General Session Minutes of the North Carolina Medical Board
Meeting held March 21-23, 2012.
The North Carolina Medical Board met March 21-23, 2012, at its office located at 1203 Front
Street, Raleigh, NC. Ralph C. Loomis, MD, President, called the meeting to order. Board
members in attendance were: Janice E. Huff, MD, Past President; William A. Walker, MD,
President-Elect; Thomas R. Hill, MD, Secretary/Treasurer; Ms. Pamela Blizzard; John B. Lewis,
Jr., LLB; Peggy R. Robinson, PA-C; Eleanor E. Greene, MD; Ms. Thelma Lennon; Paul S.
Camnitz, MD and Cheryl L. Walker, MD.
Presidential Remarks
Dr. Loomis commenced the meeting by reading from the State Government Ethics Act, “Ethics
awareness and conflict of interest reminder.” No conflicts were reported.
Minute Approval
Motion: A motion passed to approve the January 18, 2012 Board Meeting Minutes, the
February 13, 2012 Special Board Meeting Minutes, the February 16, 2012 Hearing Minutes and
the March 6, 2012 Emergency Board Meeting Minutes.
Announcements
1. Mr. Hari Gupta recognized Barbara Gartside on her five-year anniversary at the NCMB.
2. Ms. Jean Fisher-Brinkley introduced Michelle Yanik as our new employee in the Public
Affairs department.
3. David Henderson introduced Ms. Kathleen Haley and Dr. Bob Schaaf of the AIMAP
Assessment Team.
EXECUTIVE COMMITTEE REPORT
The Executive Committee of the North Carolina Medical Board was called to order at 1:30 p.m.,
Thursday March 22, 2012, at the offices of the Board. Members present were: Ralph C.
Loomis, MD, Chair; William A. Walker, MD, Thomas R. Hill, MD, Janice E. Huff, MD, and Peggy
Robinson, PA-C.
1) Financial Statements
a) Monthly Accounting January 2012 and December 2011
The Committee reviewed the January 2012 and December 2011 compiled financial
statements. January is the third month of fiscal year 2012.
Committee Recommendation: Accept the financial statements as reported.
Board Action: The Board accepted the Committee recommendation.

b) Investment Account Statements
The Committee reviewed the February and January 2012 investment account
statements from Fifth Third Bank.
Committee Recommendation: Accept the investment account statements as reported.
Board Action: The Board accepted the Committee recommendation.
2) Old Business
a) Proposed Changes to the Corporation Rules
The Board previously approved amendments to the Medical Board’s Professional
Corporations Rules, 21 NCAC 32C .0102-0109, as part of the Board’s comprehensive
effort to update and improve all Board rules. The Committee discussed additional
changes to the Professional Corporation Rules as suggested by the Rules Review
Commission staff.
Committee Recommendation: Approve proposed rules (Appendix G) for filing with the
Rules Review Commission.
Board Action: The Board accepted the Committee recommendation.
b) Proposed Changes to the FSMB Bylaws
The Committee re-visited proposed changes to the FSMB Bylaws that were submitted
by NCMB resolution to the FSMB Bylaws Committee which would change the Associate
Members term from two to three years.
Committee Recommendation: Dr. Walker to represent the NCMB before the Reference
Committee at the FSMB meeting in April in support of the NCMB’s resolution.
Board Action: The Board accepted the Committee recommendation.
c) CPEP East Update
The Committee discussed efforts to establish a CPEP site in North Carolina.
Committee Recommendation: Defer to the full Board for discussion.
Board Action: The Board provided feedback to staff regarding the proper role of the
Board in establishing a CPEP site in North Carolina.
3) New Business
a) Proposed Changes to G.S. 90-13.2(b)
The Committee discussed proposed changes to G.S. 90-13.2(b) (below) which would
waive the annual registration fee, currently $25.00, for a retired limited volunteer license
(“RLVL”) and to make other stylistic changes.

Committee Recommendation: Adopt the proposed changes to G.S. 90-13.2.
Board Action: The Board accepted the Committee recommendation.
§ 90-13.2. Registration every year with Board.
(a)
Every person licensed to practice medicine by the North Carolina Medical Board
shall register annually with the Board within 30 days of the person's birthday.
(b)
A person who registers with the Board shall report to the Board the person's name
and office and residence address and any other information required by the Board, and shall
pay an annual registration fee of one hundred seventy-five dollars ($175.00), except those who
have a limited training license pursuant to G.S. 90-12.01 to practice in a medical education and
training program approved by the Board for the purpose of education or training shall pay a
registration fee of one hundred twenty-five dollars ($125.00) and those who have a retired
limited volunteer license pursuant to G.S. 90-12.1(B) shall pay an annual registration fee of
twenty five dollars ($25.00) and those who have or a limited volunteer license pursuant to G.S.
90-12.1A shall pay no annual registration fee. However, licensees who have a limited training
license to practice for the purpose of education and training under pursuant to G.S. 90-12.01
shall not be required to pay more than one annual registration fee for each year of training.
b) Board Member Immunity / Insurance
The Committee discussed various examples of possible Board member liability and
whether Board Members would be protected by sovereign immunity and/or insurance
coverage.
Committee Recommendation: Accept as information.
Board Action: The Board accepted the Committee recommendation.
c) AIMAP-NC Update
The chair of the AIMAP-NC Assessment Team, Ms. Kathleen Haley, gave a preliminary
report to the Committee. The site visit was conducted March 13-15.
Committee Recommendation: Accept as information.

