BMDB Database Subsets License Agreement Introduction: The purpose of the BioSecure Association is the promotion of research in the field of biometric identity recognition. To this end, it proposes to distribute subsets of a multimodal biometric database, called BMDB (BioSecure Multimodal Database), which was previously acquired under the European BioSecure Network of Excellence. This distributed database subsets aim at promoting the development and benchmarking of new algorithms for specific biometric modalities. Definition of the Database Subset: The database subset is called multimodal-ds3 as defined in Annex C (called BMDB subset in the following). Licensing of the Database: The transfer of the BMDB subset will be allowed for the sole purpose of research. All requests must be submitted by the researcher’s organization (henceforth the “Licensee”) on behalf of an individual researcher or a research unit. To receive a copy of the database, this document must be signed by the institution’s legal representative committing the license owner to respect the conditions listed below. This License does not give the Licensee any ownership of the BMDB subset, but simply a right of use for research purposes only. The license purchase price of the BMDB subset is fixed by agreement between the parties based on the current rate table available on the BioSecure association website. The price of the subset for this licensee is: 0.00 Euros. The BMDB subset license is granted until 1st January 2016. An extension may be requested at the end of this period. Consent: The Licensee agrees to the following terms and conditions: (a) The BMDB subset, will not be distributed, published, copied, or disseminated in any way or form whatsoever, whether for profit or not, in part or as a whole. This includes further distributing, copying or disseminating to a different facility or organizational unit of the Licensee, if not linked to biometric research. In a project involving private and public entities, data access will be allowed only for the benefit of researchers. (b) Modification and Commercial Use: the BMDB subset, in whole or in part, must not be modified nor used for commercial purposes. The license hereby granted is solely for internal research purposes. The Licensee shall not duplicate nor use the BMDB subset, its contents, or any seal, logo, mark, or phrase associated with or owned by the BioSecure Association to manufacture, promote, or sell products or technologies (or portions thereof) either directly or indirectly. All use of data for profit is prohibited. (c) Publication Requirements: Any publication of copies of images from the BMDB subset, by the Licensee in reports, papers and other documents, or by any other means may only include the images already posted online by BioSecure Association on its website (See the list of corresponding identifiers in Annex C). The publication of any other image extracted from the database is strictly prohibited. Explicit Mention of BioSecure Association: All public documents and reports that use the BMDB subset must explicitly mention the BioSecure Database (BMDB) and the BioSecure Association. (d) In the event of dissolution (Bankruptcy, merger) of the organization that received the BMDB subset, this database must be destroyed and the BioSecure Association must be notified in writing of this destruction. At the end of the license term, in case of no renewal of the license, the holder will have to destroy all the databases it has received. This destruction must take the form of a sworn statement to the Association attesting the effective destruction of the database by the Licensee. (e) Transfer / Security: Transfer is made according to the conditions described in Annex A and Annex B. (f) Applicable Law: the French law shall govern this license. The competent court is the one at the place where the BioSecure Association legally resides.
