(UZ) NAVIGATION AND HYDROGRAPHY SERVICES CODE CODE ON NAVIGATION AND HYDROGRAPHY SERVICES Law No. Date Adopted Official Gazette of Publication Publication Code : 1738 : 30/5/1973 : Date: 7/6/1973 No: 14557 : Group: 5 Volume: 12 Page: 2281 Department of Navigation and Hydrography: Article 1 – Within the territories of Turkey, the Navy Command and the Organization under its supervision will carry out the navigation and hydrographic services defined in article 3 hereof. Concepts: Article 2 – For the purposes of this law: a) “The Organization” means the Department of Navigation and Hydrography that will carry out navigation and hydrography services under the supervision of the Navy Command, b) “Hydrographic” means the field of science that measures and studies all fundamental aspects that should be known about oceans, rivers, and other waters as well as the shorelines surrounding them for safety and facility of navigation, and publishes the same for use by seamen, c) “Oceanography” means the field of science that examines the physical, chemical, geological and biological characteristics of the oceans and the geological, physical and meteorological characteristics and interactions between the earth and air in contact with the oceans, d) “Marine geophysics” means the field of science that examines the magnetic, gravimetric and seismic effects of the earth on oceans and the submarine structures of the earth, and conducts military, academic and economic assessments of the same, e) “Navigation aids” refer to amenities and tools that assist safety and facility of vessel navigation in view of both national and international standards such as sea lights, light buoys, beacon radios, visual navigation signs, and electronic positioning facilities and stations, f) “Nautical publications” refer to publications that include information to assist navigation safety such as various publications concerning vessels and navigation, announcements distributed to seamen and such others. Navigation and hydrography works: Article 3 – Navigation and hydrography works in oceans, shores and navigable lakes and waterways include the following: a) To conduct hydrographic, oceanographic and geophysical surveys, research and assessments for military, economic and scientific purposes, b) To archive all kinds of data, plans and maps, copies of which must be furnished to the Organization in connection with hydrographic, oceanographic and geophysical surveys and studies that are assigned to private agencies by public and private organizations and persons, c) To coordinate hydrographic, oceanographic and geophysical surveys and studies conducted by public and private organizations and persons, d) To obtain the Organization’s opinion on projects and proposals prepared by concerned bodies in connection with locations and types of navigational aids to be installed, replaced or removed for safety and facility of navigation, for safety and facility of navigation, e) To assess to ensure safety of life and property in oceans and to give opinion during the preparation of projects and plans for all kinds of facilities to be built or contracted to third 1 (UZ) NAVIGATION AND HYDROGRAPHY SERVICES CODE parties by competent bodies as well as regulations concerning maritime traffic, ports and waterways for safety and facility of navigation, f) In order to ensure safety of life and property in and on the seas, to review and verify notices received by the Organization, and to publish them after correcting the same, g) To execute, pursuant to Council of Ministers’ decrees, the implementing provisions of international organizations and treaties applicable to Turkey in respect of international navigation, hydrographic, oceanographic and geophysical aspects. Publication works: Article 4 – In order to ensure that the navigation, hydrographic, oceanographic, and geophysical works as per Article 3 hereof are functional, to prepare, compile and publish special maps, plans, books and brochures, sea maps and nautical publications that will be given to: a) Relevant units, organizations and offices of the Turkish Armed Forces, b) Ministries, corporate public organizations, c) Private organizations and persons that are deemed relevant, d) International or foreign government organizations, upon consent of the General Staff. Methods concerning confidential publications will be described in applicable regulations to be issued. Article 5 – All kinds of risks to safety of life and property reported by concerned persons will be announced to the concerned by using the means of the Turkish Radio and Television Organization or coast radio stations of the Turkish Post-Telegram and Telephone Administration or all kinds of other broadcasting means, subject to the conditions applicable to Government notices and free of charge. Determining and supplying necessities: Article 6 – Subject to management within the Department of Navigation and Hydrography’s General Budget. Article 7 – (Annulled: 10/6/1985 - 3225/art. 16) Article 8 – The navigation and hydrographic works defined herein, and requests by public organizations and persons, in consideration of the organization’s own services, will be resolved once a year in a meeting to be held with the participation of authorized representatives from related public and private organizations pursuant to an invitation by the Navy Command and under the chairmanship of an officer to be designated by the Navy Command. Decisions taken in such meetings will be finalized upon approval by the Council of Ministers. The meeting will convene prior to referral of the budget for such services to the Turkish Grand National Assembly. The Organization is authorized to meet extramural and urgent needs and to do works that the Organization may deem necessary without prejudice to the program approved by the Council of Ministers. Article 9 – In order to accomplish the annual work programs approved by the Council of Ministers, expenses concerning the demands by the ministries and public organizations will be provided as follows: 2 (UZ) NAVIGATION AND HYDROGRAPHY SERVICES CODE Allocation necessary for work demands of general budget organizations covered by the program will be carried to the applicable budget provision of the National Defense Ministry, Navy Command at the time of budget preparations according to relation. In view of the amounts for works to be carried out by organizations and enterprises with annexed budgets, the Ministry of Finance will be authorized to enter as income in the miscellaneous income section of the general budget, and accordingly to enter as allocation in the special provisions to be opened at the end of the budget applicable to the organization undertaking the work and to transfer the year-end balance amounts to the special provisions to be opened in the subsequent year’s budget. Staff and personnel affairs: Article 10 – The provisions of this Law will be applicable regarding the assignment of the Organization’s chairman and the officers, noncommissioned officers and soldiers who will work in the Organization, and the relevant regulations will be applicable for the assignment of non-military personnel to be employed. Regulations: Article 11 – Regulations that define the rules of implementation of this Law, the organization and operation of the inter-ministerial council, and the publication, distribution and keeping of confidential information will be issued by a decision of the Council of Ministers within one year of the effective date hereof. Assets of the Organization: Article 12 – The Navy Command will be liable to supply to the Organization real assets, vessels, equipment, tools and other materials that the Organization requires. Effect: Article 13 – This Law will take effect as of the start of the financial year following its publication. Execution: Article 14 – This Law will be executed by the Council of Ministers. 3
