Regulations regarding Shared Leave Donation:
Donation of Annual (vacation) Leave (WAC 392-126-080):
Supervisory and 260-day classified employees.
An employee may donate annual leave using the following criteria:
1. The employee may donate any amount of annual leave provided that donation does not cause the
employee's annual leave balance to fall below ten (10) days as of the date of the transfer.
2. Employees may not donate excess annual leave that the donor would not be able to take because
of an approaching date after which the annual leave cannot be used.
3. The donated annual leave must be given voluntarily. No employee shall be coerced, threatened,
intimidated, or financially induced into donating annual leave.
4. Donated annual leave shall be in four-hour increments. Leave may be withdrawn by eligible employees
on an hour-for-hour basis regardless of the individual's rate of pay.
Donation of Sick Leave (WAC 392-126-085):
Non-supervisory certificated and classified employees.
An employee may donate sick leave using the following criteria:
1. The employee must have accrued more than twenty-two (22) days of sick leave.
2. Employees may not donate an amount of sick leave that will result in his or her sick leave account
going below twenty-two days at the date of transfer.
3. All donated leave must be given voluntarily. No employee shall be coerced, threatened, intimidated,
or financially induced into donating sick leave.
