INSTRUCTIONS TO ALL LESSEES, INTEREST OWNERS AND OPERATORS,
REGARDING THE TRANSFER OR ASSIGNMENT OF ANY INTEREST IN
SOUTHERN UTE INDIAN OIL & GAS LEASES .
The Tribe has adopted a new set of instruments to be used in any change of ownership under existing Tribal oil and gas leases and including present and future Minerals Agreements. The forms are specific and detailed below – substitutions will not be approved.
RECORD TITLE ASSIGNMENT
Used to transfer full Record Title interest OR undivided interest in full leases only. Four (4) executed originals must be submitted and the form must be complete as to the following:
A.
SUIT Lease Number (or Minerals Agreement No.)
B.
Assignor’s full name and address.
C.
Assignee’s full name and address.
D.
Full and complete description of lands.
E.
Interest owned by Assignor, amount being assigned and amount being reserved, if any. For Record Title Assignments, ALL or 100% OF AN INTEREST OR AN
UNDIVIDED INTEREST MUST BE CONVEYED . There will be no separation of tracts of the original lease.
F.
Acceptance of Assignee of all terms and conditions.
G.
Evidence of bonding by Assignee. Approval of bonding by the BIA, if required.
H.
Date of trans action (will be date approved by the Tribe, unless otherwise requested).
I.
Evidence of Authority of Officer to execute in the case of Corporate Assignors.
OPERATING RIGHTS ASSIGNMENT
To be used for the transfer of any Operating Rights ( working interest ) in all or any part of the lands in the lease. Four (4) executed originals must be submitted and the form must be complete as to the following:
A. SUIT Lease Number (or Minerals Agreement No.).
B.
Assignor’s full name and address.
C.
Assignee’s full name and address.
D.
Full and complete description of lands.
E.
Interest owned by Assignor, amount being assigned and amount being reserved, specific formation and/or depth restrictions, if any.
F.
Acceptance by Assignee of all terms and conditions.
G.
Evidence of bonding by Assignee. Approval of bonding by the BIA, if required.
H.
Date of transaction (will be date approved by the Tribe, unless otherwise requested).
I.
Ratification of transaction by Record Title Lessee.
J.
Evidence of Authority of Officer to Execute in the case of Corporate Assignors.
TRANSFER OF INTEREST
To be used to assign, sell, transfer or convey overriding royalty; interest in production; production payments, after payout interest; and any other economic interest in oil and gas lease or Minerals
Agreement. Four (4) executed originals must be submitted and the form must include the following:

DESIGNATION OF OPERATOR
To be used for the transfer of any Operating Rights (working interest) in all or any part of the lands in the lease. Four (4) executed originals must be submitted and the form must be complete as to the following:
A. SUIT Lease Number (or Minerals Agreement No.).
B. Assignor’s full name and address.
C. Assignee’s full name and address.
D. Full and complete description of lands.
E. Interest owned by Assignor, amount being assigned and amount being reserved,
specific formation and/or depth restrictions, if any.
F. Evidence of bonding by Assignee. Approval of bonding by the BIA, if required.
G. Date of transaction (will be date approved by the Tribe, unless otherwise requested).
All such Assignments must be submitted to the Southern Ute Indian Tribe, Departmetn of
Energy, PO Box 1500, Ignacio, CO 81137, together with copies of the fees for administrative and filing, to wit:
Administrative Fee $50.00 per lease/agreement payable to the Southern Ute Indian Tribe
The documents will be reviewed by the Southern Ute Indian Tribe, Energy office for review and tribal approval or disapproval. The documents will then be transmitted to the BIA for action to be taken, fees are not refundable.
Upon final approval of the assignment or transfer, one (1) copy will be returned to the newly assigned company. A copy will only be transmitted upon the request to the assignor company. A total of four (4) original signed copies, must be submitted for each desired transaction, only one
(1) original of the Evidence of Authority is necessary). If the assignee or assignor company desires additional executed “originals” same should be submitted to the BIA with appropriate instructions.