POLICY COMMITTEE REPORT

1. Old Business
a. Position Statement Review continued
i. Self- Treatment and Treatment of Family Members and Others with Whom
Significant Emotional Relationships Exist (APPENDIX A)

Issue: In November 2009, the Board approved the Policy Committee’s recommendation
to review Position Statements at least once every four years. A review schedule has
been formulated for the Committee’s consideration.
3/2011 Committee Discussion: Mr. Brosius suggested that the Board may need to
establish some bright lines, because the current position statement leaves room for
some treatments that the Board may deem unethical depending on physician
interpretation. Dr. Loomis suggested that he preferred a hardline approach and would
recommend eliminating minor treatment of illness. He indicated that the Board’s interest
is for the patients to receive the best care. Dr. Greene agreed that eliminating treatment
of minor illness would remove any room for confusion, but also felt we should leave the
ability to treat during an emergency in the position statement. Dr. Camnitz indicated
that he did not like the vagueness of the position statement and would prefer it be more
specific regarding over-the-counter medications and prescription medications, possibly
indicating specific schedules that would be restricted. The Committee further discussed
chronic versus acute. It was also recommended that “physician” should be replaced with
“licensee” to be consistent with edits made in previous position statement reviews.
3/2011 Committee Recommendation: Table issue for the Legal Department to
incorporate the recommendations from the Committee discussion.
3/2011 Board Action: No Action necessary.
This Position Statement has now been assigned to a Task Force specifically analyzing
the issue and headed by Dr. Loomis.
5/2011 Committee Discussion: Dr. Loomis reported that the Task Force was scheduled
to meet in June 2011. Dr. Kirby stated that the AMA has a statement regarding
treatment of professional peers and suggested that something similar be included in our
position statement.
5/2011 Committee Recommendation: Table issue until Task Force report is presented to
the Committee. Dr. Kirby is to provide the AMA position prior to the Task Force meeting.
5/2011 Board Action: Accept Committee recommendation
7/2011 Committee Discussion: The Committee discussed the potential benefits of
revising the current position statement. Comments were received by Board members
and senior staff that were present. One comment that had been received numerous
times is that the licensees would like the terms of the position statement better defined.
The Committee agreed that prescribing narcotics to one’s self or family members is
never appropriate. It was suggested that adopting a rule prohibiting prescribing narcotics
to one’s self or family members might be a more efficient method for the Board to
enforce compliance. The Committee concurred. There was additional discussion that
identifying what constitutes a significant emotional relationship may be difficult.
7/2011 Committee Recommendation: Instruct Legal to begin drafting a rule to cover
prescribing narcotics to one’s self or family member. The Office of the Medical Director
is to provide definitions to help clarify the Board’s statement. The proposed changes will
be provided to the Committee and Task Force for review.

9/2011 Committee Discussion: The Committee reviewed the proposed revised position
statement as well as the proposed rule changes for PAs, NPs and physicians. There
was also discussion regarding the large response we received from the Board licensee
population. There was discussion regarding the need to identify with whom an
emotional relationship may exist. It was felt that the revised position statement could be
modified to better reflect the position on the Board. Additionally the consensus of the
Committee was that the proposed rules changes were appropriate and should go
forward.
9/2011 Committee Recommendation: Dr. Camnitz will work with Mr. Brosius and Dr.
Kirby to revise the position statement and present it to the Committee at the November
Board meeting. Proceed with the rule-making process on the proposed rule change.
9/2012 Board Action: Accept Committee recommendation.
1/2012 Committee Discussion: The Committee reviewed the proposed revised position
statement. The changes discussed have been incorporated in the proposed position
statement. It was also reported that the proposed rules adopted by the Board in
September will be filed this month with an anticipated effective date of June/July 2012.
1/2012 Committee Recommendation: Tentatively approve proposed position statement
with changes so that it may be circulated to interested parties and Self –Treatment Task
Force for comments and suggestions.
01/2012 Board Action: Accept Committee Recommendation.
3/2012 Committee discussion: The Committee discussed additional proposed changes
to the current position statement. It was suggested that the position statement include
language regarding prohibiting licensees from prescribing controlled substances to
themselves or immediate family members. Language was also added suggesting that
medical records be provided to the patient’s primary care provider.
3/0212 Committee Recommendation: Approve proposed position statement including
language regarding proposed rule pertaining to controlled substances. The rule
language would be added after the rules are approved by the Rules Review
Commission.

