I, the Applicant (which shall include a parent/guardian if the Applicant is under 18), agree to be bound be the following terms and conditions on which I will study the Art of Rhee Taekwondo:
Guidance on construction of this Contract
This Contract comprises the Membership Application Form and these Terms and Conditions. In the event of ambiguity these terms and conditions will prevail to the extent of the inconsistency.
A provision of this Contract (including waivers and disclaimers, and exclusion clauses) will not be construed to the disadvantage of a party solely on the basis that it proposed that provision.
All provisions of this Contract will be construed so as not to be void or otherwise unenforceable. If anything in this Contract is void or otherwise unenforceable then it will be severed and the rest of the Contract remains in force.
This Contract shall be construed in accordance with, and any matter relating to it is to be governed by the law of the State of New
South Wales. The parties submit to the non-exclusive jurisdiction of the courts of the State of New South Wales.
Injury Waiver and Indemnity:
The Applicant warrants that he/she is in good health and that he/she has not suffered, is suffering or is receiving treatment for any disorder, disability, illness or injury that may make it unsafe for the Applicant to participate in Rhee Taekwondo. All current or pre-existing medical conditions of the Applicant have been disclosed to Rhee Taekwondo. ( )2
The Applicant is aware that Rhee Taekwondo may be dangerous and that he/she participates in activities in relation to Rhee
Taekwondo entirely at his or her own risk and on the basis that such activities are entirely voluntary he/she will elect not to participate in any activity that s/he feels involves risk of injury. ( )3
The Applicant holds Rhee Taekwondo including its instructors and members harmless from any loss, damage or expense, claims, or personal injury suffered whether through negligent act or omission, breach of duty (including a statutory duty) but excluding any willful misconduct or unlawful acts of Rhee Tae Kwon Do (including its instructors and members) arising from or in connection with participation in the study of the Art of Rhee Taekwondo. The Applicant waives all rights in respect of any such loss or damage. ( )4
Disclaimer:
To the extent permissible by law Rhee Taekwondo disclaims all responsibility for any loss, damage, personal injury or expense suffered by the Applicant whether through negligent act or omission but excluding any willful misconduct or unlawful acts of Rhee
Tae Kwon Do (including its instructors and members), arising from or in connection with participation in the study of the Art of Rhee
Taekwondo including through participation in lessons or using the Art whether within or outside of Dojang (place where Rhee
Taekwondo is taught or studied) or at grading examinations.
