Discuss how to realise, protect and manage a firm’s IP for use, commercialisation, and adherence to legal requirements and good business practice. Looking at selected issues in regards to IP from publicly financed research and development. Developing and implementing an IP Strategy. Visualising a firm’s intellectual assets and prioritising and safeguarding these assets in line with the firm’s strategic direction and objectives. Discussing commercialisation initiatives, specifically licensing activities. Discussing the enforcement of IPR and defending against potential infringers. ABOUT THE PRESENTERS The presenters include: 1 IP/ 1. Prof DR Dres hc Joseph Straus: is a former Director of the Max-Planck Institute for Innovation and Competition in Munich Germany, and the Marshall B. Coyne Visiting Professor of International and Comparative Law at the George Washington University Law School in Washington, D.C. At UNISA he holds the NIPMO-UNISA Chair in Intellectual Property. He has acted as consultant to many national and international governmental bodies, such as the German and Swiss Parliaments and Governments, the European Parliament and the EU Commission, the European Patent Organization, WIPO, OECD, UNCTAD, UNIDO, etc. He has rich experience in counseling companies in important cases. Professor Straus has far more than 300 publications in the field and still lectures in international conferences worldwide. He is the recipient of many national and international awards. 2. Mr. Ugresen Maistry: received his BA and LLB from the University of Cape Town, and his LL.M. in Intellectual Property from The University of Augsburg and the Munich Intellectual Property Center, a Joint venture of the George Washington University Law School, Washington, D.C. the Max-Planck Society, the Technical University Munich and the University of Augsburg. He is a member of the South African Bar and a Solicitor in UK. He was a scholarship holder of the Max-Planck Institute and has collected practical experience in South African Law firms. ABOUT THE PROGRAMME Admission Requirements The credit calculation is based on the assumption that all students have successfully completed at least a bachelor’s degree or equivalent. have the ability to interpret and evaluate texts on a NQF level 7 learn from predominantly written material communicate what they have learnt comprehensibly in the medium of instruction with guided support, take responsibility for their own progress Duration The duration of the course is 6 months culminating in a written examination in October of the year following enrollment. Study material is included and will be provided to students online. The course is offered on NQF level 8 and carries 12 credits. Summary of the Short Learning Programme The work in this module is based on the practice of law, economics, management, current research, legislation and case law. Students will be required to demonstrate a grasp of theoretical basis on which the concept of intellectual property management is founded and the ability to apply this to practical situations; demonstrate an understanding as to the subject intellectual property management with respect to law, management, economics, and accounting; employ appropriate methods, skills and research to implement the principles relating to intellectual property management in a variety of contexts which are typical of the demands set for learners at a level of an advanced short course; discuss how to realise, protect and manage a firm’s* IP for use, commercialisation, and adherence to legal requirements and good business practice; do research in order to produce critical legal arguments and, with guided support, take responsibility for the legal opinions that they advance; discuss selected issues in regards to IP from publicly financed research and development; develop and implement an IP Strategy, including visualising a firm’s intellectual assets and prioritising and safeguarding these assets in line with the firm’s strategic direction and objectives; develop familiarity with commercialisation initiatives, specifically licensing and assignment activities; and develop familiarity with the enforcement issues surrounding intellectual property rights, including defence against potential infringers.
