DEVELOPMENT ACT 1993, THE PORT WATERFRONT

REDEVELOPMENT PLAN AMENDMENT REPORT

PREPARED BY THE MINISTER—DRAFT FOR PUBLIC

CONSULTATION

NOTICE is hereby given that the Minister for Urban Development and Planning has, pursuant to Sections 24 and 26 of the

Development Act 1993, prepared a draft Plan Amendment Report

(PAR) to amend the Port Adelaide Enfield Development Plan.

The draft PAR proposes to amend the Development Plan by providing an appropriate and updated policy framework to better promote the revitalisation of the Port Waterfront and the Port

Adelaide Centre.

The draft PAR will be on public consultation from 15 May

2003 to 15 July 2003, inclusive.

The draft PAR can be viewed on the Internet at www.planning.sa.gov.au/portwaterfront or is available during normal office hours at:

Level 5, 136 North Terrace, Adelaide.

Alternatively, the draft PAR is available for viewing at the Port

Adelaide Enfield Council during normal business hours.

2002, Gazetted 22 August 2002, page 3127 and pursuant to section 20 (1) of the Petroleum (Submerged Lands) Act 1967, of the

Commonwealth of Australia, hereby invite applications for the grant of an exploration permit in respect of each of the following areas as scheduled below:

S CHEDULE

(The references hereunder are to the names of the map sheets of the 1:1 000 000 series and to the numbers of graticular sections shown thereon).

The Commonwealth/State/Territory jurisdictional boundary in coastal waters is determined by the Australian Maritime Boundaries

Information System Dataset of 2000, released in January 2001 by the Australian Surveying and Land Information Group (now

Geoscience Australia National Mapping Division).

Section 5AAA of the Petroleum (Submerged Lands) Act 1967 provides that, where a change to the baseline of Australia’s territorial sea would impact on the boundary of an existing petroleum title (in Commonwealth or State or Territory waters), there is in fact no such impact. The Commonwealth, State or Territory Act (as the case may be) under which the title has been granted, continues to apply to the title and the whole title area for as long as the title remains in force. Therefore, this Instrument does not apply to any such area that is already under title.

Applications

Applications lodged under section 20 of the Petroleum (Submerged Lands) Act 1967 are required to be made in the approved form and should be accompanied by:

(a) Details of:

(i) the applicant’s technical assessment of the petroleum potential of the area, including the concepts underlying its proposed exploration program, with sufficient detail to support that program;

(ii) the applicant’s minimum guaranteed proposal (including indicative minimum expenditure) for exploration wells to be drilled, 3D and 2D seismic and other surveying activities, data evaluation and other work, for each year of the first three years of the permit term. This proposal, to be known as the minimum guaranteed work program should comprise work expected to involve a substantial exploration component—normally, appraisal work should not be included;

(iii) the applicant’s proposal (including indicative minimum expenditure) for exploration wells to be drilled, 3D and 2D seismic and other surveying activities, data evaluation and other work, for each of the three remaining years of the permit term. This proposal, to be known as the secondary work program, should comprise work expected to involve a substantial exploration component—normally, appraisal work should not be included.

(b) Particulars of:

(i) the technical qualifications of the applicant and of its key employees;

(ii) the technical advice available to the applicant;

(iii) the financial resources available to the applicant, including evidence of the applicant’s ability to fund the work program proposed, a statement of other exploration commitments over the next six years, and a copy of the latest annual report and quarterly reports for each applicant company;

(iv) where relevant, the viability of the consortium lodging the application, including evidence that a satisfactory settlement has been, or can be, reached on the Joint Operating Agreement (a copy of a signed Heads of Agreement

Dealing will generally suffice); and

(v) the percentage participation interest of each party to the application.

(c) Such other information as the applicant wishes to be taken into account in consideration of the application.

(d) Each application must be accompanied by a fee of $A3 900, payable to the Commonwealth of Australia through an

Australian bank or bank cheque.

