the breeding service contract). Stallion owner reserves the right to call a veterinarian
when he deems it necessary, at the mare owner's expense.
E. A mare that has been nominated to the Select Futurity and is sold in foal is still eligible to
participate in the Select Futurity. Notification of the sale must be submitted to the Chairperson by
both parties (seller/purchaser).
F. Date of birth and sex of foal (Foal Identification) must be submitted to the Select Futurity
Chairperson no later than August 1. The required information will be accepted until September 1,
with a $20 late fee. Failure to submit is cause for disqualification.
VII.
Conduct of the Select Futurity Classes
A. There will be no fewer than 3 judges. The judges hired must be APHA approved. In the event of a
multi-judge show (POR) held in conjunction with the Futurity, all judges hired for the POR will judge all
Futurity classes. Each judge's score will be of equal consideration when tallying total points for each
horse judged.
B. A minimum of 12 horses will be placed for each class.
C. In the event of a tie, the tied horses will be recognized for that position, with the purse of the
positions added and divided between the horses tied. (Example: Two horses tie for third place: the
horses placed in that class will be recognized as follows: 1st, 2nd, 3rd (tie), 5th, 6th, etc. The
purse of the 3rd and 4th place will be added together and divided equally between the two horses.)
D. In the event of a dispute regarding a horse disqualified from a class, the only disputed monies
considered for reimbursement are the sustaining payments for the applicable class. Any other
expenses incurred by the exhibitor are at the risk of the exhibitor and would not be considered in
dispute. Any refunds granted would be deducted from the applicable futurity class.
VIII.
Rules Applicable to All Futurity Classes
A. The nominated foal or horse to be shown must have original APHA registration papers (regular or
solid paint bred) presented to the designated Committee member prior to entering the arena each
day in order to be shown.
B. All owners listed on the registration papers of the horse and the exhibitor of the horse must be
current members in good standing with the MPHA for that horse to be shown in the Futurity.
C. Failure to meet futurity responsibilities (including but not limited to nomination, identification or
notification deadlines, submittal of required veterinarian statements, payment of fees, membership,
etc) is cause for disqualification.
D. ALL offspring from a stallion whose service sold at the MPHA 2010 Select Futurity Auction are eligible
to compete in the 2011 Weanling, 2012 Yearling and 2013 2-Year-Old Futurities, upon payment of the
nomination fees described below, and any sustaining fees as detailed elsewhere in these Rules.
1. For eligible breedings, to nominate to all three futurity years: the nomination fee is $200 or ½
the regularly advertised stud fee, whichever is greater, plus $100 entry fee, due by December
1st of the BREEDING year. Additional sustaining fees will apply for the yearling and 2-year-old
futurities. Submit the mare nomination form and a copy of the mare’s registration papers,
together with payment, to the designated futurity committee member.
2. For eligible yearlings who were not nominated in their breeding year: the nomination fee is
$150 plus a $50 office fee, due by May 1st of the Yearling year, for either the halter or longe
line classes. Additional sustaining fees apply. Horses may compete in both halter and longe line
classes; a separate nomination fee must be paid for each class.
3. For eligible two-year-olds who were not nominated in their breeding year: the nomination fee is
$150 plus a $50 office fee, due by May 1st of the two-year-old year. Additional sustaining fees
apply.
E. All nomination, sustaining, and late fees stay with the applicable class.
IX. Weanling Halter Futurity
A. There will be two halter classes offered: 1) Fillies, 2) Stallions and Geldings. Regular and solid
paint bred will be shown together.
B. When the number of foals in either class (stallion or filly) equals 15 or more, that class (stallion or
filly) will be split by date of birth. Division of age groups in the weanling classes will be announced
the day of the futurity show.
C. Weanlings must be checked in and paid in full at the show office prior to the start of the posted
show time. Any weanlings not checked in by deadline are disqualified from the applicable futurity
class. Any sustaining payments for such disqualified weanling(s) will remain in the applicable class.