ii. Availability of Physicians to Their Patients (APPENDIX B)
9/2011 Committee Discussion: The Committee reviewed the current position statement.
It was suggested that the term physician be replaced with licensee in order to be
consistent with past revisions to the Board’s position statements. Dr. Kirby pointed out
the need to relate this position statement to providers who are providing care through
telemedicine.
9/2011 Committee Recommendation: The staff is to provide a revised position
statement at the November Committee meeting.

1/2012 Committee Discussion: The Committee reviewed the proposed revised position
statement. There was discussion regarding the requirement that instructions for
securing afterhours care be in writing.
1/2012 Committee Recommendation: Mr. Brosius will provide the Committee with a
revision of the position statement to address its concerns.
1/2012 Board Action: Accept Committee recommendation.
3/2012 Committee Discussion: The Committee discussed and modified changes to the
new proposed language. That language is now incorporated in the working draft of the
position statement. Dr. Kirby expressed concern regarding recognition of episodic care
pertaining to after-hours coverage. Ms. Whited asked for the Board to allow NCMS an
opportunity to comment on the position statement after Dr. Kirby’s suggestions are
included within the position statement.

concerns.

2. New Business:

1/2010 Committee Recommendation: (Loomis/Camnitz) Adopt a 4 year review schedule
as presented. All reviews will be offered to the full Board for input. Additionally all
reviews will be documented and will be reported to the full Board, even if no changes are
made.
1/2010 Board Action: Adopt the recommendation of the Policy Committee.
2. New Business:
a. Position Statement Review
i. Sexual Exploitation of Patients (APPENDIX D)
3/2012 Committee discussion: The Committee discussed the language in the current
version of the position statement and suggested having Mr. Brosius simplify the
language in the position statement.

3/2012 Board Action: Approve Committee recommendation.
2. New Business
b. Board inquiry (APPENDIX E)
3/2012 Committee discussion: There was discussion amongst the Committee members
and members of the staff who were present regarding the legal and ethical implications
of the inquiry.

3/2012 Committee Recommendation: Mr. Brosius to research and provide the
Committee with a legal opinion at the May meeting.
3/2012 Board Action: Approve Committee recommendation.
2. New Business
c. Advertising and publicity Position Statement – suggested change
i. Minor revision suggested by Dr. Walker: "The Board expects the licensee to
identify the area of Board certification and the certifying Board in any
advertising." (APPENDIX F)
3/2012 Committee discussion: The Committee discussed a proposed change regarding
the advertisement of board certification and strengthening the language to require, rather
than suggest, that the identity of the specialty board be disclosed.

CONTINUED COMPETENCE COMMITTEE REPORT
The Continued Competence Committee of the North Carolina Medical Board was called to order
at 1:00 p.m. March 21, 2012, at the office of the Medical Board. Members present were:
Thomas R. Hill, MD, Chair; Paul S. Camnitz, MD and Cheryl Walker-McGill, MD. Also present
were: David Henderson, Michael Sheppa, MD, Hari Gupta, Christina Apperson, Ms. Kathleen
Haley, Dr. Bob Schaaf, Nancy Hemphill and Maureen Bedell.

a. There was no old business discussed.
2.
New Business
a. Dr. Hill reviewed the FSMB Workgroups report ‘Define A Minimal Data Set’. A
discussion followed comparing the questions that the FSMB proposed to those that
the NCMB currently asks on its MD/DO renewal. Hari Gupta, Director of Operations,
explained that our MD/DO renewal questions are similar to most of the FSMB
questions. One of the FSMB questions is not asked: ‘how many weeks did you work
in the past year’.
Committee Recommendation: NCMB staff to contact FSMB and find out if the FSMB
questions were suggestions or if the FSMB wanted member Boards to use those
exact questions. NCMB staff would also contact SHEPS and see if making the FSMS
changes would cause any problems.
BOARD ACTION: To accept the Committee Recommendation.
b. Dr. Walker-McGill discussed with the committee the importance of finding out
what the patient population served is. Meaning what are the resources available vs
the population needs. Are physicians leaving areas that are in need? An in depth
discussion followed.

Committee Recommendation: NCMB staff to contact the Institute of Medicine,
Community Care of NC and the NC Department of Health to find out who the
stakeholders are and what types of data they have each collected.

