COMPLAINT
The Florida Bar, Complainant, files this complaint against Charles
Alexander Greene, Jr., Respondent, pursuant to the Rules Regulating The Florida
Bar and alleges:
1.
Respondent is, and at all times mentioned in the complaint was, a
member of The Florida Bar, admitted on November 15, 2002, and is subject to the
jurisdiction of the Supreme Court of Florida.
2.
Respondent resided in Hillsborough County and practiced law in
Hillsborough and Pinellas counties at all times material and relevant hereto.
3.
On January 19, 2012, Respondent was appointed to represent a client
in a criminal appeal to the Sixth Judicial Circuit Court in Pinellas County, Florida.
4.
On April 27, 2012, the court issued a Notice of Intent to Dismiss
which ordered Respondent to file the initial brief within ten (10) days.
5.
On May 4, 2012, Respondent filed a motion for an extension of thirty
(30) days to file the initial brief.
6.
On May 8, 2012, the court issued an order directing Respondent to file
the initial brief by May 28, 2012.
7.
Respondent failed to file the initial brief as ordered by the court.
8.
On June 1, 2012, Respondent filed a motion for extension of twenty
(20) days to file the initial brief.
9.
On June 5, 2012, the court issued an order directing Respondent to file
the initial brief in twenty (20) days.
10.
Respondent failed to file the initial brief as ordered by the court.
11.
On July 3, 2012, the court issued another Notice of Intent to Dismiss
which ordered Respondent to file the initial brief within ten (10) days.
12.
On July 13, 2012, Respondent filed a motion for an extension of thirty
(30) days to file the initial brief.
13.
On July 18, 2012, the court issued an order directing Respondent to
file the initial brief in thirty (30) days.
14.
Respondent failed to file the initial brief as ordered by the court.
15.
On August 20, 2012, Respondent filed a motion for extension of thirty
(30) days to file the initial brief.

16.
On August 21, 2012, the court ordered Respondent to file the initial
brief within twenty (20) days, or to appear before the court on September 10, 2012
to show cause why he had failed to do so.
17.
Respondent failed to file the initial brief pursuant to the August 21,
2012 order.
18.
Respondent failed to appear before the court pursuant to the August
21, 1012 order.
19.
By order dated September 12, 2012, the court removed Respondent as
counsel for the appellant.
20.
By repeatedly failing to file the appellant’s initial brief, Respondent
violated Rule 4-1.3(Diligence) and 4-3.2 (Expediting Litigation).
21.
By failing to appear before the court, Respondent violated Rule 4-
8.4(d) (A lawyer shall not engage in conduct in connection with the practice of law
that is prejudicial to the administration of justice).
22.
On February 5, 2013, the Thirteenth Judicial Circuit Grievance
Committee “A” found probable cause to file this complaint pursuant to Rule 3-7.4,
of the Rules Regulating The Florida Bar, and this complaint has been approved by
the presiding member of that committee.
23.
By reason of the foregoing, respondent has violated the following
Rules Regulating The Florida Bar: Rule 4-1.3 (Diligence); Rule 4-3.2 (Expediting

Litigation); and Rule 4-8.4(d) (A lawyer shall not engage in conduct in connection
with the practice of law that is prejudicial to the administration of justice).
WHEREFORE, The Florida Bar prays respondent will be appropriately
disciplined in accordance with the provisions of the Rules Regulating The Florida
Bar as amended.
