NEWBALD PARISH COUNCIL 3 JANUARY 2007 NEWBALD PARISH COUNCIL MINUTES OF THE MEETING HELD AT NEWBALD VILLAGE SCHOOL ON 3 JANUARY 2007 Present – Councillors Bolton (Chairman), Hildyard (Vice-Chairman), Baker, Barrett, Jackson, Lownsborough, Shepherd & Wild; Pollard (ERYC) Apologies – Councillors Richards & Waite; PCSO Jo Finon (Humberside Police) 1 PUBLIC FORUM Mr Stachan, Ings Drive attended the meeting to express his concern that livestock from the Prattwood land were escaping into his garden scavenging for food. Members advised Mr Stachan that this was a Trustee matter and his complaint would be forwarded onto them to deal with. 2 DECLARATIONS OF INTEREST None received 3 MINUTES OF THE LAST MEETING Resolved – That the minutes of the meting held on 4 December 2006 were approved and signed as a correct record 4 MATTERS ARISING 4.1 Commuted Sums – Members asked for clarification on eh payment of Commuted Sums. The Clerk reported that Commuted Sums remained with ERYC in an interest bearing account until such time as a scheme was presented for consideration. 4.2 Hotham Lake – Members requested the current status of the Hotham Lake application. The Clerk advised that the application was scheduled to be presented to the Planning Committee sometime in February 5 ERYC COUNCILLORS REPORT 5.1 Spring Lane – Councillor Pollard reported that she had made little progress with Highways on addressing the unauthorised installation of a drain – Highways Legal Officers were minded not to pursue the case. Members were appalled by such inactivity given the evidence that the unauthorised drain was connected to the main connector drain and was clearly in breach of s50 Roads & Streetworks Act. 5.2 Stoneledge Quarry – Councillor Pollard advised that she had not yet been made aware of a Liaison Meeting, but advised that Strategic Planning Officers had written to Stoneledge requesting a meeting. 6 ALLOTMENT ALLOCATION The Clerk reported that there was no provision in any live Allotment Act to restrict the number of allotments by any one individual. In accordance with such legislation the vacant plots had been advertised and at the closure of the advertisement notice only one letter of interest had been received. Both Councillors Baker & Jackson advised that they had been contacted by 722 Councillor Shepherd to pursue the matter with Richard Alderson Progress to be reported to the next meeting NEWBALD PARISH COUNCIL 3 JANUARY 2007 residents of the village who wished to garden a plot. Resolved – That the three plots be offered to Mr Levitt (via the Clerk), Mr Williams (via Councillor Baker) & Mrs O’Sullivan (via Councillor Jackson). 7 COMMUNITY SAFETY MATTERS None reported 8 HIGHWAYS MATTERS 8.1 Back Lane – It was reported that a resident of South Newbald Road had installed a gate, which accessed Back Lane from his premises. Members believed this to be a long established access and the resident was tidying his residential boundary. Members asked that should he be using Spring Lane during his house development stage, he make good the surface of the Lane. Councillor Bolton to contact the resident 8.2 Drain Spring Lane – It was reported that Highways were reluctant to pursue the restoration of the lane following the unauthorised installation of a drain Councillor Shepherd to request a site visit 8.3 Burgate Grass Verge– It was reported that a resident of Burgate had requested improvements to the grass verge along Burgate to facilitate the delivery of medical supplies and reduce the burden on the resident due to the need to tidy up following poor grass cutting by the Grounds Maintenance unit. The area had been inspected and a plan of works, which has been approved by the resident, would be completed during the Parish Streetscene Improvements scheduled for Spring 2007. Clerk to ascertain length of works and date for Streetscene works 8.4 Flooding – Members reported flooding in the following areas: South Newbald Road between Elm Tree House and the Old Forge Beverley Road near to the Yorkshire Water station Clerk to contact Environmental Service to request gully cleaning 8.5 Flashing Signs – Members reported that the flashing signs did not always work when cars travelled past exceeding the 30mph speed limit. Clerk to contact ERYC to inspect the signs 9 PRATTWOOD Those members who were Trustees of the Prattwood Charity requested guidance from the Parish Council on a number of issues: 9.1 An Ash Tree on the southern boundary of the site had become diseased and required the removal of limbs at a cost of £200 +VAT 9.2 Current Rental position – There remained confusion regarding the tenancy of the land following the death of the previous tenant. They reported that a payment had been received but they were uncertain from whom. The Clerk reported that she had received a request from Mr R Hatfield to take over the tenancy from his late father and advised him by letter that it was a matter for the trustees to consider. 9.3 Husbandry – The Trustees had been aware of the husbandry arrangements of the tenant following complaints that livestock were straying from the land scavenging for food Resolved – That (i) In the interests of public safety the Parish Council arrange for the removal of diseased limbs 723 NEWBALD PARISH COUNCIL (ii) 3 JANUARY 2007 The Trustees resolve the current dispute regarding transfer of tenancy The Trustees talk to the owner of the livestock regarding husbandry arrangements. The Strategic Development Service Manager had requested Steve Dunn to contact the applicant to pursue the setting up of a Liaison Meeting.