Further details of the work program bidding system outlined above, including the criteria for assessment of applications and the conditions to apply following the award of a permit, are available from the Director Petroleum, Minerals Petroleum and Energy,

Department of Primary Industries and Resources in Adelaide and from the Offshore Resources Branch, Department of Industry, Tourism and Resources in Canberra.

It should be noted that any income derived in the future from the recovery of petroleum from this area will be subject to the

Commonwealth Government’s Resource Rent Tax.

Applications together with relevant data should be submitted in the following manner to the Director Petroleum, Minerals Petroleum and Energy, Department of Primary Industries and Resources SA, Level 7, 101 Grenfell Street, Adelaide, SA 5000 before 4 p.m. on

Thursday, 25 September 2003.

The following special instructions should be observed:

• two copies of the application and supporting data, together with a fee of $A3 900, payable to the Commonwealth of

Australia through an Australian bank or by bank cheque, should be enclosed in an envelope or package;

• the application should then be sealed and clearly marked as ‘Application for Area S02…..

- Commercial-in-Confidence’;

• this envelope or package should then be enclosed in a plain covering envelope or package and delivered by hand or posted to the relevant address above.

1. Introduction

1.1 Section 4 (1) (c) of the Parliamentary Remuneration Act

1990, confers jurisdiction on the Remuneration Tribunal to determine from time to time electorate allowances and other allowances and expenses for Members of Parliament.

1.2 On 15 January 2003, the Tribunal wrote to all Members of

Parliament and major political parties advising that the

Tribunal would conduct a review of those allowances and expenses, having regard to existing electoral boundaries, and seeking submissions on any matter relevant to such a review, including evidence of increased costs and expenses incurred for the allowances.

1.3 On 28 January 2003, the following was published in The

Advertiser newspaper:

REMUNERATION TRIBUNAL

Review of Electorate and Other Allowances

Section 4 (1) (c) of the Parliamentary Remuneration Act 1990, confers jurisdiction on the Remuneration Tribunal to determine from time to time electorate allowances and other allowances and expenses for Members of

Parliament.

Electorate allowances compensate members of Parliament for the expenses they necessarily incur in the performance of their duties.

Other allowances referred to include:

• Expense Allowances of Ministers of the Crown;

• Expense Allowances of Officers of Parliament;

• Country Member’s Accommodation Allowance; and

• Travelling and Accommodation Allowances.

It should be noted that the Remuneration Tribunal does not set salaries for

Members of Parliament.

Interested persons, organisations and associations are invited to submit in writing any views they consider should be taken into account in the above reviews.

1.4 The Tribunal received a number of requests from Members for an extension of time to respond to the Tribunal’s request for submissions in relation to the review. At its meeting on 24 February 2003, the Tribunal granted those

Members an extension until Wednesday, 12 March 2003.

1.5 The Tribunal heard oral submissions from Members of

Parliament on 24 February 2003 and 18 March 2003.

1.6 Written and/or oral submissions were received from:

1.6.1 the Hon. John Rau who sought the provision of motor vehicles to the Members of the South

Australian Parliament under an arrangement similar to that of Federal Parliament. Mr Rau considered it quiet anomalous that vehicles were not provided when compared with what occurs in other states

and to Public Servants and other Private Sector employees of similar seniority. Mr Rau also requested that the Global Allowance be increased to allow for stretched office resources as a result of additional staff allocations;

1.6.2 the Hon. Bob Such who sought a specific allocation of a motor vehicle to Members of Parliament in return for appropriate adjustments to Member’s electorate allowances. He claimed ‘the issue has dragged on for a long time and needs to be resolved’ and that ‘many MPs from various political parties have approached me on this issue and I have agreed, along with others to raise the matter with you’;

1.6.3 the Hon. Liz Penfold who provided details of the diverse activities within her electorate of Flinders and the expenditure involved in servicing that electorate including the cost of staff wages and overheads;