X. Yearling Halter and Longe Line Futurities
A. Yearlings can show both Halter and Longe Line classes. Separate fees apply.
B. There will be three halter classes offered: 1) Stallions, 2) Geldings, and 3) Mares.
Stallion/Gelding status must be identified by August 15.
C. Longe Line class will be conducted under rules set by the APHA. Class splits and working order will
be determined by the show management.
D. Yearling Halter Fee Structure:
1. A one-time “Early Bird” payment of $60 will be accepted, due by May 1.
No subsequent sustaining payments needed.
2. OR: Fees may be paid in three installments:
A: First Sustaining Payment - $25.00 due by June 1
B: Second Sustaining Payment - $25.00 due by July 1
C: Third Sustaining Payment - $25.00 due by August 1
E. Yearling Longe Line Fee Structure:
1. A one-time “Early Bird” payment of $100 will be accepted, due by May 1.
No subsequent sustaining payments needed.
2. OR: Fees made be paid in three installments:
A. First Sustaining Payment - $25.00 due by June 1
B. Second Sustaining Payment - $50.00 due by July 1
C. Third Sustaining Payment - $50.00 due by August 1
F. Failure to submit payments on or before the due dates will cause the horse to be ineligible to show;
however, reinstatement will be granted through September 1st upon payment of double the amount
of all missed fees. Entries will be accepted after September 1st until the start of the futurity show,
with a $250 late fee, plus all other applicable fees.
XI. 2-Year-Old Western Pleasure Futurity
A. Fee Structure:
1. A one-time “Early Bird” payment of $100 will be accepted, due by May 1.
No subsequent sustaining payments needed.
2. OR: Fees may be paid in three installments:
A. First Sustaining Payment - $25.00 due by June 1
B. Second Sustaining Payment - $50.00 due by July 1
C. Third Sustaining Payment - $50.00 due by August 1
B. Failure to submit payments on or before the due dates will cause the horse to be ineligible to show;
however, reinstatement will be granted through September 1st upon payment of double the amount
of all missed fees. Entries will be accepted after September 1st until the start of the futurity show,
with a $250 late fee, plus all other applicable fees.
XII.
Payback Schedule
A. Payback is based upon number of horses shown as follows:

B. After the first fifteen (15) horses, 1 place will be paid for every three (3) additional horses in each
class.
C. The Weanling Futurity purse will be divided according to how many foals will be shown in each of
the weanling classes. (Example: 25 Weanlings: 10 early stallion = 28.6%, 10 late stallions =
28.6%, 15 fillies = 42.8%, for a total of 100%).
D. The 15% designated for the Yearling Futurity from the 2010 Auction will be added to the purse and
the purse divided according to how many horses are shown in each of the yearling classes.
(Example: 50 yearlings shown: 20 Longe Liners = 40%, 5 Stallions = 10%, 10 Geldings = 20%, 15
= 30%, for a total of 100%). Sustaining fees and late fees will stay with the class.
XIII.
Special Award
As an incentive to show horses as Weanlings, Yearlings and 2-year-olds in the Select Futurity, an
award will be given to the horse accumulating the most points in the Select Futurity over all three
years. (Horse must be shown all three years). This special award was added with the 2008 Auction;
the first award will be presented in 2011.
XIV.
Disclaimer
The MPHA Board of Directors reserves the right to interpret, amend and enforce these rules. Any decision
concerning the application or interpretation of these rules by the MPHA Board of Directors shall be final.
Any person participating in this Futurity including but not limited to owners, exhibitors, handlers and
consignors shall indemnify and hold harmless the Minnesota Paint Horse Association, its officers, directors
and employees, from and against all claims, demands, causes of action and expenses of every kind,
including fees, arising out of or related in any manner to the acts or admissions of an owner, exhibitor,
handler or consignor. Every person and legal entity by participating in this futurity does thereby agree 1)
if unsuccessful in an attempt to overturn MPHA decisions, actions or regulations to reimburse the MPHA
for its reasonable attorney fees, court costs and other reasonable expenses incurred in defense of such
suit and, 2) That no action will be commenced whether in law or equity against the MPHA in a court other
than the district court in the county in which the MPHA Secretary, at the time of dispute, resides.
