Deticio AN ORDINANCE ADOPTING REPUBLIC ACT NO. 9288 OR THE NEWBORN SCREENING ACT OF 2004 ESTABLISHES A NATIONAL COMPREHENSIVE NEWBORN SCREENING SYSTEM TO ENSURE AN INTEGRATIVE AND SUSTAINABLE IMPLEMENTATION OF THE GOVERNMENT’S POLICY TO PROTECT AND PROMOTE THE RIGHT TO HEALTH OF THE PEOPLE, INCLUDING RIGHTS OF THE CHILDREN TO SURVIVAL AND FULL AND HEALTHY DEVELOPMENT AS NORMAL INDIVIDUALS APPROXIMATELY 33,000 OF THE 2 MILLION BABIES BORN ANNUALLY IN THE COUNTRY ARE AFFECTED BY THE LIFE THREATENING CONGENITAL METABOLIC DISORDERS. Be it ordained by the Sangguniang Panlungsod of Malaybalay City in session assembled: Section 1. Declaration of Policy: The state shall institutionalize a Newborn Screening system that is………….. COMPREHENSIVE, INTEGRATIVE, SUSTAINABLE, COLLABORATIVE To ensure that every baby born in Malaybalay City is offered the opportunity to undergo Newborn Screening (NBS) and be spared from metabolic conditions that can lead to mental retardation and death. Section 2. “Ordinance Title – The ordinance shall be known as the adopting Newborn Screening Act of 2004”. Section 3. Role of Health facilities in the implementation of RA 9288 Health Facilities as major stakeholders shall ensure the implementation of NBS and will have the following responsibilities: 1. 2. 3. 4. Integrate NBS in its delivery of health services. Serve as collecting health units for blood samples for NBS. Coordinate with duly accredited NSC. Ensure that adequate and sustained NBS service such as information, education, communication, screening, recall and management of identified cases are being provided in the health facility. 5. Establish a NBS team that will be responsible for collection of samples to accredited NSC, prompt recall of positive patients, referral, management and follow up of patients. 6. The government and health facility are highly encouraged to develop a scheme providing partial and full subsidy depending on the financial capability of parents. 7. All birthing facility, RHU’s, health center and other collecting facilities throughout the City shall have NBS specimen collection kit at all times. 8. Define creative financial packages to make NBS accessible particularly among the economically deprived populace. 9. Establish an appropriate financial system that will ensure effective and efficient collection of fees and payment of NBS services to the NSC. 10. Monitor and evaluate the implementation of NBS within the institution. Section 4. Scope- The Newborn Screening shall include five (5) disorders namely: Congenital Hypothyroidism, Congenital Adrenal hyperplasia, Phenylketonuria, Glucose 6 phosphate dehydrogenase and Galactosemia. Section 5. To subsidize 25% of the Screening (NBS) filter card actual cost of Newborn Section 6. Rules and Regulations A. For the Bonafide Residents of Malaybalay only 1. All parents who are bonafide residents of Malaybalay are qualified to avail the 25% discount of the cost of NBS filter card and screening process. 2. In order to avail the 25% discount, the parents shall bring birth certificate, Community Tax Certificate (CTC), and barangay certification as proof that they are resident of Malaybalay City. B. For non-residents of Malaybalay shall pay the actual cost for the filter card & screening process. Section 7. Definition of Terms – As used in this ordinance, the following terms are defined as follows: 1. Newborn Screening (NBS) – is a simple and effective procedure done to detect metabolic disorders through heel prick, a few drops of blood are taken for the baby’s heel and blotted on a special absorbent paper. 2. Congenital hypothyroidism (CH) – results from lack or absence of thyroid hormone which are essential to growth of the brain and body. 3. Congenital Adrenal Hyperplasia (CAH) – causes severe salt loss, dehydration, and abnormally high levels of male sex hormones in both boys and girls. 4. Galactosemia (GAL) – is a condition in which babies are unable to process a certain part of milk sugar called galactose. 5. Phenylketonuria (PKU) – is a rare condition in which babies cannot properly use one of the building blocks of protein, called phynelalanine. 6. Glucoe 6 phosphate dehydrogenase (G6PD) deficiency – leads to anemia, yellow discoloration of the skin and other health problems if the patient is exposed to certain drugs, food or chemicals. 7. NSC – Newborn Screening Center – A testing facility equipped with a newborn screening laboratory and provides all required laboratory tests and recall/follow-up programs for newborns with heritable conditions. 8. NSF – Newborn Screening Health Facility/Blood collecting Facility for NBS. Section 8. Newborn screening shall be done through a heel prick to be performed by the trained health workers. The procedure shall be done preferably by 24th to 48th hours of life. Section 9. Handling and Sending of Samples as defined by the NBS Administrative Manual. 1. Using a drying rack, dry the sample in horizontal manner. If drying 2 or more samples, place the filter cards in alternate manner. 2. Make sure that samples are dried for at least 4 hours or until completely dried. 3. Check filter card against Samples Spotcheck poster. 4. Wrap the samples in a clean sheet of bond paper or place the samples inside the envelope. 5. Fill in the transmittal form with the mother’s name. 6. Send it together with your samples to your NSC. Do not staple the transmittal form on the filter card. 7. In sending samples, call or arrange with your official courier for the schedule to pick up. Get the booking or pick up reference fro tracking purposes. 8. Write on the airway bill your NSC’s courier account number and tick the box for consignee. Section 10. Newborn screening coordinator shall be designated at all levels to oversee the implementation of NBS program. The NBS coordinator shall assist in the recall of patients with positive results. Section 11. Placing order – by Using health facility’s Purchase order (P.O.) form in ordering NBS Specimen Collection kit. The minimum allowable order per p.o. is (5) Five NBS Specimen collection kits. P.O. should be signed and approved by the authorized personnel. Section 12. Order Delivery – After placing the order processing time order will be seven (7) working days from the receipt of P.O., provided that the Health facility does not have any outstanding account balance with NSC. NSC will send ordered supplies to the requesting health facility through a courier indicated in institutional database. A sales invoice will accompany with ordered supplies. Section 13. Payment of Orders – Terms of Payment is the period given By the NSC for the NSF to pay the ordered NBS Specimen Collection Kits. Terms of Payment = 45 days from the receipt of costumer’s sales invoice. Any unpaid account after given terms shall be charged 2% interest per month until fully paid. The next Purchase Order will only be processed upon receipt of payments. Payment made through any of the following ways: a. Cash/ Cash on delivery for walk-in clients b. Appropriations Section 15. Formulation of implementing Rules and Regulation – within one month after the approval of this ordinance, the council shall formulate and issue the appropriate rules and regulations necessary for the efficient and effective implementation of any and all provision of this ordinance. Section 16. Separability clause – The provisions of this ordinance are hereby declared to be separable, and In the event one or more of such provisions are held unconstitutional, the validity of other provisions shall not effected hereby. Section 17. Repealing Clause – Any existing ordinance of its provisions, which are inconsistent with this ordinance shall not deemed repeated, amended or modifies accordingly. Section 18.