1.6.4 the Hon. Martin Hamilton-Smith who sought an increase in electorate allowances given the increasing costs associated with communicating on matters of concern with constituents through quarterly news bulletins and letters to each household in the electorate;

1.6.5 the Hon. Mark Brindal who sought an increase in electorate allowances to meet the myriad of costs associated with running an electorate office and the ability to access salary sacrifice arrangements similar to those offered to public servants;

1.6.6 the Hon. Vicki Chapman who detailed activities undertaken in her electorate and expenses incurred including those incurred in visiting properties etc. outside her electorate but owned by people or businesses inside her electorate;

1.6.7 the Hon. Wayne Matthew who sought clarification of matters related to allowances determined by the

Tribunal and supplied a detailed summary of expenses incurred in the 2000-2001 and 2001-2002 years above that provided for in the electorate allowance;

1.6.8 the Hon. Angus Redford and the Hon. Terry

Stephens who drew the Tribunal’s attention to the history of the electorate allowance and, whilst not commenting on the adequacy of the current amounts, advised the Tribunal that at least nine

Members of the Legislative Council had indicated they would record expenditure for a 12 month period to assist the Tribunal in fixing appropriate rates; and

1.6.9 members of the public. Both of the two submissions received stated that Members of Parliament should be subject to normal Taxation rules and receive re-imbursement, upon presentation of proof of purchase, only for costs actually incurred.

2. Electorate Allowances

2.1 Electorate allowances are provided to compensate

Members of Parliament for the expenses they necessarily incur in the performance of their duties. A significant component of the allowance covers the cost of running a motor vehicle in the servicing of electorates. Other items of expense may include accommodation and travelling expenses (not otherwise covered), donations, subscriptions, telephone, printing, stationery and postage, without attempting to give a fully exhaustive list.

2.2 These allowances were last increased from 1 February

2001, having regard to movement in the Consumer Price

Index for the period from July 1999 to December 2000.

2.3 Submissions from Members of Parliament, in addition to seeking increased electorate allowances, also raised two significant issues for the Tribunal to consider as part of its review. These issues were the ability for Members of

Parliament to access salary sacrifice arrangements and the allocation of motor vehicles.

2.4 Whilst the Tribunal believed it did not have the jurisdiction under the Parliamentary Remuneration Act 1990, to make determinations in relation to these matters it sought legal advice from the Crown Solicitor’s Office on these issues.

2.4.1 Salary Sacrifice Arrangements

In relation to salary sacrifice arrangements, the

Crown Solicitor has confirmed that the Tribunal does not have jurisdiction to make a determination to provide for salary sacrifice arrangements. The

Tribunal is advised that any salary sacrifice arrangement for Members of Parliament would need to be by variation to the Parliamentary

Remuneration Act 1990, by Parliament as it is an act of Parliament that determines the salaries of

Members of Parliament.

2.4.2 Allocation of Motor Vehicles

A number of Members of Parliament made submissions for the allocation of motor vehicles to

South Australian Members of Parliament on the basis that all other States had arrangements in this regard.

The Tribunal is informed that Federal Members along with Members in Victoria, Western Australia and the Northern Territory have access to motor vehicles under various arrangements. However

Members in New South Wales, Queensland and some Members in Tasmania do not have vehicles provided.

The Crown Solicitor has confirmed that, under the

Parliamentary Remuneration Act 1990, the Tribunal does not have the power to determine that motor vehicles be supplied to Members of Parlia-ment as part of their salary and allowances. Having regard to section 6A of the Act, both Parliament and the

Crown have the power to provide Members of

Parliament with motor vehicles. Indeed that power has been exercised with the provision of a motor vehicle to one Member of Parliament in lieu of a chauffer driven vehicle.

As a significant component of the Electorate

Allowance covers the cost of running a vehicle in the servicing of electorates, if vehicles are provided to Members of Parliament the Tribunal would need to consider a downward adjustment of the electorate allowance.

