DELAND POLICE DEPARTMENT Chief William E. Ridgway Departmental Rules & Regulations TITLE: FORMAL ORGANIZATION CODIFIED: CFA STD: 1.1 1.02M,1.03M DATE OF ISSUE: 12.01.10 EFFECTIVE DATE: 12.01.10 RESCINDS/ AMENDS: 08.03.09 PAGES: 6 ATTACMENTS: 1 PURPOSE The purpose of this directive is to establish procedures for the formal organization of the department. FORMAL ORGANIZATION 1.1.1 The Police Department shall be composed of sworn, non-sworn members, and civilian volunteers. 1.1.2 Non-sworn service employees shall include permanent and temporary employees. 1.1.3 The strength of the department shall not ordinarily exceed the number of employees authorized by the City Commission. 1.1.4 The Department shall be organized into such divisions, section, and units as may be directed by the Chief of Police. 1.1-1 1.1.5 A written copy of the organizational structure is provided to all employees, and is updated and revised as organizational changes occur. (See the DeLand Police Department Organizational Chart.) CHIEF OF POLICE 1.1.6 Defined: Shall mean any person so appointed by the City Manager with approval of City Commission to assume the authority of the Chief of Police granted under DeLand City Charter Article 5, Sections 41 and 42. 1.1.7 Duties: The Chief of Police shall: Assume command of, exercise leadership over and direct, the operation of the DeLand Police Department. The chief will train his immediate subordinates to be able to assume the duties and responsibilities of his office on a temporary basis. ACTING CHIEF OF POLICE 1.1.8 In the absence of the Chief of Police, a Deputy Chief shall be considered the Acting Chief of Police when so designated by the Chief of Police. 1.1.9 If circumstances prevent the Chief of Police from designating an acting Chief of Police, the City Manager will designate the acting Chief of Police. CHIEF’S COMMAND STAFF 1.1.10 Defined: Shall mean the administrative staff comprised of the Deputy Chiefs, Civilian Managers, and any member so designated by the Chief of Police. 1.1.11 Duties: The Chief's Command staff shall: Counsel and aid the Chief; Assist the Chief by performing those duties as he may assign. COMMANDING OFFICERS 1.1.12 Defined: Shall mean any member with the rank of Lieutenant or above, or any employee so designated by the Chief of Police. SUPERVISORS 1.1.13 Defined: Shall mean members or employees who have as one of their major responsibilities the general authority in the interest of the DeLand Police Department; to direct other employees or members; 1.1-2 The review and resolution of personnel problems or the effective recommendation of appropriate remedial action; and the evaluation of the work performance of employees or members. 1.1.14 Supervisors shall assign, reward, supervise, and train subordinates. 1.1.15 Supervisors shall recommend dismissals, transfers, suspensions, demotions, recalls and discipline. DUTIES OF SUPERVISORY MEMBERS 1.1.16 Assume command of, exercise leadership over, and direct the operation of any assigned bureau or office within the department. 1.1.17 Train immediate subordinates to be able to assume the duties and responsibilities of his/her office. 1.1.18 Perform such duties as required by City/ Department Directives and other duties as directed by the Chief of Police. DUTIES OF SQUAD LEADERS 1.1.19 Defined: Shall mean any sworn member of the Department who holds the rank of Police Officer and has been selected and approval by the Chief of Police to act in a temporary position of authority over a specified squad and its Civilian Employees. 1.1.20 Squad Leaders shall be utilized when exigent circumstances or normal scheduling vacancies prevent the squad’s Supervisors from being readily available for duty and/or are temporarily detained from their assigned duties. 1.1.21 Squad Leaders assume command of, exercise leadership over, and direct the operation of their assigned squad when called upon to do so. 1.1.22 A Squad Leader’s temporary authority is relinquished at the end of the assignment or . when properly relieved by a higher ranking Supervisor. DUTIES OF NON-SUPERVISORY MEMBERS 1.1.23 Be assigned to any bureau, division, section, or unit within the department; 1.1.24 Perform such duties as required by department rules and regulations and any other duties assigned by superiors. 