LICENSE COMMITTEE REPORT
The License Committee of the North Carolina Medical Board was called to order at 1:00 p.m.,
March 21, 2012, at the office of the Medical Board. Members present were: William Walker,
MD, Chair, Pamela Blizzard and Eleanor Greene, MD. Also present was: Scott Kirby, MD,
Thom Mansfield, Patrick Balestrieri, Carren Mackiewicz, Jean Fisher-Brinkley, Joy Cooke,
Michelle Allen, Mary Rogers, Kathleen Haley, Robert Schaaf, MD and Amy Whited

1. Pending Applications Over One Year Old
Issue: Staff has been requested to report to the Committee every meeting the number of
pending applications that are more than 1 year old. Currently we have 29. Of those, 2 have
open investigations in other states and their NCMB application is on hold; 1 was denied at the
January meeting. Staff will review and mark the other 26 applications “expired” as time
permits.

2. PGT Requirement for Medical School Faculty Limited License (MSFL)
Issue: The majority of applicants for a MSFL license completed training and education or have
experience outside the US and Canada that is not approved by ACGME, CFPC, RCPSC, or
AOA as required by NCAC 32B .1502 (b)(7). Any experience, education or training not
approved by the forgoing organizations must be determined, by the Board, to be equivalent to
training approved by these organizations.
21 NCAC 32B .1502 APPLICATION FOR MEDICAL SCHOOL FACULTY LICENSE
(b) In order to obtain a Medical School Faculty License, an applicant shall:

submit proof of satisfactory completion of at least one year of GME
approved by ACGME, CFPA, RCPSC or AOA; or evidence of other
education, training or experience determined by the Board to be
equivalent.
Committee Recommendation:
In an effort to avoid unreasonable delays in processing
these applications it is recommended that the Chair of the License Committee be given the
authority to review and determine whether experience, education or training that is not approved
by ACGME, CFPC, RCPSC or AOA is equivalent to training that is approved by these

organizations with input from staff/Medical Director. Should the Chair have concerns with
regard to making a determination, they can pass it on to the Board for a determination.
Dr. Kirby expressed concern with the medical education of Caribbean medical schools and the
number of graduates of these schools applying for a license.
Board Action: In an effort to avoid unreasonable delays in processing these applications it is
recommended that the Chair of the License Committee be given the authority to review and
determine whether experience, education or training that is not approved by ACGME, CFPC,
RCPSC or AOA is equivalent to training that is approved by these organizations with input from
staff/Medical Director. Should the Chair have concerns with regard to making a determination,
they can pass it on to the Board for a determination.
Dr. Kirby was instructed to create a formal report to present to the committee at the July 2012
meeting regarding possible additional requirements or exclusions for medical license regarding
medical schools training.
3. Withdrawals
Issue: Staff requests clarification that in all cases where the Board Action is “allow withdrawal”,
that the Board’s intent, in the event the applicant does not withdraw, the application will be
denied.
Committee Recommendation:

4. Oral Interview Question #1
Issue: It was recommended that question #1 on the oral interview questions be amended by

A motion passed to close the session pursuant to Section 143-318.11(a) of the North Carolina
General Statutes to prevent the disclosure of information that is confidential pursuant to
Sections 90-8, 90-14, 90-16, 90-21.22 of the North Carolina General Statutes and not
considered a public record within the meaning of Chapter 132 of the General Statutes and/or to
preserve attorney/client privilege.
Eleven licensure interviews were conducted. A written report was presented for the Board’s
review. The Board adopted the Committee’s recommendation to approve the written report.

The Allied Health Committee of the North Carolina Medical Board was called to order at 8:00
a.m., Wednesday, March 21, 2012 at the office of the Board.

1. Drugs that the NC Office of Emergency Medical Services is requesting to be added to the

Issue: Dr. Tripp Winslow discussed the drugs that the NC office of Emergency Medical
Services is requesting to be added to the NCMB approved list of medications for credentialed
EMS personnel.
Committee Recommendation: Approve the NC Office of Emergency Medical Services
additional five medications to the NCMB approved list of medications for credentialed EMS
personnel: 1. Octreotide, 2. N-Acctylcysteine, 3. Phenylephrine, 4. Ketamine, 5. Propofol.

Open Session Physician Assistants
1. 2011 PA Compliance Review Summary Report
Issue: Don Pittman discussed the 2011 PA Compliance Review Summary Report.
Committee Recommendation: Don Pittman to work with Lori King to write an article for the
Forum regarding the results of the 2011 PA Compliance Program. Also recommend that this
article be added to the “Pulse”, the NCAPA Newsletter.