2.5 Whilst the Tribunal received various other submissions from Members in relation to electorate allowances, only limited evidence was given to the Tribunal as to the measure of increase (if any) in any of those components specifically, since the date of the last Determination.

2.6 The Tribunal has on a number of occasions (in 1969, 1975 and 1994) endeavoured to gain more detailed information from Members of Parliament on actual expenses incurred in servicing electorates. It has therefore been a matter of some concern that on each of these occasions the Tribunal has received only limited information.

2.7 The Tribunal however is encouraged from submissions heard in this review that at least nine Members of the

Legislative Council have indicated they would complete a survey of expenditure if the Tribunal was to conduct a further full review of allowances and expenses payable.

2.8 Accordingly, whilst the Tribunal is at this stage only prepared to accept that the movement in the Consumer

Price Index justifies a minimal adjustment to the electorate allowances and has therefore determined new electorate allowances as set out in the Determination, it has decided to conduct an extensive review of electorate allowances payable to Members of Parliament by way of a survey in the near future.

2.9 This survey will be conducted for the period 1 July 2003 to

30 June 2004 and each Member of Parliament will be sent in advance a copy of information which the Tribunal will be requesting. Members will be reminded that electorate allowances are payable for personal expenses in

servicing the constituents in the electorate in which they serve as distinct from those occurred in campaigning or securing support for re-election.

3. Expense Allowances of Ministers of the Crown and Officers of

Parliament

3.1 These allowances are to compensate Ministers of the

Crown and Officers of Parliament for the extraordinary expenses incurred when performing the duties of these offices and were last increased from 1 February 2001.

3.2 The Tribunal received no submissions to increase these allowances and had no evidence put before it as to the measure of increase (if any) in costs and expenses relating to any of those components specifically, since the date of the last Determination. The Tribunal therefore has determined not to increase these allowances at this time.

3.3 The Tribunal will be writing to Ministers of the Crown and

Officers of Parliament receiving these allowances requesting additional information in order to be satisfied that any increase to these allowances are justified.

4.

Country Members’ Accommodation Allowance

4.1 This allowance was last increased from $140 to $158 per night from 1 July 2000 and is payable to members of

Parliament whose usual place of residence is more than

75 km by road from the General Post Office at Adelaide and who are required to stay in Adelaide overnight in order to attend to parliamentary duties and to also meet their duties to be actively involved in community affairs and represent and assist constituents in dealings with governmental and other public agencies and authorities.

4.2 The maximum amount payable for a 12 month period is

$21 330 and this amount was effective from 1 July 2000.

4.3 The Tribunal received submissions from two Members detailing benefits potentially gained by Country Members who utilise this allowance to subsidise the purchase of a second residence in Adelaide.

4.4 Whilst the Tribunal notes these submissions (along with similar submissions received in previous years), and is aware of growing public expectations that persons in public office do not benefit from that position, it is not prepared to alter the arrangements which have been in place for over 30 years without full consideration. In its determination in

1994, the then Tribunal stated:

‘In addition, the Tribunal is aware that some members have deliberately chosen to acquire a second residence, either by way of house, flat, unit, etc. and it is very difficult to determine the actual expenses in these circumstances.

As a matter of policy, the Tribunal does not wish to disadvantage such members for the exercise of this choice and has therefore decided to provide an allowance of a flat amount per overnight stay in Adelaide irrespective of the form of accommodation used. Such payment should not exceed the maximum prescribed in the Determination for each 12 month period and should only apply to those members who are eligible to receive the allowance by virtue of the fact that:

(i) the Member remains in Adelaide overnight; and

(ii) the Member’s usual place of residence is more than

75 km by road from the G.P.O. Adelaide.’

4.5 The Tribunal is aware that the Commonwealth Remuneration Tribunal has determined an allowance of one-third of the commercial rate for those Members who do not avail themselves of commercial accommodation.