1.1-3 PART-TIME SWORN/RESERVE 1.1.25 Defined: Shall mean any certified police officer working less than 30hrs per week. 1.1.26 Duties: A Part-time sworn/reserve Officer shall be subject to the same rules of conduct as members and employees. 1.1.27 Perform other related duties as directed by the Chief of Police. COMMAND PROTOCOL 1.1.28 Command Authority: Is the amount of authority possessed commensurate with rank held and/ or duties assigned. 1.1.29 The Chief of Police is the ranking member of the Police Department with command authority over all members and employees of the department. 1.1.30 A Deputy Chief has command authority over all employees in their division. This command authority extends over Civilians, Lieutenants, Sergeants and Police Officers of lesser rank. 1.1.31 A Civilian Manager has command authority over civilian employees in their division and also has same over sworn officers who are temporarily assigned to their division. 1.1.32 A Lieutenant has command authority over all employees in their division, section or unit. This command authority extends over sergeants, Civilians and Police Officers of lesser rank. 1.1.33 A Sergeant has command authority over all employees in their division, section or unit. This command authority extends over Civilians and Police Officers of lesser rank. 1.1.34 A Squad Leader has temporary command authority over Civilians and Police Officers within their assigned squad when the authority has been given to them via the Chain of Command from the Chief of Police. The temporary authority is relinquished at the end of the assignment or when properly relieved by a Supervisor. 1.1.35 Line authority: is having authority over members and employees directly below and responsible to any of the various ranks. 1.1.36 Staff authority: is that authority possessed by employees who are directly responsible for various departmental operations, but who may not directly supervise employees of particular units on a day to day basis. 1.1-4 1.1.37 Those members designated as ”Acting” Lieutenants possess command authority, during their tour of duty, over any member below the rank of Lieutenant any time the “Acting” Lieutenant is actively pursuing their assigned duties. 1.1.38 An employee will be accountable to only one supervisor at any given time. 1.1.39 Each employee will be able to identify one supervisor to whom they are directly accountable. 1.1.40 Supervisors who issue orders or direction to employees outside their normal supervision shall inform the supervisor of the affected employee as soon as practical. 1.1.41 A supervisor having responsibility over any operation or emergency situation will be in charge of all employees of different functions who are engaged in the operation, special function or situation until relieved by a higher authority. 1.1.42 Specific command protocol may be further delineated by directive, if required. ANTI-NEPOTISM 1.1.43 Florida Statutes 112.3135, as well as Article 3, Section 12, A & B of the City of Deland’s Rules shall govern the employment and placement of relatives within the police department. 1.1.44 Relatives of employees may be employed within these limitations: 1.1.45 During the hiring procedure, no relative may take an active role in the employment process of related personnel. 1.1.46 No relative may advocate or suggest the promotion or disciplinary actions of a relative within the department. 1.1.47 The relative shall not be: Related to his immediate supervisor. The immediate supervisor of the employee's immediate supervisor (reviewer of the related employee's evaluation). A member of the promotional oral review board where a relative is a candidate. The Chief of Police. 1.1.48 Assignment of related employees shall not be such that direct or indirect supervisor/subordinate relationships occur, or a relationship that would result in this person handling the sensitive or confidential information regarding a relative. 1.1-5 1.1.49 When such relationships occur, they are considered prima facie of a conflict of interest. OATH OF OFFICE 1.1.50 Each member of the agency, prior to assuming a sworn status shall be administered an oath of office to the Constitution of the United States, The State of Florida and the City of DeLand. 1.1.51 The Oath of Office shall be administered both in writing and orally, by the City Clerk or designee as a step in the employment process. 1.1.52 The notarized oath shall be signed by the officer and placed in the personnel file.
