TAC WIN A DOUBLE PASS TO THE 2016 AUSTRALIAN OPEN MEN’S AND WOMEN’S FINALSOCIAL MEDIA ‘THE LOOK’ COMPETITION CONDITIONS OF ENTRY Promoter: Transport Accident Commission (ABN 22 033 947 623) of 60 Brougham Street, Geelong, Victoria, 3220. Entry and Eligibility 1. Information on how to enter, the mechanics of entry, and prizes forms part of these Conditions of Entry. 2. Entry into the competition is deemed acceptance of these Conditions of Entry. 3. Entry is only open to persons who at the time of submitting their entry are residents of Australia and are not an employee, or related to an employee of the TAC, Graffiti, Tennis Australia or one of its agencies connected with this competition. 4. The competition opens at 9:30am (AEST) on Monday 18th January 2016 and closes at 20:00 (AEST) on Thursday 28th January 2016 (Competition Period). 5. To enter, entrants must upload a picture of ‘their look’ to Instagram, Twitter or Facebook and hashtag #thelook during the Competition Period. Multiple entries will be accepted. 6. Entrants must ensure their relevant social media account is made public otherwise their entry will be deemed invalid. 7. Entries must be received by 20:00 (AEST) on Thursday 28th January 2016 and the winner will be selected at 10.00am (AEST) on Friday 29th January 2016. The draw will take place at TAC’s nominated agency Graffiti Group (ABN 44 110 497 786) at Level 2, 16 Palmer Parade, Cremorne, Victoria 3121. 8. An entry is deemed to be received at the time of receipt by the Promoter as specified in Condition 7 and not at the time of transmission. Entries received will be considered final by the Promoter. Entries which are partially or wholly incomplete, inaccurate, erroneous, ineligible or incomprehensible will automatically be deemed invalid. The Promoter accepts no responsibility for late, lost or misdirected entries. 9. The use of any automated entry software or any mechanical, electronic or other means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid. 10. Costs associated with accessing the competition website remain an entrant’s responsibility and may vary depending on the internet service provider used. Contact details entered incorrectly on the competition website by an entrant will automatically deem an entry invalid. Prize draw 11. Each valid entry entered during the Competition Period will be entered into the draw. 2 12. The winner will receive two (2) tickets to each of the 2016 Australian Open Men’s and Women’s Final valued at $1120. The winner must produce identification in a form acceptable to the TAC before the prize is collected or couriered. 13. The winner will be notified by private message on the social platform the winner entered on, on Thursday 29th January 2016. If the prize is not taken by the winner within twenty-four (24) hours the prize will be forfeited and re-drawn. A prize cannot be used in conjunction with any other tickets, discounts or special offers. 14. The Promoter’s decision is final and no correspondence will be entered into. 15. The Promoter may conduct a further draw at the location identified at condition 7 at 10:00am (AEST) on Friday 29th January 2016 to distribute any prizes unclaimed by the date specified under condition 13 whether because the entrant has not responded to a notification under condition 13 or in the event of an invalid entry/entries or an ineligible entrant/s or if an entrant/s is unable to accept a prize or declines to participate in a prize. This requirement is subject to any written directions or requirements given under relevant legislation. GENERAL 16. All additional costs not expressly stated, but which may be incurred in acceptance of a prize are the responsibility of a winner. Such additional costs include, but are not limited to, meals, beverages, spending money, transport to and from the venue, and any other transfers. 17. Winners must conduct themselves in a friendly, courteous and respectable manner at all times during their participation in a prize. 18. Acceptance of and participation in a prize (including but not limited to entry into the venue) is subject to any prevailing terms and conditions of the venue, event organisers and any ticket suppliers (including but not limited to applicable age restrictions, ground security and ticketing), and in particular, health, behaviour, age, safety and responsible consumption of alcohol requirements. 19. No compensation will be payable if a winner is unable to use any element of a prize as stated for whatever reason, including refusal of entry or ejection from the venue or participation in certain activities for health, age, behaviour, safety or responsible consumption of alcohol reasons. If a winner fails to participate in a prize in the manner required, as stated in this condition and in the reasonable opinion of the Promoter, their entry into the competition and the balance of the prize will be forfeited with no compensation payable. 20. Tickets are not replaceable if lost or stolen. Tickets cannot be sold, scalped, auctioned, raffled, pledged, or promoted as an incentive or reward by any third party as an inducement for any person or other entity to enter into any commercial or other arrangements with that third party. Tickets obtained through any of these methods will not be honoured by the Promoter or any prize supplier. 21. If the prize is unavailable for any reason the Promoter reserves the right to substitute the prize for a prize of equal or greater value subject to any relevant legislation or other requirements. 22. The Promoter accepts no responsibility for any tax implications that may arise from any prize winnings. Independent financial advice should be sought. The Promoter accepts no responsibility for any variation in prize value. All prize values are the recommended retail price including GST. 3 23. Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the competition and all entries of an entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid. 24. The Promoter reserves the right to request the entrant produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the entrant’s identity, age, residential address, eligibility to enter and claim a prize, and any information submitted by the entrant in entering the competition, before issuing a prize. 25. Each entrant consents to the Promoter accessing their driving and driver’s licence history in order to confirm their eligibility to enter the competition and be issued a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or an entry or entrant has not been verified or validated to the Promoter’s satisfaction then all the entries of that entrant will be ineligible and deemed invalid. 26. The Promoter reserves the right to verify the validity of any and all entries and reserves the right to disqualify any entrant from the competition if the Promoter reasonably believes they have: a. tampered with the entry process; b. submitted an entry which is not in accordance with these Conditions of Entry; c. engaged in any unlawful or other improper conduct calculated to jeopardise the fair and proper conduct of the competition. 27. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved. A prize will only be awarded following any winning entrant validation and verification that the Promoter requires in its sole discretion. 28. Any attempt, deliberate or otherwise, to cause malicious damage or interference with the normal functioning of the competition website or the information on the competition website, or to otherwise undermine the legitimate operation of this competition may be a violation of criminal and civil laws and, should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Conditions of Entry or any other legal obligation by an entrant, the entrant agrees to indemnify the Promoter in full for those losses, damages and costs payable as a debt due on demand. 29. It is a condition of accepting a prize that the participants may be required to sign a legal release or releases in a form determined by the Promoter in its absolute discretion. 30. If a prize or element of a prize becomes unavailable, for any reason beyond the Promoter’s reasonable control, then a comparable prize or prize element of equal or greater value may be awarded in lieu, subject to any written directions made under applicable legislation. 31. If this competition is not capable of running as planned for any reason, including but not limited to war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the competition and/or, if necessary, to provide an alternative prize or prizes to the same value as an original prize or prizes, subject to any written directions made under applicable legislation. 4 32. The Promoter excludes all liability (including negligence) except for any liability that cannot be excluded by law, for any direct or indirect injury, loss and/or damage arising in any way out of the competition. This includes, but is not limited to loss and/or damage arising from: a. technical malfunctions, delays or failures, including those resulting from accessing any materials related to this competition and any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this competition as a result of any technical malfunctions, delays or failures; b. theft, unauthorised access or third party interference; c. lost or damaged entries, prize claims or prizes; and/or d. acceptance and/or use of any prize. 33. As a condition of entering this competition, an entrant consents to, in the event they are a winner, the Promoter using the entrant’s name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing the competition (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the Promoter. The entrant agrees that, in the event they are a winner, the entrant will participate in all reasonable promoted activities in relation to the competition as requested by the Promoter and its agents. 34. In consideration for the Promoter awarding any prize elements to the winner the winner hereby assigns to the Promoter all rights, title and interest in and to all copyright in any material created pursuant to the winner’s participation in any aspect of the prize (Works). The winner acknowledges that the Promoter is free to use the Works and to exercise its rights in relation to the Works and the winner will not be entitled to any fee for such use. 35. An entry and any copyright subsisting in an entry irrevocably becomes, at time of entry, the property of the Promoter. 36. The Promoter and Graffiti Group on behalf of the Promoter collect personal information about an entrant for the primary purpose of including the entrant in the competition and, where appropriate, awarding prizes. If the personal information requested is not provided, the entrant cannot participate in the competition and is deemed ineligible. 37. In addition to the above primary purpose an entrant also agrees that the Promoter and Graffiti Group on behalf of the Promoter may: a. in the event the entrant is a winner, publish or cause to be published the entrant winner’s name and locality in any media, as required under the relevant lottery legislation. b. use the information for research, survey or educational purposes including to contact the entrant in the future for this purpose or to provide the entrant with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. 38. An entrant can gain access to, update or correct any personal information held by the Promoter and Graffiti Group on behalf of the Promoter by contacting Candice McDonald at the Transport Accident Commission, 60 Brougham Street, Geelong Victoria, 3220. A copy of the Promoter’s Privacy Policy in 5 relation to the treatment of personal information collected may be obtained by contacting the Promoter.