2. Physician Assistant Advisory Council (PAAC) 2012 Committee Members.
Issue: The North Carolina Medical Board’s Physician Assistant Advisory Council (PAAC)
advises and communicates with the Board on issues affecting PA practice and regulation in the
state. The PAAC does not have authority to license or discipline PAs, but it provides valuable
insights to the Board’s Allied Health Committee and to the full Board. The PAAC meets once a
year in July. The members of the PAAC are nominated by the Allied Health Committee and
appointed by vote of the full Board for terms of two years. They may be reappointed by Board
action. The PAAC’s members represent the leadership of the North Carolina Academy of
Physician Assistants, the PA Section of the North Carolina Medical Society and each PA
training program in North Carolina. They also include other PA and physician members chosen
for their particular expertise on issues facing the Board.

BEST PRACTICES COMMITTEE
The Best Practices Committee of the North Carolina Medical Board was called to order at 3:00
p.m. on Thursday, March 22, 2012, at the office of the Medical Board. Members present were:
Ms. Pamela Blizzard, Chair; Dr. Janice Huff and Ms. Thelma Lennon. Also present were: David
Henderson, Dr. Scott Kirby, Christina Apperson, Todd Brosius and Maureen Bedell.
1. Old Business
a. Update on “CPEP East”
Christina Apperson provided a summary of the CPEP East Overview and
Timeline. The group briefly discussed the Board’s role in CPEP East
introductions/discussions with North Carolina organizations.
b. Proposed speakers regarding telemedicine
Christina Apperson is to contact representatives of the Georgia Partnership for
Telehealth to speak at the May meeting.
2. New Business
a. The committee heard a report from David Henderson, Dr. Scott Kirby and Todd
Brosius concerning a meeting they attended recently concerning a proposed
telemedicine model. Involved groups include American Well, Blue Cross, UNC,
and Walgreens. The most recently proposed delivery model/study would include
a kiosk in a Walgreens store to be manned by a pharmacist. A patient would
have online access to a family practice physician via telemedicine link-up for a
limited number of conditions. Walgreens would fill any needed prescriptions.
MEDICAL SCHOOL EDUCATIONAL OUTREACH PROJECT
The Medical School Education Outreach Project group was called to order at 12:15 p.m. on
March 22, 2012 at the office of the Medical Board. Members present were: Peggy Robinson,
PA-C, Chair; Janice Huff, MD, and Pamela Blizzard. Also present were: Jean Fisher-Brinkley;
Nancy Hemphill; and Dena Konkel. There were no absences.
1. Old Business
a. We reviewed the discussion from our February 24 meeting/ conference call.
2. New Business
a. The Committee brainstormed ideas for the professionalism module.
1. Truthfulness/ candor: example: on license applications. Disclose misdemeanors;
ask your lawyer for advice about “expungements”; report academic probation.

2. Accountability/ respect for the Board. Timeliness, compliance with institutional
deadlines, such as keeping up with clinical requirements for CME on infections, etc.
Keep records of everywhere you’ve ever worked or lived, for future license
applications. Keep records of any criminal history.
3. Compassion, humanity. Studies show that students entering medical school and
new physicians entering residency have high levels of caring, but then lose that over
time. Compassion is an important aspect of patient care.
4. Communication: include statistics about poor communication being the base of
many complaints and professional liability payments.
5. Humility vs. arrogance/ team orientation/ don’t be a disruptive physician. Interact
with your patients and staff with respect.
6. Don’t have sex with patients or staff.
7. Self-reflection. This is part of MOL. Remember why you went to medical school.
Value wellness and strive for a balance between your work and personal life. Avoid
burnout.
8. Put the patient’s needs first. Use patient handoffs as example. Even with
restrictions on work hours for residents, patient care has priority over the clock, your
family life, etc. It is critical that the next set of providers has the information needed
to care for the patient.
9. Cross-cultural awareness. Avoid being disdainful of a patient’s lifestyle or beliefs.
Be careful when discussing “hot button” issues, like a child’s obesity (which may
conflict with a cultural norm or be perceived as insulting to the parent.) To become
more culturally sensitive, a physician could participate in community events, or take a
class in a language.
b. Action items:
1. Jean will contact Dr. Patrick Ober at Wake Forest University Medical School, to
learn whether this module will still be useful to his students; when it might be used in
their curriculum; and whether our module will duplicate or reinforce their current
message about professionalism.
2. Nancy will contact AHEConnect, to learn about: what they need from the Board
for curriculum development; their time requirements to develop the module; and their
ideas on integrating video interviews or other clips into the module.
3. Nancy or Jean will contact Dr. Gerancher to see whether physicians in her
residency program might also serve as a test case for the module.
4. Staff will develop a “meaty” outline in the next few weeks, and will distribute that
to committee members for their review.

