RESOLUTION TOWNSHIP OF FRANKLIN RESOLUTION AUTHORIZING THE DONATION OF PROPERTY OWNED BY THE TOWNSHIP OF FRANKLIN KNOWN AS BLOCK 502, LOT 31, TO HABITAT FOR HUMANITY, SUBJECT TO CONDITIONS R-182-10 WHEREAS, the Township Committee of the Township of Franklin, County of Gloucester, State of New Jersey, is the owner of Block 502, Lot 31, which is an undersized lot and is not capable of being developed with a single family home under current zoning ordinances; and WHEREAS, Habitat for Humanity already owns, or is in the process of obtaining, an adjacent undersized lot which when merged with Block 502, Lot 31 will create a conforming building lot; and WHEREAS, the Township is aware that it has certain constitutionally required obligations to provide a realistic opportunity for affordable housing to be constructed in the Township of Franklin; and WHEREAS, the governing body feels it would be in the best interest of the residents of Franklin Township to permit the donation of Block 502, Lot 31 to Habitat for Humanity provided that the house to be constructed on the property, together with other adjacent lands, be compliant with the rules and regulations created by the New Jersey Council on Affordable Housing. NOW, THEREFORE, BE IT RESOLVED, by the Township Committee of the Township of Franklin, County of Gloucester, State of New Jersey, that the Township Committee has authorized the Mayor as its designee to execute a Deed conveying Block 502, Lot 31 to Habitat for Humanity provided that the property be compliant with the rules and regulations propounded by the Council on Affordable Housing for low and/or moderate income occupancy and that said property be deed restricted to those ends.