4.6 The Tribunal received no submissions to increase this allowance and had no evidence put before it as to the measure of increase (if any) in costs and expenses relating to overnight accommodation in Adelaide.

4.7 Accordingly, the Tribunal has decided to review this policy and will consider determining a rate for those not using commercial accommodation at a figure considerably less than that determined for those using commercial accommodation. The Tribunal will also consider replacing the overnight allowance for commercial accommodation with reimbursement of actual costs incurred up to a maximum overnight rate and annual ceiling. As part of the

Tribunal’s review of this allowance it will be writing to country Members in the near future inviting submissions on the matter.

4.8 Having regard to the above, the Tribunal has determined not to increase the Country Member’s Accommodation

Allowance at this time.

5. Travelling and Accommodation Allowances of Ministers and the Leader and Deputy Leader of the Opposition

5.1 These allowances are payable when expenditure is incurred when travelling on official business. These rates were last increased from 1 April 2002.

5.2 The Tribunal received no submissions to increase these allowances and had no evidence put before it as to the measure of increase (if any) in costs and expenses relating to any of those components specifically, since the date of the last Determination. The Tribunal therefore has determined not to increase these allowances at this time.

5.3 The Tribunal has decided to review the basis of this allowance and will consider determining a rate for those not using commercial accommodation at a figure considerably less than that determined for those using commercial accommodation. The Tribunal will also consider replacing the overnight allowance for commercial accommodation with reimbursement of actual costs incurred up to a maximum overnight rate. As part of the

Tribunal’s review of this allowance it will be writing to

Ministers of the Crown and the Leader and Deputy Leader of the Opposition in the near future inviting submissions on the matter.

1.

This proclamation may be cited as the Criminal Law Consolidation (Offences of Dishonesty)

Amendment (Commencement) Proclamation 2003 .

Commencement of suspended provisions

The remaining provisions of the Criminal Law Consolidation (Offences of Dishonesty)

Amendment Act 2002 will come into operation on 5 July 2003.

Short title

This proclamation may be cited as the National Parks and Wildlife (Sturt Gorge Recreation Park)

This proclamation comes into operation on the day on which it is made.

Alteration of boundaries of Sturt Gorge Recreation Park

3.

(1) The boundaries of the Sturt Gorge Recreation Park are altered by excluding from that Park the following land:

Section 1549, Hundred of Noarlunga, County of Adelaide.

(2) The boundaries of the Sturt Gorge Recreation Park are further altered by adding to that Park the following Crown land:

Allotment 3 of Plan No. DP 61457, Hundred of Noarlunga, County of Adelaide, accepted for deposit in the Lands Titles Registration Office at Adelaide.

Development Plan Review—Public Consultation

NOTICE is hereby given that the City of Onkaparinga is reviewing its Development Plan, pursuant to section 30 of the

Development Act 1993. The Development Plan Review will determine the appropriateness of the Onkaparinga Development

Plan to the council area and its consistency with the State Planning

Strategy for Metropolitan Adelaide.

Community input into the Development Plan Review is invited over a two month period, from Monday, 12 May 2003 until

Friday, 11 July 2003. During this time any interested person is invited to make written submissions on the subject of the

Development Plan Review. Any person who makes a written submission in response to this invitation will be given an opportunity to appear personally or by representative before a council committee to be heard on their submission.

A Development Plan Review Discussion Paper will be available for viewing at council’s Aberfoyle Park, Noarlunga and Willunga offices and council libraries. The Discussion Paper will be available during normal office hours during the Development Plan

Review public consultation period and on Council’s website: www.onkaparingacity.com

Written submissions regarding the Development Plan Review must be forwarded to the City of Onkaparinga no later than 5 p.m. on 11 July 2003. Persons making written submissions should indicate whether they wish to be heard on their submission at the public hearing and if so, contact details should be provided.