APPENDIX A
CURRENT POSITION STATEMENT:
Self-treatment and treatment of family members and others with whom significant
emotional relationships exist*
It is the position of the North Carolina Medical Board that, except for minor illnesses and
emergencies, physicians should not treat, medically or surgically, or prescribe for themselves,
their family members, or others with whom they have significant emotional relationships. The
Board strongly believes that such treatment and prescribing practices are inappropriate and
may result in less than optimal care being provided. A variety of factors, including personal
feelings and attitudes that will inevitably affect judgment, will compromise the objectivity of the
physician and make the delivery of sound medical care problematic in such situations, while real
patient autonomy and informed consent may be sacrificed.
When a minor illness or emergency requires self-treatment or treatment of a family member or
other person with whom the physician has a significant emotional relationship, the physician
must prepare and keep a proper written record of that treatment, including but not limited to
prescriptions written and the medical indications for them. Record keeping is too frequently
neglected when physicians manage such cases.
The Board expects physicians to delegate the medical and surgical care of themselves, their
families, and those with whom they have significant emotional relationships to one or more of
their colleagues in order to ensure appropriate and objective care is provided and to avoid
misunderstandings related to their prescribing practices.
*This position statement was formerly titled, "Treatment of and Prescribing for Family
Members."

PROPOSED CHANGES
Self-treatment and treatment of family members
It is the Board’s position that it is not appropriate for licensees to write prescriptions for
controlled substances or to perform procedures on themselves or their family members. Rules
32B .1001, 32S .0212, and 32M .0109 prohibit licensees from prescribing controlled substances
(including all narcotics) to themselves or immediate family members. In addition, licensees
should not treat their own chronic conditions or those of their immediate family members or
others with whom the licensee has a significant emotional relationship. In such situations,
professional objectivity may be compromised, and the licensee’s personal feelings may unduly
influence his or her professional judgment, thereby interfering with care.
There are, however, certain limited situations in which it may be appropriate for licensees to
treat themselves, their family members, or others with whom the licensee has a significant
emotional relationship.

1. Emergency Conditions. In an emergency situation, when no other qualified licensee is
available, it is acceptable for licensees to treat themselves or their family members until
another licensee becomes available.
2. Urgent Situations. There may be instances when licensees or family members do not
have their prescribed medications or easy physician access. It may be appropriate for
licensees to call in provide short term prescriptions.
3. Acute Minor Illnesses within Clinical Competence. While licensees should not serve as
primary or regular care providers for themselves or their family members, there are
certain situations in which routine care may be acceptable. Examples would be
treatment of a simple urinary tract infection antibiotic-induced fungal infections or
prescribing ear drops for a family member with external otitis. It is the expectation of the
Board that licensees will not treat recurrent acute problems.
4. Over the Counter Medication. This position statement is not intended to prevent
licensees from suggesting over the counter medications or other non-prescriptive
modalities for themselves or family members, as a lay person might.
Licensees who act in accord with this position statement will be held to the same standard of
care applicable to licensees providing treatment for patients who are unrelated to them. Thus,
licensees should not treat problems beyond their expertise or training and should be sure to
maintain an appropriate medical record documenting any care that is given. It may also be
prudent to provide a copy of the medical record to the patient’s primary care provider.
Licensees who inappropriately treat themselves, their family members or others with whom they
have a significant emotional relationship should be aware that they may be subject to
disciplinary action by the Board.

I think this is an improvement over previous Position Statement. It clarifies what a Physician
can do and not do. In the past many Physicians have been confused over whether or not they
could handle minor illnesses of their family members. I think there should be a record kept of
these treatments especially if prescriptions of controlled substances are involved.

This revision is an improvement in that there are concrete examples of when it is acceptable for
a licensee to provide care or prescribe for self, family or loved ones. In keeping with the
statement at the close of the position statement pertaining to maintaining the same level of
quality care provided to all patients there should be a record keeping requirement and that such
a record should be forwarded to the primary care provider of the recipient of care. Best to all my
colleagues down there in Raleigh.

inserting the paragraph about the specific examples of exceptions from the new statement after
paragraph #2, and using the last paragraph of the new statement by adding it after the last

include "minor urinary infections" as an example of a minor illness since these can be the first
sign of a major problem, especially in pediatrics. I appreciate being asked for my input.

Thanks for the opportunity to comment. We support the draft position statement on selftreatment and the three rule changes prohibiting the prescribing of controlled substances to

While a tremendous improvement over the original proposed policy, this policy is now without
reason. It is appropriate for someone to diagnose and treat himself or a family member for an
acute event, with unknown or uncertain causation, but not prescribe or refill chronic medications
for himself/herself for chronic maintenance medications where the medical issue is well
documented. And acting as a “Lay person” in giving advice is something that a physician can
actually be claiming to be doing!!??
While potentially foolish, it seems ridiculous to me that an attorney can draw up his/her own
legal documents, but a physician has an ethical reason not to treat or prescribe for
himself/herself. This is not medical ethics. It is enforcement of medical stupidity. And the line
remains unclear based on the current policy.

