Amended and Restated Declarations and Covenants Sun Country Meadows Filing No. 5 ARTICLE 7 CULVERTS Each lot owner shall install, where necessary and at their own expense, Elbert County approved culverts at the point of access from platted Subdivision roads to their property. ARTICLE 8 DAMS AND RESERVOIRS Owners of the lots in the Subdivision shall not construct ponds or dams or in any way obstruct the natural flow of water through the Subdivision. ARTICLE 9 ANIMALS It is expected that owners will exercise proper animal care and management and animals will be disallowed on a lot if sanitation is not properly maintained and are not properly cared for. Each owner is responsible for providing shelter and enclosures for the animals and verifying that their well permit allows domestic animal watering. All animals must be kenneled or kept in a fenced enclosure and not allowed to roam any other property unrestricted or unrestrained. Animals shall be permitted, as defined in Part 2, section 23B, of the Elbert County Code. (Household Pets), inclusive of, but not limited to, dogs and cats shall be permitted in all zones, allowing residential use provided that not more than four (4) animals of more than (4) months of age kept by the property owner or occupant of any residential unit. (Kennels, boarding facilities, and commercial activities, are not allowed.) This provision does not apply to tropical fish; rodent animals (gerbils, hamsters, etc.) and small birds kept as pets, unless raised for commercial purposes, kept outdoors or kept in an accessory structure. Domestic Hoofed livestock (Noncommercial) (PART 2 SECTION 23C, 1 and 2) shall include, but are not limited to, horses, cattle, mules, sheep, and goats. The following restrictions shall apply to such animals allowed in the R-1 zone (1-2.499 acres). Only two (2) equine shall be allowed. No other large animal, such as cattle, sheep, swine, and goats shall be allowed. The maximum density is one (1) animal unit per one-half (1/2) acre. One (1) horse, mule or bovine = 1 unit One (1) swine = 1 unit Two and half (21/2) alpacas = 1 unit Four (4) miniature horses = 1 unit Five (5) sheep or goats= 1 unit One (1) llama = 1 unit Two (2) ostriches = 1 unit Page 5 Domestic, noncommercial use of poultry, foul or small livestock, PART 2 SECTION 23D, 1, b, shall include, but not limited to chickens, turkeys, pigeons, small birds and ducks. Small livestock shall include, but not limited to rabbits, chinchillas, or similar animals. A maximum number of fifteen (15) poultry and/or foul and twenty-five (25) rabbits or other small livestock shall be allowed. PLEASE SEE ELBERT COUNTY CODE PART 2 SECTION 23 FOR FURTHER RESTRICTIONS. ARTICLE 10 WATER AND SANITARY SEWAGE FACILITIES Installation of a water supply well and sanitary septic tank or other acceptable sanitary waste disposal system shall be the responsibility of each lot owner, and all such installations shall comply with all standards imposed by the County of Elbert, the State of Colorado, or any other governmental authority having jurisdiction. Each lot will be entitled to a Denver formation water well, the use of which shall be subject to such limitations as set forth on the Subdivision plats. ARTICLE 11 NATURAL FOLIAGE No trees or other natural foliage, except weeds and brush, located upon any lot shall be cut, trimmed removed or destroyed, except with the prior approval of the Developer. ARTICLE 12 EASEMENTS AND BRIDLE TRAILS Easements for the installation and maintenance of utilities, drainage, construction slopes, road, road maintenance, snow storage, school student storm shelters, temporary cul-de-sacs, and existing pipelines are hereby established and reserved as shown or described on the recorded plat of the Subdivision. Easements for the bridle trails and hiking are hereby established and reserved as shown or described on the recorded plats of the Subdivision for the use and benefit of the owners of all lots in the Subdivision. Except as approved by the Developer and Association, no shrubbery, trees or plantings shall be placed on, and no buildings, fences, or other structures of any type shall be built over or across any such easements, and such easements, shall remain open and readily accessible for use by the beneficiaries thereof. The developer or the Association shall have the right to adopt and enforce reasonable rules and regulations covering the use of such easements, including rules prohibiting or regulating the use of any motorized vehicle, and the association shall have the right and responsibility to clear, grade, or otherwise improve and maintain such areas.
