ENFORCEMENT REGULATIONS OF THE HOUSEHOLD REGISTRATION LAW

Chapter 1 General Provisions

Article 3
These regulations are enacted in accordance with Article
60 of Household Registration Law (hereafter referred to as
"the present Law").
The authority in charge of household administrations shall
be the Civil Affairs Bureau of municipal and county (city)
governments.
All forms and lists for processing census and household
registrations shall be produced by the census offices or
municipal and county (city) governments.
In any alteration made to the entries of the census or
household registration forms and lists there shall be
affixed with the chop of the person who makes the alteration.
Article 4 Every authority that needs domiciliary information of its
clients may ask the census authority to provide, or may
transcribe and check by itself.
The authority that need the information of its clients
mentioned in the previous paragraph, which has built

computerized operation system shall apply by regulation
for the linkage with the census information system in order
to obtain such information.
The household is categorized as follows:
1. Common living household: It means the ordinary household
of which the residents live together in the same family
or place.
2. Common business household: It means the factory, shop,
temple, organization, school or any other public or

private place engaging in common businesses in the same
place and under the same managing person.
3. Independent living household: It means the resident who
lives independently in a place. If there are different
households in the same place, the households shall be
separated according to the nature of such households.
The name of a common business household, if any, shall
be indicated.
For the census and household registration, there shall check
and record the household in which up to three existing
residents have resided or three and more are expected to reside.
In the common living household, the members are placed in the
following order:
1. The head of household
2. The spouse of the head
3. The lineal ascendants of the head
4. The lineal descendants of the head
5. The side relatives
6. Other relatives
7. Lodgers
In the common business household, the head stands in the first
place, followed by his/her employees and lodgers. If the head
has the common living household or independent living household,
the address of such household shall be indicated.
Chapter 2 Household

Registration
Household registrations shall be made through applications by
applicants, except the Initial household registration made after
census or those pursuant to Article 39, Article 40, the proviso
of Article 42, the third to fifth paragraphs of Article 47 of the
present Law.
Article 9 The information of household registration mentioned in Article 6
of the present Law means various application forms for the
registration, evidencing documents in file, books, cards and
media stored in computer.
Article 10 When processing initial household registration in a domiciliary
registration area, the census office shall input the information
obtained from census into computer system, with copies bound into
volume by village (li) sent to the municipal or county (city)
government for filing.
Article 11 The applicant shall sign or affix chop on the application form for
household registration, except that made by the census office
straightly.
A case involving two and more registrations shall be separately
registered.
Article 12 Except the household number, name of the head, party concerned
and applicant, citizen’s identification card number, address,
date of application that shall be indicated, the household
registration application form shall be elaborated with the
information in accordance with the following requirements:
1. Birth Registration: The order of birth, date of birth,
birthplace, and names and birth dates of parents of the
child borne. The abandoned or helpless child without a name
may be given one by the rearer or the accommodating children
welfare organization, and the date of birth may be inferred
by law. The names of the rearer and the organization shall be
indicated.
2. Acknowledgement registration : The order of birth, date of
birth, and name of natural mother of the adoptee, the name of
adopter, and date of adoption.
3. Adoption or Adoption Termination Registration: The order of
birth, date of birth, name of spouse and names of natural
parents of the adoptee, the name of adopter, and date of
adoption or termination of adoption. When the adoptee is an
abandoned or helpless child, there shall be indicated with
the name of rearer or the accommodating children welfare
organization.
4. Marriage or Divorce Registration: Both parties' dates of
birth, names of parents and witnesses, and date marriage or
divorce.
5. Death or Death Announcement Registration: The order of birth,
date of birth, date of death or inferred date of death, cause
of death and place of death of the dead.
6. Movement Registration: The order of birth, date of birth,
place of birth, names of parents and spouse, appellation,
and original and new residences of the person who moves in
or out, or alters address.
7. Guardianship Registration: The date of birth of the person
under guardianship, name of guardian, relationship between
both parties, cause of guardianship and date on which the
guardianship begins.
8. Initial Household Registration: The order of birth, date of
birth, place of birth, names of parents and spouse, and
appellation of the person who makes the Initial Domiciliary
Registration.
9. Alteration, Correction, Revocation and Deletion Registration:
The original cases or items or those subject to registration,
and the causes and date of alteration, correction, revocation
or deletion. In the Birth, Marriage or Divorce, and Death or
Death Announcement Registration
application forms mentioned in the previous paragraph, there
may be recorded the educational backgrounds of the persons
concerned or the parents of the child borne.
For the party concerned who is the aboriginal inhabitant, the
household registration application form mentioned in the first
paragraph shall be indicated with his/her identity of aboriginal
inhabitant and race.
The numbers of citizen’s identification card and household
Article 13
mentioned in the first paragraph shall be assigned by the census
office.
For the following registrations, the applicant shall furnish
evidencing documents when making application:
1. Birth Registration
2. Death or Death Announcement Registration
3. Acknowledgement registration
4. Adoption Registration
5. Adoption Termination Registration
6. Marriage Registration, however, if both parties and two witnesses
appear on the site to make the registration personally, the marriage
evidencing documents may be exempted.
7. Divorce Registration
8. Guardianship Registration
9. Transfer Registration: for independent household.
10. Initial Domiciliary Registration
11. Alteration, Revocation or Deletion Registration
12. Correction Registration, not for transcription errors.
The original copies of evidencing documents mentioned above, except
those of Birth, Death or Death Announcement and Initial Household
Registrations, shall be retained in the census office after examination.
For the rest documents, the photocopies thereof may be kept for filing.
The documents produced in foreign country shall be certified by a ROC
embassy, representative office, liaison office or any other organization
authorized by the Ministry of Foreign Affairs (MOFA).
The documents produced in Mainland China shall be certified by an
organization established, or a private organization entrusted by Executive
Yuan.

