Waste Management (End-of-Life Vehicles) Regulations 2006.

These Regulations came into effect on 8 June 2006 and, in conjunction with the
Protection of the Environment Act 2003, give legislative effect to Directive
2000/53/EC of the European Parliament and of the Council of 18 September 2000
on end-of life vehicles (ELVs).
Obligations on Producers
The Waste Management (End-of-Life Vehicles) Regulations 2006 place a
number of obligations on producers - vehicle manufacturers and professional
importers – including requirements to establish national collection systems for the
collection and storage and treatment of end-of-life vehicles.
Typically, an end-of-life vehicle will be a passenger car or a light commercial van
that the registered owner wishes to dispose of as waste. From 1 January 2007
owners of intact end-of-life cars and vans can deposit them free-of-charge at
Authorised Treatment Facilities (ATFs).
Producers were required to apply for registration with each city and county council
by 21 September.
Local authorities have a period of six weeks to assess the applications and
accompanying Implementation Plans.
Standards in Authorised Treatment Facilities (ATFs)
The Regulations also introduce new environmental standards to ensure that when
an End of Life Vehicle (ELV) is deposited at an ATF, materials are recovered and
recycled in a way that does not harm the environment.
Prescribed targets for reuse / recovery and reuse / recycling are required in
accordance with the provisions of Directive 2000/53/EC. In addition new
minimum standards are prescribed in relation to the storage and treatment of ELVs
at Authorised Treatment Facilities.
Local Authority Role
Under the Regulations, Local Authorities are responsible for the enforcement of
all relevant provisions relating to the permitting of Authorised Treatment
Facilities, and where appropriate, producer responsibility provisions concerning
the administration of the system of producer registration. Local authorities will set
down permit conditions governing the operation of ATFS from 1 January 2007 to
require that ATFs providing free take-back for ELVs do so in accordance with the
standards prescribed in the Regulations.
