WHO DEALS WITH THE REGISTRATION?
1.
The Licensing Service, based at Hackney Service Centre, 1 Hillman Street, London, E8 1DY is responsible for registering
massage / special treatment practitioners. Our licensing staff will be able to answer your queries; you can ring them on 0208 356
2431 between 9.00am - 5.00pm, Monday to Friday.
WHO REQUIRES REGISTRATION?
2.
Any practitioner who carries out any of the functions listed below at premises located within the London Borough of Hackney
requires registration. This registration will allow the practitioner to work at any premises licensed by the London Borough of
Hackney for a period of three years.
DO YOU REQUIRE A LICENCE?

The following lists set out treatments which are considered to fall into the definition of special treatments as set out in the London
Local Authorities Act 1991. If you are providing any of the listed treatments you require registration.

HOW TO APPLY FOR REGISTRATION

Applications for registration must be made in person to the Licensing Service, Service Centre, 1 Hillman Street, London, E8 1DY,
telephone 020 8356 2431.
The application form must be fully completed and the following enclosures must be brought into the office in PERSON:



Two recent passport size photographs;
A copy of all relevant qualifications / certificate that covers treatments which you wish to be licensed for;
Proof of identity (for example, passport or birth certificate and one other form of identification confirming your current
address);
 Relevant fee
The non refundable fee for registration is £100.00 Cheques / postal orders should be made payable to the LONDON
BOROUGH OF HACKNEY.
Should you place non-specific terms such as ‘Body Treatments’ or ‘Beauty Therapy’ only on the application form as
treatments to be provided it will be returned as invalid as the Council requires FULL details of the treatments to be
provided.
Registrations are valid for a period of three years.
On completion of your application form you are required to comply with various conditions. However it must be pointed out that
you will be consenting to the disclosure by the Police to the Council of any record of your criminal convictions (other than spent
convictions within the meaning of the Rehabilitation of Offenders Act 1974).

WHAT HAPPENS AFTER YOU APPLY?

When your application is received a consultation process is carried out. The following people are consulted about your
application:


Police
Training organisation
If no objections are received, registration will be issued with standards conditions and any other special conditions that may be
considered appropriate.
If any objections are received, the application will be considered by the Licensing Committee.
GROUNDS FOR REFUSAL OF REGISTRATION

These are as follows:



The applicant cannot be reasonably regarded as being a fit and proper person to hold a registration;
The applicants training do not cover the treatments applied for;
The applicant has made a material statement which they know to be false in respect of their application;
The applicant has failed to comply with the requirement to submit such particulars as the Council prescribed, and / or has
failed to pay the fee.
ATTENDANCE AT COMMITTEE

This is open to any member of the public to attend as an observer
The applicant and objector (s) may be represented by a barrister, solicitor or any other person they choose.
Applicants and objector (s) may bring any person to support their case, however hearsay evidence is not normally allowed. Those
giving evidence should therefore only speak of matters within their own knowledge. They should not, for example, refer to oral
complaints made by other people.
Each party will be given the opportunity to question anything said by the other side.

The decision of the Sub-Committee will normally be announced at the end of the hearing and, in addition, all parties will be notified
in writing.
The Council has no power to award costs to either side.
NOTE: A copy of the hearing procedure is available on request.
APPEALS
8.
A person refused an application or who is aggrieved by any term, condition or restriction attached to the licence can appeal to the
Magistrates’ Court. The Council is the party who defends any such appeal but the Court re-hears all the evidence for and against
the grant of the application or the imposition of the term, condition or restriction as the case may be. A person aggrieved by the
order of a Magistrates’ Court on any such appeal has a right to appeal to the Crown Court. An objector aggrieved by the Council’s
decision does not have these rights of appeal but is entitled to object again when the licence comes up for renewal.
REVOCATION
9.
The Council may at any time revoke the licence if any condition imposed is broken.

EXEMPTION OF PRACTITIONERS
10.
The exemption application is for members of accepted Professional Bodies that want to administer special treatments in the
London Borough of Hackney. Exemptions will only be granted for authorised treatments to bona fide members of the bodies listed at
Appendix 1 in the guidance notes and will be granted annually.
11.
You must provide the completed application form and the following:

copies of all relevant membership and qualification certificates for all operatives.
EXEMPTION PRACTITIONER
Fee: £00.00 (Zero)
Registrations are valid until the following April the 1st. (i.e. if you apply in January 2012, the registration would be valid until the 1st of April
2012).