If the licensee is not going to be available after hours, the licensee must provide clear
instructions to the patient for securing after-hours care. It is the responsibility of the licensee to
ensure that the patient has sufficient information regarding how to secure after-hours care.
The physician must clearly communicate to the patient orally and provide instructions in writing
for securing after hours care if the physician is not generally available after hours or if the
physician discontinues after hours coverage.
It should be noted that these duties are applicable to a licensee whether the licensee is
practicing telemedicine or practicing medicine through traditional means.

CURRENT POSITION STATEMENT:
Sexual exploitation of patients
It is the position of the North Carolina Medical Board that sexual exploitation of a patient is
unprofessional conduct and undermines the public trust in the medical profession. Sexual
exploitation encompasses a wide range of behaviors which have in common the intended
sexual gratification of the physician. These behaviors include sexual intercourse with a patient
(consensual or non-consensual ), touching genitalia with ungloved hands, sexually suggestive
comments, asking patients for a date, inappropriate exploration of the patients or physician’s
sexual phantasias, touching or exposing genitalia, breast, or other parts of the body in ways not
dictated by an appropriate and indicated physical examination, exchanging sexual favors for
services. Sexual exploitation is grounds for the suspension, revocation, or other action against a
physician’s license. This position statement is based upon the Federation of State Medical
Board’s guidelines regarding sexual boundaries.
Sexual misconduct by physicians and other health care practitioners is a form of behavior that
adversely affects the public welfare and harms patients individually and collectively. Physician
sexual misconduct exploits the physician-patient relationship, is a violation of the public trust,
and is often known to cause harm, both mentally and physically, to the patient.
Regardless of whether sexual misconduct is viewed as emanating from an underlying form of
impairment, it is unarguably a violation of the public’s trust.
As with other disciplinary actions taken by the Board, Board action against a medical licensee
for sexual exploitation of a patient is published by the Board, the nature of the offense being
clearly specified. It is also released to the news media, to state and federal government, and to
medical and professional organizations.

REQUEST:
Mr. Brosius,
In response to our telephone conversation today and at the direction of the Chief of the Office of
EMS, I am submitting the following issue asking for an official ruling of the Medical Board. The
Board’s position will be shared with the state’s Emergency Medical Services and Specialty Care
Transport Program Medical Directors.
NC General Statute 143-514 places the practice standards for emergency medical personnel
under the authority of the NC Medical Board. Using these established standards, NC General
Statute 143-508 requires the NC Medical Care Commission to promulgate rules consistent with
the Medical Boards practice standards. These rules are 10A NCAC 13P. In order for a
credentialed paramedic to practice invasive skills, these rules require the paramedic to practice
under the license of the EMS System Medical Director. This Medical Director must be a
licensed physician in North Carolina. Having said this, a situation has presented itself to our
office that we are unable to address. The scenario is:
A physician is on duty in the emergency department of a hospital. A patient arrives that,
following assessment, is determined to have overdosed on an illegal narcotic. This physician
provides emergency care and the patient is stabilized. This physician serves the local EMS
System as their Medical Director. The patient is a paramedic that functions under the license of
this physician. The patient (paramedic) was not on duty when treated by the physician (their
Medical Director) in the Emergency Department.
The dilemma for the physician is twofold. One, he has established a physician / patient
relationship with this individual. Two, this individual is a paramedic that practices under his
medical license. Does the physician have an obligation to maintain the patient’s confidentiality,
or is the physician obligated to report the substance abuse matter to the paramedic’s state
credentialing agency? The physician, in his role as system medical director, thinks his
knowledge that a paramedic practicing under his license may be a potential risk to the public
and those patients under the paramedic’s pre-hospital care. However, ethically the physician
realizes the rights of this patient may override his ability to address this situation.
Although the EMS rules do allow the medical director the authority to suspend, pending due
process review, an individual from practicing under his license, if the medical director exercises
this authority he will be required to disclose his reason for suspension during the paramedic’s
due process hearing. Also, there is nothing in either the EMS laws or rules that mandate a
medical director disclose to the state EMS office his suspension of any person practicing under
his license.
Taking into account the his patient’s rights (the paramedic), the right of the public to be safe, the
rights of the paramedic’s patients, the physician’s liabilities as both caregiver and medical
director, etc., how would the Board advise a physician to handle such a situation?