The notification mentioned in the second paragraph, Article 47 of the
present Law shall have a time limit of no less than seven (7) days; such
notification shall be sent to the person who shall make the application.
The notification of Movement, Birth, Death, Correction, Revocation or
Deletion Registration shall indicate that if the application is not made
within the notified time limit, the registration shall be made pursuant
to the third paragraph, Article 47 of the present Law straightly.
The Birth Registration that is registered straightly as specified in the
previous paragraph, the chief of census office may give the name.
After the census office makes straightly the registration pursuant to the
third paragraph, Article 47 of the present Law, it shall notify the
applicant who shall make the registration.
After the census office makes straightly the registrations pursuant to the
fourth and fifth paragraphs, Article 47 of the present Law, it shall transfer
the domicile of whole household to such office temporarily with address
indicated, and notify police department.

For incompleteness of household registrations, the census office shall notify
for correction at a time.
When accepting household registrations, the census office, in addition to
examining the citizen’s identification cards and extract of household
registration, shall register the information of registrations accepted into
computer system, print out the application forms for the registrations, and
make necessary notes in relevant columns of the citizen’s identification
cards and extract of household registration. The forms and photocopies or
original copies of evidencing documents kept shall be bound into volumes

according to village (li) for filing in the office, with copies sent to the
municipal or county (city) government every ten days, which shall be
categorized and bound into volume by year and by village (li).
The entries of household registration shall be registered in the relevant
columns or households, with causes and dates indicated. In case the head
of household has made the registration of alteration, death or death
announcement, moving-out or deletion, such household shall be listed as
deleted and the information thereof shall be copied for retention.
Chapter 3 the citizen’s identification cards and extract of household registration

The citizen’s identification cards and extract of household registration.
shall be produced and printed by municipal or county (city) governments.
However, when necessary, the citizen’s identification cards may be

produced and printed by the Ministry of the Interior.
The citizen’s identification card and extract of household registration
shall be printed out by census offices according to the registered
information, which shall be sent to municipal and county (city) governments
for examination and seal affixing, then returned for issuance. When necessary,
the census offices may examine and affix seals on behalf of those governments
for issuance.
The citizen’s identification card shall have its validity throughout the
whole country.
The citizen’s identification card shall be carried along with oneself, which

can not be seized except by law.
All the citizen’s identification cards shall be affixed with the front-faced
and bust photographs, with the municipal or county (city) governments' iron
seals stamped in the margins. However, the photographs may be exempted if there
are special cases that are approved by census offices.
Article 22
All fingerprints stipulated in Article 8 of the present Law shall be taken from
fingers except that there are no fingers

When any change is to be made on the relocation blank of the identity (ID) card,
it shall be done by the registry office and sealed by the undertaker.
If the ID card is damaged, destroyed, lost, or unable to be made a change, the
cardholder shall apply for a change or a reissue with the registry office where
his or her permanent residence is located. If there is any damage or insufficiency
for a change on the ID card, the cardholder may apply for a reissue with any
registry office outside of the registry office where his or her permanent residence
is located.
On account of death, death pronouncement, rescission of household registration, or
cancellation of household registration, the ID card shall be returned to the
registry office and then be delivered together with other ID cards to the municipal
or the city (county) government for destruction.
Article 24
To apply for an ID card, the applicant shall file the application with the registry
office where his or her permanent residence is located; but for applicants below
fourteen years old, this shall be done by their legal representatives.
Any household which has made a household register shall apply for a household
certificate.
For receiving a household certificate for the first time or for a reissue or a renewal
of it, the householder shall go in person to the registry office where his or her
permanent residence is located, or shall be represented by a person in written form to
do it. For a reissue or renewal, the application may be made with any registry office
outside of the registry office where the applicant’s permanent residence is located.
Chapter 4 Census and Population Statistics

The areas and periods of census shall be prescribed by municipal and county (city)
governments, and shall be submitted to the Ministry of the Interior for examination
and filing.
The date of census shall be stipulated by municipal and county (city) governments.
When making census, the census offices shall issue household labels according to the
sequence of households in each lin, marking the village (li), lin and door plate No.
From the day of census, the offices shall assign personnel to proceed with the census
in the households one by one, and fill out the census papers. The census papers, which
may be substituted with the household registration application forms, shall be filled
out by the census personnel, but shall be signed or affixed with chops of the heads
of households or the agents of the persons who receive census. For the common business
households, the papers may be issued to them for filling out.
The census shall be conducted on household basis; the households shall be grouped
according to village (li), lin and door plate No.
After completing the census and re-checking, the census office shall process the
household registration immediately, and produce result statistics, which shall be
submitted to the Ministry of the Interior .

When the census office makes the census on every household and every member of
household, the chief of each village (li) and lin, as well as the clerks of each
village (li) and policemen of each police precinct shall provide the office with
assistance.
Any person refuses to accept checking or correction of the entries of household
registration without any due reason, the census office shall notify him/her to
make them up when he/she applies for household registrations or various certificates.
When checking the educational background pursuant to Article 50 of the Present Law,
the census office may make the entry of such background straightly in accordance with
the register of graduates' educational backgrounds furnished by different levels of
middle schools and above, the evidencing documents surrendered by the parties concerned,
or the results that the census personnel obtains verbally. When making the entry of
educational background as mentioned above, the titles of school and department may be
exempted.
Article 33
The forms, methods and dates of production of census statistics shall be stipulated by
the Ministry of the Interior .
Chapter 5 Supplementary Provisions

The implementary procedures or supplementary requirements prescribed by each municipal
and county (city) government for census and registrations shall be submitted to the
Ministry of the Interior for examination and filing.
The regulations shall come into force on the date of promulgation.
