BOARDING CONTRACT For Heavenly Acres This contract is made between (HORSE BOARDER) ____________________________ and Nancy and Eugene Janssens (HEAVENLY ACRES’ OWNERS) on this ______ Day of ____________________ 20___. Contract changes by HEAVENLY ACRES’ OWNERS, and adding or removing of horses by horse boarder require 2 weeks written notice, unless arranged otherwise with HEAVENLY ACRES’ OWNERS. For new boarders or new horses coming in, there will be a 30 day trial period in which HEAVENLY ACRES’ OWNERS or HORSE BOARDER may terminate this contract requiring HORSE BOARDER to remove that horse or all of his/her horses with a 24 hour notice. All fees and expenses must be paid before horses can be removed from premises. ($254.25) per horse per month. Indoor board is $330.00 + H.S.T. ($372.90) per horse per month. Payment will be due on the first day of each month. Late payments are subject to late fees of $1.00 per day per horse. All fees and expenses must be paid before horse(s) can be removed from premises. Access and use of round pen, outdoor ring, and indoor arena. (This access can be limited by HEAVENLY ACRES’ OWNERS due to lessons or other ongoing circumstances). A schedule of lessons and special events will be posted for boarders to see. 6. Tack Room access and use. 7. Trail access (Out of bounds during hunting season). 8. Blanketing of horse(s) when necessary. * The amount of feed provided is dependent on the needs of the individual horse. This amount will be decided on between the HORSE BOARDER and HEAVENLY ACRES’ OWNERS. All special diets and/or supplements required by horse will be at boarders’ expense. All copies of medical records provided will be kept on file by HEAVENLY ACRES’ OWNERS. Deworming, farrier and vet checks are responsibility of the HORSE BOARDER and must be kept current and recorded on file. The HORSE BOARDER must make, and be present for all appointments unless arranged otherwise with HEAVENLY ACRES’ OWNERS. All veterinarian charges, medical supplies, and farrier fees are at HORSE BOARDERS’ expense. Signature of Horse Boarder ______________________________________ Page 2 EMERGENCY CARE In emergency situations, HEAVENLY ACRES’ OWNERS are authorized to proceed with treatment and/or call in a veterinarian of HEAVENLY ACRES’ OWNERS choice if HORSE BOARDER’S vet cannot be reached. HEAVENLY ACRES’ OWNERS agree to attempt to contact horse boarder, at the following emergency telephone number (________________), should HEAVENLY ACRES’ OWNERS feel that medical treatment is needed for said horse(s), provided however, that in the event that HEAVENLY ACRES’ OWNERS are unable to so contact HORSE BOARDER within a reasonable time, which time shall be judged and determined solely by HEAVENLY ACRES’ OWNERS, HEAVENLY ACRES’ OWNERS are then hereby authorized to secure emergency veterinary care and/or farrier care by any licensed providers of such care who are selected by HEAVENLY ACRES’ OWNERS, as HEAVENLY ACRES’ OWNERS determine is required for the health and well-being of said horse(s). The cost of such care secured shall be due and payable by the HORSE BOARDER within fifteen days from the date HORSEBOARDER receives notice thereof, provided however, that HEAVENLY ACRES’ OWNERS are authorized to arrange direct billing by said care provider to the HORSE BOARDER. Boarders will not be allowed to move other people’s horses without the consent of the horses’ owners and HEAVENLY ACRES’ OWNERS and/or employees. HEAVENLY ACRES’ OWNERS and/or employees are authorized to provide reasonable discipline for horse(s) as needed. HEAVENLY ACRES’ OWNERS are not responsible for death or injuries of horses, boarders or guests. HEAVENLY ACRES’ OWNERS are not responsible for lost, damaged or misplaced tack & equipment. Due to the fact that other boarders’ things are here and are not the property of Heavenly Acres, please do not use or abuse anything that is not yours unless given permission. The HORSE BOARDER agrees that he/she and his/her guests and invitees will be bound and abide by these Rules, and accepts responsibility for the conduct of his guests and invitees according to these Rules. The HORSE BOARDER acknowledges the Rules included but not limited to: *Every rider MUST sign a waiver form PRIOR to riding any horse on Heavenly Acres premises. *Smoking is NOT permitted on Heavenly Acres premises. *Dogs are NOT permitted on Heavenly Acres premises. *Children under 12 MUST have adult supervision at all times. *A certified (ASTM) and well fitted HORSEBACK RIDING HELMET MUST be worn at all times and by every rider while on horseback. This is mandatory for children under 19 years of age. Any adult declining to wear a riding helmet is doing so at his/her own risk, and understands the risks and danger associated with such a practice and must sign and initial the Assumption of Risks, Release of Interest, Waiver of Claim, and Indemnity Agreement. HEAVENLY ACRES’ OWNERS will NOT be held responsible for any injury or death incurred while riding without a helmet. * Proper riding footwear must be worn when on horseback. * Horses being lead out of their paddock must have a lead line attached to their halter. * Only one horse is being lead at the time. * Gates are to be closed at all times. * Feeding (including treats) or handling of someone else’s horse without permission is not permitted. * The HORSE BOARDER is responsible for cleaning up after themself and their horse(s). (If horse manure happens, it is yours!) * No alcohol or drugs permitted on Heavenly Acres premises. * Anybody who displays inappropriate or dangerous behaviour or is suspected of being under the influence of alcohol or drugs will be asked to leave the premises immediately. HEAVENLY ACRES’ OWNERS reserve the right to call law enforcement forces if necessary. * Absolutely NO abuse will be tolerated. HEAVENLY ACRES’ OWNERS are not responsible for death or injuries of horses, boarders or guests. HEAVENLY ACRES’ OWNERS are not responsible for lost, damaged or misplaced tack & equipment. Due to the fact that other boarders’ things are here and are not the property of Heavenly Acres, please do not use or abuse anything that is not yours unless given permission.
