Data Protection Act 1998 privacy notice – Personal information of any kind, including sensitive
information like convictions, supplied by applicants on a licence application form or associated
documents may be stored on a computer and/or paper file system by the authority (Moray Council
and/or Moray Licensing Board) as part of the licensing process. Wherever possible the authority
will take steps to preserve privacy e.g. by the use of case reference numbers rather than names.
Information may be shared with and received from: Other council departments; other
councils/authorities; government departments; the police; the fire and rescue service; and other
relevant parties e.g. community councils or courts.
Information may be shared by: any method. Public-sector organisations can share data privately
and securely by sending emails via the UK Government Connect Secure Extranet (GCSX). In
addition they can communicate with other authorities Europe wide via the EC’s secure Internal

You must answer all of the questions as fully as you can as failure to do so may result in your
application being returned to you. Your application will not be processed until you have provided all
the necessary information.
A.
PERSONAL DETAILS
You require to complete this section if you are an individual person applying for a Riding
Establishment Licence. It is essential that your full details are supplied on the application form
so that necessary Police checks can be undertaken swiftly and so your application can be
progressed as quickly as possible.
B.
BUSINESS DETAILS
You require to complete this section if the Establishment is run by a company or partnership
rather than an individual person. Please include the details of any Partners, Directors
responsible for the management of the business.
C.
LICENCE DETAILS
A Riding Establishment licence generally lasts for a maximum of 1 year although the Licensing
Authority have the discretion to grant it for a shorter period. Once it expires you can apply to
renew it for a further 1 year.


Grant of a Licence (1 year) – If you have never held a Riding Establishment Licence
before or you do not currently have such a licence you need to apply for the Grant of a
licence. The fee for a grant is £.
Renewal of Licence (1 year) – If you currently hold a Riding Establishment Licence
which has not expired but is due to expire then you need to apply for a Renewal of the
licence. The fee for a renewal is £. The old licence remains in force until the renewal is
granted, but only if application is made before the expiry date.
If you are applying for the grant of a licence you are asked questions on the form as to whether
you have previously held a licence in the United Kingdom or whether you have been refused
such a licence previously. Please note it is very important that you complete these questions
fully.

ESTABLISHMENT DETAILS
You are required to supply the full postal address and telephone number of the establishment to
which the licence is to relate, including emergency procedures and supervision. Please also
include the details of the person who will have direct control of the management of the
establishment including any certificates held and/or experience in the management of horses.

DISQUALIFICATIONS
Please give details of any disqualifications under any of the acts detailed include dates and
length of disqualification.

CONDITIONS SUBJECT TO WHICH LICENCE IS GRANTED
1.
The holder of the licence must be suitable and qualified either by experience in the management
of horses or by being the holder of one or more of the following approved certificates:
a) Assistant Instructor's Certificate or Instructor's Certificate and Fellowship issued by the British
Horse Society;
b) Fellowship of the Institute of the Horse;
c) Any other certificate for the time being prescribed by order by the Secretary of State or by
employing in the management of the riding establishment a person so qualified to be the
holder of such a licence.
2. All horses must be maintained in good health and horses kept for letting-out on hire or kept for
riding instruction will be suitable for the purpose for which they are kept.
3. The feet of all horses must be properly trimmed and, if shod, the shoes must be properly fitted.
4. There must be available, at all times, accommodation as respects construction, size, lighting,
ventilation, drainage, and cleanliness suitable to the number of horses kept.
5. There will be available, at all times, adequate pasture, shelter and water for horses maintained at
grass, and supplementary feeds will be supplied as and when required.
6. All horses must be adequately supplied with suitable food, drink and (except in the case of horses
maintained at grass so long as they are so maintained) bedding material and they must be
adequately exercised, groomed and rested and visited at suitable intervals.
7. All reasonable precautions must be taken to prevent and control the spread of infectious or
contagious disease among the horses and veterinary first aid equipment and medicines shall be
provided and maintained within the premises.
8. Appropriate steps must be taken for the protection and extrication of horses from the premises in
case of fire and the name, address and telephone number of the licence holder or other
responsible person must be displayed in a prominent position on the outside of the premises
together with instructions as to action to be taken in the event of fire, particularly with regard to the
extrication of the horses.
9. Adequate accommodation must be provided for forage, bedding, stable equipment, and saddlery.
10. Any horse found, on inspection by an authorised officer of the Local Authority, to require
veterinary attention shall not be returned to work until the licence holder has obtained, at his own
expense and has lodged with the Local Authority, a Veterinary Certificate that the horse is fit for
work.
11. No horse will be put on hire or used for providing instruction in riding without supervision by a
responsible person of the age of 16 years or over unless the licence holder is satisfied that the
hirer is competent to ride without supervision.
12. At no time shall the carrying on of the business of riding establishment be left in the charge of a
person under 16 years of age.
13. The licence holder must hold a current insurance policy which insures him against liability for any
injury sustained by those who hire a horse from him for riding and those who use a horse in the
course of receiving from him, in return for payment, instruction in riding and in respect of any
liability which may be incurred by them in respect of injury to any person caused by or arising out
of the hire or use of a horse as aforesaid.
14. The licence holder shall keep a register, which shall be available for inspection by any authorised
officer of the Local Authority at all reasonable times, of all horses in his possession aged 3 years
and under which are usually kept on the premises.
15. If a complaint relating to a licenced riding establishment is made and substantiated by the
authorised veterinary surgeon, the fees incurred shall be borne by the licence holder.
16. All fees for inspections made by the authorised veterinary surgeon to confirm that conditions
attached to a provisional licence have been complied with shall be borne by the licence holder.
