CONDITIONS OF ENTRY

1. REFUNDS – No refunds will be given for bulls or females withdrawn from sale after 1 June 2015.

Entries withdrawn prior to this date will receive a partial refund only at the discretion of the Committee;

2. BULLS entered in the Show & Sale are required to be Zoetis Star Accredited

3. FEMALES entered in the Show & Sale are required to be tested PI Negative, vaccinated with 7 in 1

4. RESTRICTIONS – There will be no restriction as to the number of bull entries accepted but the

Committee reserves the right to review maximum numbers and reject entries immediately after the closing date for entries.

5. INSURANCE – A copy of each exhibitor’s Certificate of Currency for Public Liability Insurance must accompany the entry form.

6. INSPECTION – All cattle entered must pass an onsite inspection by the inspectors appointed by the

Committee. The Committee inspectors may in their absolute discretion and at any time accept or reject any exhibits submitted by an exhibitor for exhibition and/or sale. Any entry rejected must be removed from the exhibition area prior to the show to such area as is designated by the committee from time to time. The Committee will not be required to assign any reason for such rejection and no appeal can be made. Any rejected animal will not be sold or arranged to be sold, swapped or given away through the duration of the sale.

7. SALE – All cattle presented to and passed by the Committee inspectors must be offered for sale.

8. MANAGEMENT OF SALE – The Committee has the right to determine the manner and management of the sale. All entrants shall at all times comply with the requirements and directions of the representatives of the Committee in relation to any matter related to the conduct of the sale.

9. SEMEN RIGHTS AND/OR SHARES – Any semen or embryos collected must be stated at the time of entry and printed in the catalogue.

10. POSSESSION – Any animal offered for sale must be offered with full possession on sale.

11. STATISTICS – All available statistics are to be placed in the exhibit cards by the exhibitor under the jurisdiction of the Committee and Shorthorn exhibit cards must remain displayed at all times.

12. REGISTRATION – Entries will only be accepted for animals registered as pure breeds with their respective Shorthorn Societies in Australia being Shorthorn Beef, Beef Shorthorn Society of Australia and Dairy Shorthorn Association of Australia.

13. AGE – No bulls under 14 months of age will be accepted for show or sale (that is born after 31 March

2013).

14. TEETH – A bull will be ineligible for exhibition in its class if at the time of inspection in the opinion of the Committee or its nominee the animal must be of sound mouth and:- i. In the case of an entry in a class under 18 months has or shows evidence of having had a permanent tooth; and ii. In the case of an entry in the class 18 months and over and not over 22 months shows evidence of more than 2 permanent teeth.

15. MEDICATION

The Committee is to be advised of any medication that is being administered or applied to any animal entered. The Committee reserves the right to conduct tests for drugs and medications at any time and for any reason.

16. HEALTH CERTIFICATES – Current health certificates must be dated not earlier than 30 days before the date of sale and provided to the Committee.

17. LEVY – A levy charge of 2% on gross proceeds of sale at auction or private treaty will be charged by the Committee and will appear on all account sales as an additional charge against the Vendor.

18. ACKNOWLEDGEMENT, RELEASE & INDEMNITY – Each exhibitor, in consideration of the

Committee accepting one or more of the exhibitor’s applications for entry:- i. Acknowledges that the Committee, its employees, agents, members and office bearers shall have no responsibility or liability to the exhibitor in respect of any act, matter or thing done or omitted by the Committee, its employers, agents, members or office bearers, whether deliberately, inadvertently or negligently; ii. www.nationalshorthornsale.com.au

Acknowledges that the exhibitor’s participation in any event, competition, entertainment or activity is wholly and exclusively at th e exhibitor’s own risk in respect of injury or death, loss of or damage to property or economic loss; iii. Releases and indemnifies the Committee, its employees, agents, members and office bearers from and against all claims for or in respect of injury or death, loss of or damage to property or economic loss sustained by the exhibitor or any person claiming by or through the exhibitor as a result or any act, matter or thing done or omitted by the Committee, its employees, agents, members and office bearer, whether deliberately, inadvertently or negligently and whether or not such injury or death, loss of or damage to property or economic loss occurred during or as a consequence of or arose from the participation by the exhibitor or any other person in any event, competition, entertainment or activity; iv. Indemnifies the Committee, its employees, agents, members and office bearers from and against all claims for or in respect of injury or death, loss of or damage to property or economic loss sustained by any person as a result of any act, matter or thing done or omitted by the exhibitor, his employees and agents, or by any person patronizing, using or occupying any equipment, facility or exhibitions made available by the exhibitor, his employees or agents; v. Agrees that in this condition the word “claims” includes actions, suits, causes or action, arbitrations, debts, dues, costs, claims, demands, verdict and judgments either at law or inequity or arising under statute.

19. CONDITION OF CATTLE

– The Committee does not warrant the condition, quality or performance of any cattle offered for sale and the Committee shall not be responsible for any injury to or death of cattle whilst at the sale and the Vendor indemnifies the Committee in respect of any claim that may be made against performance or state of health of an exhibitor’s cattle.

20.

VENDORS’ GUARANTEE ON FEMALES –

1) It is a condition of all sales that Vendors warrant that all females catalogued and sold as unjoined are fertile to natural service within 12 months of sale;

2) The Vendors shall refund to the Purchaser the purchase price paid (excluding any costs or expense of the purchaser) upon the Purchaser providing to the Vendor within 12 months of the sale date:- a) A report from a licensed veterinarian certifying that in his or her opinion:- i. There is no evidence that the female suffered any injury or illness subsequent to being sold to the Purchaser which could have affected her breeding ability; and ii. There is no evidence that the female has been subjected to embryo transfer procedures. b) A Statutory Declaration from the Purchaser warranting that in the opinion of the Purchaser the facts stated in the veterinarian’s report are true and correct.

3) If a female catalogued for sale has been flushed, the Vendor must disclose this in the Comments section of the catalogue.

21. VENDORS GUARANTEE ON BULLS

1) It is a condition of sale that Vendors warrant that all bulls are to be sold as fertile and capable of natural service within 6 months of the date of the sale;

2) The Vendors shall refund to the Purchaser the purchase price paid (excluding any costs or expense of the purchaser) upon the Purchaser providing to the Vendor within 6 months of the sale date:- a) A report from a licensed veterinarian certifying that in his or her opinion:- i. The bull is infertile or incapable of natural service; ii. There is no evidence that the bull has suffered any injury or illness subsequent to being sold to the Purchaser which could affect his breeding ability b) A Statutory Declaration from the Purchaser warranting that in the opinion of the Purchaser the facts stated in the veterinarian’s report are true and correct.
