More detailed provisions relating to many of the terms and conditions set out in this contract are to be found in the Conditions of Service Handbook and the accompanying Joint Commentary. 1. Duties 1.1. You will carry out your duties under the reasonable direction of the College Principal. The Principal may from time to time delegate this responsibility and other responsibilities mentioned in this contract to other members of the College management. 1.2 You may be called upon to perform any of the duties set out in Appendix 4 of the Conditions of Service Handbook which may reasonably be assigned to you. The particular tasks required of you will be specified in a job description. This job description may be changed provided always that the tasks specified are consistent with the list of duties laid down in Appendix 4 of the Conditions of Service Handbook and that changes will only be made after consultation with you. 2. Working Time 2.1 Subject to the provisions in the other paragraphs of this section, you may be required to work for 195 days in any year of which 190 will be days on which you may be required to teach in addition to carrying out other duties. Within this 195 days, up to 1265 hours a year will be allocated reasonably to you by the Principal. Details of this directed time will be provided by the Principal. 2.2 Within the 1265 hours you may be required to teach for up to 6 hours over two evenings per week. Any teaching in the evening beyond this level would be undertaken only on a voluntary basis. 2.3 In addition to the requirements in 2.1 above, you will work such additional hours as may be needed to enable you to discharge your duties effectively including, in particular, the marking of students’ work, the writing of reports on students and the preparation of lessons, teaching material and teaching programmes. 2.4 In this section, ‘year’ means a period of 12 months commencing on 1st September [unless the College’s academic year begins in August in which case the date quoted should be 1st August]. 2.5 Details of your holiday periods will be made available to you by the Principal. You will be paid full salary during these holiday periods unless you are receiving less than full salary arising from the application of the sick pay scheme, maternity scheme, etc. 3. Place of Work 3.1 Your principal place(s) of work is/are at the College’s site(s) at … but you may be required to move your principal place of work to the College’s site(s) at … or any new site(s) within […] miles of your original principal place(s) of work. 3.2 From time to time you may be required to attend for duty at places other than the College’s site(s). 4. Reference must also be made here to any other contractual remuneration which may apply). 4.11 3 May 2007 Where there are changes in your duties and responsibilities which have salary consequences, these will normally be effected on 1st September, but where appropriate can take effect at other times of the year. 4.12 Annual performance reviews will be conducted in accordance with the Performance Management Framework, which is contained in the Conditions of Service Handbook. 4.13 The pay levels will be reviewed from time to time by the Corporation, who will give due consideration to the recommendations of the National Committee for Teaching Staff in deciding on levels of pay. 5 Pension You will become a member of the Teachers’ Pension Scheme subject to its terms and conditions from time to time in force, unless you choose otherwise. A contracting out certificate is in force for the Teachers’ Pension Scheme. 6. Appraisal and Staff Development You will be required: a) to participate in College arrangements made in the light of the responsibility for the appraisal of staff that is laid on the College Principal in the College’s Articles of Government and to participate in reviews from time to time of your methods of teaching and programmes of work; b) to participate in reasonable arrangements for your further training and development. If you are unqualified at the time of appointment you will need to obtain a qualification appropriate to your teaching duties within two years of the start of your appointment [four years for part-time]. The College will provide further details of suitable qualifications and the necessary arrangements if appropriate. 7. Introductory Period (For All New Appointments) 7.1 Confirmation of your appointment will be subject to satisfactory completion of an introductory period of …… months. During this period you will be expected to establish your suitability for the appointment. 7.2 Newly qualified teachers [with PGCE (schools)] may be able to participate in a formal induction period, involving a Local Authority. The College will provide further details of this scheme if appropriate. 4 May 2007 8. Grievance and Disciplinary Procedures 8.1 If you have a grievance relating to your employment, you are entitled to express it. The procedure for this is set out in a document that the Corporation has adopted which is available from ………. An appeal against a written warning must be made to …. within …. days of receipt of the disciplinary letter. Period of Notice You are entitled to receive, or required to give, two months’ notice of termination of employment and in the Summer term three months’, terminating at the end of term as defined below for this purpose: the Summer term ends on 31st August the Autumn term ends on 31st December the Spring term ends on 30th April However, if you have been continuously employed for more than eight years you are entitled to receive longer notice as specified in the Employment Protection (Consolidation) Act 1978. 10. Period of Continuous Employment 10.1 Your period of continuous service for statutory employment rights dates from the date of commencement of your service with this College. This date is ……… 10.2 If you have previous continuous service with an organisation(s) covered by the Redundancy Payments (Local Government) (Modification) Orders this will be included in calculating your entitlement to a redundancy payment, maternity pay and leave and sickness allowance. Sickness Pay and Leave Your entitlement to sickness pay and leave, the notification procedure for reporting sick, the certification procedure for illness and injury and deductions made in respect of state benefits are described in the documents referred to in paragraph 15. 5 May 2007 12. Maternity Pay and Leave If you become pregnant, you may, dependent on your length of continuous service, be eligible to receive maternity pay and you may have a right to return to work after you have had your baby. Full details of your maternity conditions are contained in the documents referred to in paragraph 15. 13. Paternity Pay and Leave Fathers will be entitled to 2 weeks’ paid paternity leave within 8 weeks of the child’s birth. The contractual entitlement under the NJC Paternity Leave Scheme will be for one week at full pay and one week at the statutory level of pay. 14. Adoption Leave There is a statutory right to adoption leave for which statutory adoption pay is payable. This is the same as Statutory Maternity Leave, with 26 weeks Ordinary Adoption Leave and 26 weeks Additional Adoption Leave. It can be taken by either the adoptive mother or father and one partner can take adoption leave and one can take ‘Paternity’ Leave. The statutory pay arrangements are the same as Statutory Maternity Pay. 15. Other Terms and Conditions 15.1 Other terms and conditions of service together with those explicitly laid down or referred to in this contract are embodied in documents available for you to refer to in the College. These documents include those recommendations from the national Committee for Teaching Staff that have been adopted by the Corporation. These terms and conditions are supplemented by local collective agreements reached with trade unions recognised by the College and by the rules of the College. 15.2 National recommendations on terms and conditions of your employment that have been adopted by the Corporation currently cover: Working Time Appointment Travel and subsistence Conduct Sickness pay and leave Maternity leave and pay Paternity leave and pay Age of retirement Insurance for assault 15.3 6 May 2007 Local collective agreements affecting other terms and conditions of your employment currently cover: (Possible examples would be: Provision for time off (other than holidays and sickness) Time off for trade union representatives Premature retirement/redundancy Health and Safety) 15.4 From time to time variations in your terms and conditions of employment will result from decisions by the Corporation to adopt nationally negotiated recommendations and these will be separately notified to you. 16. Conduct During your employment you are expected to act in the best interests of the college at all times. You are obliged at all times to act in accordance with the provisions of the College Staff Rules of Conduct. A copy of this document is available from ………. 17. Data Protection By signing this contract I consent to the College creating and maintaining computer and paper based records on me, in compliance with the Data Protection Act 1998, both during and after my employment. I consent that any such data may be processed if it is necessary for the performance of my employment contract with the College and/or is necessary for the purposes of exercising or performing any right or obligation which is conferred or imposed by law on the College in connection with my employment. 7 May 2007