CURRENT POSITION STATEMENT:
Advertising and publicity*
It is the position of the North Carolina Medical Board that advertising or publicity that is
deceptive, false, or misleading constitutes unprofessional conduct under the Medical Practice
Act.*
The term “advertising” includes oral, written and other types of communication disseminated by
or at the direction of a licensee for the purpose of encouraging or soliciting the use of the
licensee’s services. At issue is whether a member of the general public would be confused or
deceived by the advertising in question. The following general principles are intended to assist
licensees in meeting the Board’s expectations: (1) advertisements should not contain false
claims or misrepresentations of fact, either expressly or by implication; (2) advertisements
should not omit material facts; and (3) licensees should be prepared to substantiate claims
made in advertisements.
Licensees should avoid advertising and publicity that creates unjustified medical expectations,
that are accompanied by deceptive claims, or that imply exclusive or unique skills or remedies.
Similarly, a statement that a licensee has cured or successfully treated a large number of
patients suffering a particular ailment is deceptive if it implies a certainty of results and/or
creates unjustified or misleading expectations. When using patient photographs, they should be
of the licensee’s own patients and demonstrate realistic outcomes. Likewise, when a change of
circumstances renders advertising inaccurate or misleading, the licensee is expected to make
reasonable efforts to correct the advertising within a reasonable time frame.
The advent of the Internet and the proliferation of websites purporting to “rate” healthcare
providers mean that licensees cannot always control information about themselves in the public
domain. However, a licensee is expected to exercise reasonable efforts to bring about the
correction or elimination of false or misleading information when he or she becomes aware of it.
Physicians Advertising Board Certification
The term “board certified” is publicly regarded as evidence of the skill and training of a physician
carrying this designation. Accordingly, in order to avoid misleading or deceptive advertising
concerning board certification, physicians are expected to meet the following guidelines.
No physician should advertise or otherwise hold himself or herself out to the public as being
“board certified” without proof of current certification by a specialty board approved by the (1)
American Board of Medical Specialties (ABMS); (2) the Bureau of Osteopathic Specialists of the
American Osteopathic Association (AOA-BOS); (3) the Royal College of Physicians and
Surgeons of Canada (RCPSC); or (4) a board that meets the following requirements:
i.
the organization requires satisfactory completion of a training program with training,
documentation and clinical requirements similar in scope and complexity to ACGME- or
AOA-approved programs, in the specialty or subspecialty field of medicine in which the
physician seeks certification. Solely experiential or on-the-job training is not sufficient;
ii.
the organization requires all physicians seeking certification to successfully pass a
written or oral examination or both, which tests the applicant’s knowledge and skill in the

specialty or subspecialty area of medicine. All examinations require a psychometric
evaluation for validation;
iii.
the organization requires diplomates to recertify every ten years or less, and the
recertification requires, at a minimum, passage of a written examination;
iv.
the organization prohibits all certification and recertification candidates from attempting
more than three times in three years to pass the examination;
v.
the organization has written by-laws and a code of ethics to guide the practice of its
members and an internal review and control process including budgetary practices to
ensure effective utilization of resources;
vi.
the organization has written proof of a determination by the Internal Revenue Service
that the certifying organization is tax-exempt under Section 501(c) of the Internal
Revenue Code; and
vii.
the organization has a permanent headquarters and staff sufficient to respond to
consumer and regulatory inquiries.
The Board expects aAny physician advertising or otherwise holding himself or herself out to the
public as “board certified” should to disclose in the advertisement the specialty board by which
the physician was certified. A physician is expected to maintain and provide to the Board upon
request evidence of current board certification. In the case of physicians who have been
certified by non-ABMS, non-AOA and non-RCPSC boards, the physician is expected to
maintain and provide to the Board upon request evidence that the certifying board meets the
criteria listed above.
The above limitations are only intended to apply to physicians who advertise or otherwise hold
themselves out to the public as being “board certified.” The above criteria are not applicable in
other instances, such as employment determinations, privileging or credentialing decisions,
membership on insurance panels, or setting reimbursement rates.
*Business letterheads, envelopes, cards, and similar materials are understood to be forms of
advertising and publicity for the purpose of this Position Statement.

(3)(5) A shareholder may authorize the retention of his surname in the corporate name
after his retirement or inactivity because of age or disability, even though he may
have disposed of his stock. The estate of a deceased shareholder may authorize
the retention of the deceased shareholder's surname in the corporate name after
the shareholder's death.
(4)(6) If a living shareholder in a professional corporation whose surname appears in
the corporate name becomes a "disqualified person" as defined in the
Professional Corporation Act, the name of the professional corporation shall be
promptly changed to eliminate the name of the shareholder, and the shareholder
shall promptly dispose of his stock in the corporation.

Director of Finance/Operations/Human Resources of the Board to sign certifying
that at least one of the incorporators and each of the persons named as original

qualified to own shares pursuant to N.C.G.S. 55B-6, 55B-14(c) or 55B-16.

to display on the face of all professional corporation stock certificates a legend
that any stock transfers are subject to the provisions of the Professional
Corporations Act and the Rules of the Board shall be a violation of N.C.G.S. 9014(a).

All shareholders must be licensed to practice medicine in North Carolina.
