All fish kills should be reported to the nearest Alaska Department of Fish and Game and EPA offices in Anchorage as soon as possible. The Department will then investigate the fish kill and report to the EPA. Date, location, estimates of the numbers and kinds of fish killed and the apparent cause of death should be reported, if possible. This information may help biologists in their analysis of the factors causing the kill. These will be on the environmental impact of activities affecting the anadromous fishery resource on National Forest lands and adjacent marine and estuarine environment. R-10 SUPPLEMENT 2600-2004-3 EFFECTIVE DATE: 12/17/2004 DURATION: This supplement is effective until superseded or removed. 2615_exhibit01 Page 3 of 5 FSM 2600 – WILDLIFE, FISH, AND SENSITIVE PLANT HABITAT MANAGEMENT CHAPTER 2610 – COOPERATIVE RELATIONS 2615 – Exhibit 01 MEMORANDUM OF UNDERSTANDING between the National Marine Fisheries Service Alaska Region National Oceanic & Atmospheric Administration U.S. Department of Commerce and Forest Service, Region 10 U.S. Department of Agriculture This memorandum of understanding is entered into by the U.S. Forest Service, Region 10, and the National Marine Fisheries Service, Alaska Region, hereinafter referred to as the Forest Service and the Fisheries Service. It is made for the purpose of establishing a working relationship between the two agencies leading to closer liaison in the development of investigations and reports on the environmental impact of water-use projects and other activities affecting the anadromous fishery resource on National Forest lands and the effect of forest management practices on the adjacent marine and estuarine environment in the Alaska Region. WHEREAS, the Forest Service is responsible for the management of the various renewable surface resources on the National Forest in Alaska, including fish and wildlife habitat; and WHEREAS, the Fisheries Service is responsible for research on marine, estuarine and anadromous fishery resources and for the investigation of the impact of water-use projects and such other similar activities within the area of responsibility of NMFS which may affect these resources and their environment; and WHEREAS, on lands they administer, the Forest Service has the responsibility and authority for correlation and integration of fish and other wildlife habitat management and improvement with all other National Forest resources and uses; and WHEREAS, the Fisheries Service will act in an advisory capacity to the Forest Service in matters pertaining to anadromous fishery habitat management and research on lands administered by the Forest Service. NOW THEREFORE, it is mutually agreed that Forest Service and Fisheries Service work will be coordinated through the procedures listed below R-10 SUPPLEMENT 2600-2004-3 EFFECTIVE DATE: 12/17/2004 DURATION: This supplement is effective until superseded or removed. 2615_exhibit01 Page 4 of 5 FSM 2600 – WILDLIFE, FISH, AND SENSITIVE PLANT HABITAT MANAGEMENT CHAPTER 2610 – COOPERATIVE RELATIONS The Forest Service agrees to: 1. Notify the Fisheries Service when resource developments affecting NMFS areas of responsibility are proposed by any private or governmental agency, and prior to initiation of any investigations in those areas of responsibility. 2. Specify extent of Forest Service interest and cooperation in the research, planning and execution of any Fisheries Service project investigations involving anadromous fishery values. 3. Notify the Fisheries Service of Forest Service plans to conduct studies involving water-use activities in NMFS area of responsibility and the need and extent of direct coordination and cooperation. This includes studies of log rafting and dump sites, interdisciplinary team surveys and the preparation of environmental analyses and environmental statements. 4. Coordinate the fishery habitat segments of various required reports with the Fisheries Service prior to submission to the constructing or licensing agency. With respect to lands administered by the Forest Service, the Fisheries Service agrees to: 1. Notify the Forest Service as soon as notification of a water-use or other similar project proposed for National Forest lands is received from a constructing agency or licensing agency prior to initiation of any investigations. 2. Work closely with the Forest Service in planning and coordination of the research and investigations necessary to formulate the NMFS report on the effects of such projects on marine, estuarine or anadromous fishery resources and their environments. 3. Coordinate required reports with the Forest Service, including investigative reports on location of log rafting and dump sites, prior to submission to the constructing or licensing agency. The Fisheries Service and the Forest Service agree: 1. That every attempt will be made to resolve significant differences concerning any particular segment of their respective reports before submission to the constructing or licensing agency; however, when such difference s cannot be resolved, each agency will submit its report with a statement identifying the area of differences and defining the reason for lack of agreement. That research and investigation done under this memorandum of understanding and any specific funding and working arrangements developed in connection with it will be governed by the appropriations available to the agencies involved. 3. That this agreement shall become effective as soon as signed by the parties hereto and shall continue in force until terminated by either party upon 30 days notice in writing. 4. That amendments to this memorandum may be proposed by either party and shall become effective upon mutual approval. 5. That this agreement supersedes a similar agreement dated February 18, 1966.
