(DAY CHARTER TERMS & CONDITIONS)
1. A 50% deposit is required to secure a booking made more than 7 days from charter date.
2. Payment in full is required 14 days prior to the booking date.
3. Where a booking is made within 7 days payment in full is required to secure the booking.
4. Your charter start time and finish time entitles you to use of the vessel for the specified time. Where
departure is delayed your return time will not be extended.
5. Extension of time incurs an additional hourly fee of $400. An extension of time is at the discretion of
the skipper/management and subject to availability.
6. The Ocean Dynamics skipper mastering your vessel will determine a safe and pleasurable
destination/anchorage on the day of charter dependant on weather conditions. Ocean Dynamics
can not guarantee a requested/preferred destination will be possible on any given day.
7. In the instance of extreme weather predictions Ocean Dynamics will cancel any charters for the
safety of its guests and crew. Should this occur Ocean Dynamics will endeavour to provide an
alternative charter date or where an alternative charter date is not available provide a full refund.
8. Cancellations made less than 30 days prior will incur a 25% administration fee calculated on the full
charter price and 14 days prior will incur a 50% cancellation fee.
9. Cancellation made less than 48 hours prior will incur full fee. Refunds will not be provided.
10. Charter prices include a fuel limit for a set itinerary determined by the skipper on the day. Any
variations that use in excess of the fuel limit will incur a fuel surcharge that is payable at the
completion of the charter.
11. Ocean Dynamics crew can serve guests food and beverages on board a vessel. Ocean Dynamics
crew are not permitted to serve food or beverages ashore.
12. Smoking is not permitted on board vessels.
13. Guests must abide by any direction given by the skipper and crew for safety reasons.
14. Ocean Dynamics Charter Pty Ltd may provide recreational and other equipment on the Vessel (e.g.
fishing equipment, snorkelling equipment and the like). You acknowledge that if you choose to use
such equipment, you do so at your risk;
15. By providing snorkelling equipment, Ocean Dynamics Charter Pty Ltd is not conducting recreational
snorkelling for the purposes of the Workplace Health and Safety Regulation 1997.
16. Guests must use the Vessel, its facilities, fixtures, fittings and furnishings and all equipment including
recreational equipment with reasonable care. You are responsible for the cost of:
(a) making good any damage to the Vessel or to its facilities, fixtures, fittings, furnishings and
equipment caused or contributed to by You or your invitees/guests;
(b) replacing items which have been damaged and which are not economically able to be repaired,
including replacing items of recreational equipment which are lost or damaged by You or your
invitees/guests; and
(c) excessive or abnormal cleaning of the vessel occasioned by want of care, arising out of guests
use of the vessel, its facilities etc.

wish for myself (and my group) to participate in a luxury boat charter aboard Ocean ______, which may
include any of the following activities:
Snorkelling
Tender trip
Scuba diving
Shore excursions
Fishing
as arranged and conducted by Ocean Dynamics Charter Pty Ltd.
As consideration for Ocean Dynamics Charter Pty Ltd providing these activities, I/we agree to pay the
applicable charges and to be bound by the following terms and conditions.
1) I acknowledge that these activities involve physical risks, which could result in injury or death, and
confirm that I am engaging in these activities at my own risk absolutely.
2) I warrant that:
a) I am in a good state of health;
b) I am not receiving any medication or taking any drug that may be affected by participation in these
activities or may affect or interfere with my ability to engage in them: and
c) I am free from any injury, medical condition, disability, disease or illness that may be aggravated by
participation in these activities and may affect or interfere with my ability to engage in them.
3) I will at all times comply with any direction whatsoever given to me by Ocean Dynamics Charter Pty Ltd
relating to my participation in these activities including minimum age requirements as requested by staff.
4) Ocean Dynamics Charter Pty Ltd shall not be liable to me for any damage (including death, personal
injury or loss of any nature whatsoever including pecuniary loss as a result of personal injuries) that may
occur during or incidental to or as a consequence of my engaging in one of these activities. Further, I
agree to indemnify Ocean Dynamics Charter Pty Ltd against the claims of others for any such damage.
5) Ocean Dynamics Charter Pty Ltd shall include its servant’s agents, independent contractors,
concessionaires, sub-contractors, licensees or other officers who from time to time may be employed,
licensed or directed by Ocean Dynamics Charter Pty Ltd.
6) This agreement is to be constructed and take effect in accordance with the laws of Queensland.
7) I agree that this document constitutes the entire agreement between myself and Ocean Dynamics
Charter Pty Ltd and that any terms or representations made prior to the signing of this document shall be
void and of no effect.
8) In the event any part of this agreement is found to be invalid or unenforceable, that invalid or
unenforceable part shall be severed from the agreement and the balance shall be of full force and effect.
