VIBE FM hosts “ The Joey Ebanks Show” on Mondays from 5:00 to 6:00 p.m. and Tuesdays to Fridays from 5:00 to 7:00 p.m. and has been doing so since April 2nd, 2013. The content of “The Joey Ebanks Show” is in my view libelous, slanderous, abusive, annoying and harassing to several members of the public including myself. Attached is some of the evidence from the show that has been placed on Facebook. In contacting Vibe to request a taped copy of the show, my PR contact was advised that the show's recordings are available on YouTube. I therefore invite you as Managing Director to use your legislated authority to obtain copies of all “The Joey Ebanks Show” as evidence to review when addressing this complaint. I believe that the content of “The Joey Ebanks Show” violated several sections of the Information & Communications Technology Authority Law ( 2011 revision) and that it also breaches conditions of the licence granted to VIBE FM by the Authority. Specifically, I refer to Part 111 - Compliance with Laws and specifically to section 151.of the license issued to VIBE FM by the Authority. I also draw your attention to section 90 of the Information & Communications Technology Authority Law (2011 Revision) and I have by letter (copy attached) made a formal complaint to the Royal Cayman Islands Police Service that my family and I have been slandered, abused, annoyed, threatened and harassed by Joey Ebanks on “The Joey Ebanks Show” on several of the broadcast if not each and every show. I am therefore with this letter seeking the intervention of the Information & Communications Authority in accordance with its enabling legislation and in particular section 32 (1) a. -- to suspend the license for VIBE FM to prevent further violation of the Law by “The Joey Ebanks Show” on VIBE FM. I have also by letter ( copy attached) sought the immediate intervention of the Governor in accordance with section 32 (2). I believe that the contents of “The Joey Ebanks Show”, which has been consistently attacking and criticizing the Commissioner of the Royal Cayman Islands Police Service, yourself as the Governor and other public figures, and his distribution of the show through Facebook and YouTube constitute a threat to the security of the Cayman Islands both internally and externally. These actions are compounded by the fact that they are politically motivated and do carry extra political clout in that he is a duly nominated political candidate in the elections to be held on May 22nd, 2013. VIBE FM has posted the contents of the show on YouTube and excerpts also appear to be available on Joey Ebanks' Facebook page. I have attached copies of some material from Facebook. Ebanks has a radio show on VIBE FM that is broadcast on Mondays from 5:00 to 6:00 p.m. and Tuesdays to Fridays from 5:00 to 7:00 p.m. The show has been aired since April 2nd, 2013. Joseph Ebanks, on this show, continues to break provisions of the Information & Communications Technology Authority Law (2011 Revision) in particular section 90 which reads; “Section 90 (1): A person who knowingly uses an ICT network or ICT services to defraud, abuse, annoy, threaten or harass any other person is guilty of an offense and liable, on summary conviction to a fine of ten thousand dollars and to imprisonment for one year, or, on conviction on indictment to a fine of twenty thousand dollars and to imprisonment for two years. (2) In addition to imposing any penalty under subsection (1), the court may by order , restrain the person from using ICT services or ICT networks as it sees fit.” I believe that the contents of “The Joey Ebanks Show”, in particular comments about other candidates in this election, including myself and comments about senior officials and members of the general public are in breach of section 90 of the Information & Communications Technology Authority Law (2011 Revision) and therefore places the show in conflict and breach of the Elections Law (2009 Revision) Part IV - Political Broadcast and in particular section 75. It should be noted that based on the contents of this show and his comments about other candidates and public officials some individuals have been prompted to contemplate legal action against him for libel and slander. I also have to report that information coming to my attention indicate that Mr. Joseph F. Ebanks, candidate for the Electoral District of North Side, may be in breach of sections 95, 96 and 97 of the Elections Law (2009 Revision) as he has been seen delivering appliances to an area of North Side called “Queldo Square” on Tideman Street next to the Police Station in North Side. This action took place on Tuesday 2nd, and Wednesday 3rd, April 2013 and should be recorded on the cameras located next to Chisholm Store. I am therefore requesting that your office investigate these complaints and determine what action should be taken by the Elections Office, the Anti-Corruption Commission and the police.
