THE PERMIT ALLOWS:
Demolition of rear outbuildings and of the school-room attached to the rear of the
Synagogue building and development of a multi-level building complex partly on the
footprint of the demolished school-room, part intrusion into the airspace above the
Synagogue building footprint by parts of the new multi-level building complex plus
conservation, compliance and infrastructure works to the retained Synagogue building.
All works are to be in accordance with the Denton Corker Marshall drawings for 502
Albert Street, East Melbourne and the following document, as endorsed by the Executive
Director and forming part of this permit: 7-page (seven-page) Conservation, Compliance
and Infrastructure Works Cost Plan by Donald Cant Watts Corke dated 2 July 2014.
THE FOLLOWING CONDITIONS APPLY TO THIS PERMIT:
1.
Prior to the commencement of any of the works to the registered place approved by this
permit a full set of revised plans and drawings are to be lodged with the Executive Director,
Heritage Victoria, showing a reduction in the amount of cantilevering over the rear of the
Synagogue building. Once approved, these plans and drawings will be endorsed and will form
part of the approved works.

Prior to the commencement of any of the works to the registered place approved by this
permit and as provided for under s.74(4) of the Heritage Act 1995, a financial security in the
form of an unconditional Bank Guarantee in favour of the Heritage Council of Victoria
(ABN 87 967 501 331) is to be lodged with the Executive Director, Heritage Victoria. The Bank
Guarantee is to ensure the satisfactory completion of all of the conservation, compliance and
infrastructure works to the Synagogue building as identified in the Donald Cant Watts Corke
report endorsed as part of this permit. The amount guaranteed shall be eight-hundredthousand dollars ($800,000) and the period of validity of the Bank Guarantee is to be
unspecified.

The Bank Guarantee referred to in condition 2 above shall be released to its provider following
receipt by the Executive Director, Heritage Victoria of a written request from the Principal,
subject to the completion of all of the conservation, compliance and infrastructure works
identified in the Donald Cant Watts Corke report referred to in condition 2 above to the
satisfaction of the Executive Director, Heritage Victoria.

The Bank Guarantee provided under condition 2 above shall be forfeited to the Heritage
Council of Victoria in the event that all of the relevant works as identified in the Donald
Cant Watts Corke report referred to in condition 2 above are not completed prior to the expiry
date of this permit.
5.
Prior to the commencement of any of the works to the registered place approved by this
permit a suitably experienced conservation architect shall be nominated to and approved in
writing by the Executive Director, Heritage Victoria. Following approval, the conservation
architect is to liaise with and advise at the Principal’s direction, the nominated consultants and
contractors engaged to carry out all of the conservation, compliance and infrastructure works

referred to in condition 2 above in order to achieve best conservation practice in their
implementation and completion.
At the completion of the conservation, compliance and infrastructure works referred to in
condition 2 above the nominated conservation architect referred to in condition 5 above shall
provide the Executive Director, Heritage Victoria with a short written assessment of the extent
to which the execution of these works complied with best conservation practice.
Prior to the commencement of any of the works to the registered place approved by this
permit an archival quality photographic survey is to be undertaken in accordance with the
provisions of the Heritage Council/Heritage Victoria Technical Note titled “Photographic
Recording for Heritage Places” available on the Heritage Council website at:
http://www.dpcd.vic.gov.au/heritage, copy attached. Two copies of the completed
photographic survey are to be produced with one copy to be submitted to the Executive
Director, Heritage Victoria for approval in writing. Following approval, the second copy is to be
lodged with the La Trobe Picture Collection, State Library of Victoria and the lodgement
receipt provided to the Executive Director, Heritage Victoria. The photographic survey is
required to include only exterior views of the outbuildings but both interior and exterior views
of the school room and auditorium/Schul.
The inscribed basalt foundation stone to the Succah and the memorial tablets and plaques
attached to the other outbuildings are to be carefully removed prior to demolition of these
structures. These salvaged items are to be relocated as considered appropriate by the
Synagogue authorities, preferably within the premises.
This permit shall expire if the permitted works have not commenced within two (2) years of
the date of issue of this permit, or are not completed within five (5) years of the date of issue
of this permit unless otherwise agreed in writing by the Executive Director, Heritage Victoria.
The Executive Director is to be given five working days notice of the intention to commence
the approved works.
Approved works or activities are to be planned and carried out in a manner which prevents
damage to the registered place. However, if other previously hidden original or inaccessible
details of the place are uncovered, any works that may affect such items shall immediately
cease. The Executive Director shall be notified of the details immediately to enable Heritage
Victoria representatives to inspect and record the items, and for discussion to take place on
the possible retention of the items, or the issue of a modified approval.
All works must cease and this office be contacted if historical archaeological artefacts or
deposits are discovered during any excavation or subsurface works. Should any munitions or
other potentially explosive artefacts be discovered, Victoria Police is to be immediately alerted
whilst the site is cleared of all personnel.
The Executive Director is to be informed when the approved works have been completed.
The development approved by this permit is to be carried out in accordance with the
endorsed drawings, unless otherwise agreed in writing by the Executive Director, Heritage
Victoria.
NOTE THAT PERMISSION HAS BEEN GIVEN FOR INSPECTIONS OF THE PLACE OR OBJECT
TO BE UNDERTAKEN DURING THE CARRYING OUT OF WORKS, AND WITHIN SIX (6)
MONTHS OF NOTIFICATION OF THEIR COMPLETION.
TAKE NOTICE THAT ANY NATURAL PERSON WHO CARRIES OUT WORKS OR ACTIVITIES
NOT IN ACCORDANCE WITH THE PERMIT OR CONDITIONS IS GUILTY OF AN OFFENCE
AND LIABLE TO A PENALTY OF UP TO 2,400 PENALTY UNITS ($346,464) OR 5 YEARS
IMPRISONMENT OR BOTH, OR IN THE CASE OF A BODY CORPORATE 4800 PENALTY
UNITS ($692,928).
THE ATTENTION OF THE OWNER AND/OR APPLICANT IS DRAWN TO THE NEED TO
OBTAIN ALL OTHER RELEVANT PERMITS PRIOR TO THE COMMENCEMENT OF WORKS.

WHAT HAS BEEN DECIDED?
The Executive Director has issued a permit under section 74 of the Heritage Act 1995.
WHEN DOES THE PERMIT BEGIN?
The permit operates from a day specified in the permit.
WHEN DOES A PERMIT EXPIRE?
A permit expires if *
the development or any stage of it does not start within the time specified in the
permit; or
*
the development or any stage is not completed within the time specified in the
permit, or, if no time is specified, within two years after the issue of the permit.
The expiry of a permit does not affect the validity of anything done under that permit before the
expiry.
WHAT ABOUT APPEALS?
The applicant or the owner of a registered place or registered object may appeal to the Heritage
Council against any condition of a permit imposed by the Executive Director on a permit issued under
Section 74 of the Heritage Act.
