ORDINANCE NO. 63-2015 (AMENDED)

AN ORDINANCE ESTABLISHING THE PROCEDURE FOR
AND AUTHORIZING THE SALE OF OBSOLETE EQUIPMENT
OF THE CITY HAVING A VALUE OF $10,000 OR LESS ON
GOVDEALS.COM AND DECLARING AN EMERGENCY
WHEREAS, the City occasionally has the need to dispose of obsolete equipment
no longer needed for any municipal purpose; and
WHEREAS, GOVDEALS.com has become a standard mode for many
municipalities and has proven to be an effective and reasonable way for municipalities to
dispose of obsolete city equipment no longer needed for municipal purposes; and
WHEREAS, it is desired that the respective heads of the various city departments
be authorized at any time to promptly make available for sale on GOVDEALS.com any
and all obsolete equipment of the City no longer needed for municipal purposes having a
value of Ten Thousand Dollars ($10,000.00) or less to be sold on GOVDEALS.com.
Now therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF OLMSTED
FALLS, OHIO, THAT:
SECTION 1. That the respective heads of the various city departments are
hereby authorized, respectively, to advertise and sell at public auction on
GOVDEALS.com any and all City property that is obsolete and no longer needed for
municipal purposes when such item is valued at no more than Ten Thousand Dollars
($10,000.00).
SECTION 2. That prior to offering the sale of such obsolete equipment, the
Director or Department Head in charge of such obsolete equipment shall submit a
Declaration to the Mayor and the Director of Finance expressly declaring that such
item(s) is (are) no longer needed for municipal purposes and the same should be sold and
the proceeds thereof be deposited into the appropriate City fund.
SECTION 3. That the Director of Finance shall provide appropriate forms to
track the declaration that such item(s) is (are) obsolete and no longer needed for
municipal purposes and the same shall be retained in the Department of Finance for
purposes of tracking the disposition of such city property.
SECTION 4. The Council finds and determines that all formal actions of this
Council relating to the adoption of this Ordinance have been taken at open meetings of
this Council; and that deliberations of this Council and of its committees, resulting in
such formal action, took place in meetings open to the public, in compliance with all
Ord. 63-2015 (AMENDED)

statutory requirements including the requirements of Section 121.22 of the Ohio Revised
Code.
SECTION 5. This Ordinance is hereby declared to be an emergency measure
necessary for the immediate preservation of the health, safety and welfare of the residents
of Olmsted Falls for the reason that it is immediately necessary to sell various items of
obsolete equipment to provide funds for the general fund and to eliminate the necessity of
storing and housing obsolete equipment no longer needed for any municipal purpose. It
shall therefore take effect immediately upon passage by the affirmative vote of no less
than five (5) members elected to Council and approval by the Mayor or otherwise at the
earliest time allowed by law.
