Ariz. ruling on return of seized marijuana

PHOENIX (AP) — The Arizona Supreme Court is letting stand a lower court's
ruling that the Yuma County sheriff must return marijuana seized from a woman
with a California medical marijuana authorization honored by Arizona. The justices
without comment on Monday declined to review a January ruling by the Court of
Appeals.
The January ruling said medical marijuana seized from Valerie Okun must be returned to
her. It said that's because Arizona's medical marijuana law allows people with medical
marijuana authorizations from other states to legally possess marijuana in Arizona.
The marijuana was found in Okun's vehicle at a Border Patrol checkpoint near Yuma.
State drug charges against her were dismissed after she showed she had authorization
under California's medical marijuana program. Prosecutors argued that federal drug law

Physician wants change in med pot law
for research purposes
PHOENIX -- A University of Arizona physician has taken the first political steps in
her bid to do medical marijuana research at state-run schools. Sue Sisley, a
specialist in internal medicine and psychiatry, has formed Americans for Scientific
Freedom, which she will chair. The filing with the Secretary of State's Office will
allow her to collect donations for political purposes. But Sisley told Capitol Media
Services the committee is not designed to elect legislators who support research or
defeat those who oppose it. Instead, she wants to lobby lawmakers to change the law
to let her do her work at the UA. Potentially more significant, she also is looking at
changes to the law to let the state health department fund medical marijuana research.
Legislation approved last year was designed to close what some lawmakers saw as a
loophole in the state's 2010 medical marijuana law. That initiative allows those with a
doctor's recommendation to possess and use up to 2 1/2 ounces of marijuana every two
weeks. While the measure banned the drug on public school campuses, it was silent on

Arizona has a MEDICAL MARIJUANA
(cannabis) LAW.
SUMMARY: Just over 50 percent of voters (50.13 percent) approved Proposition
203 on November 2, 2010. The law removes state-level criminal penalties on the use
and possession of marijuana by patients who have "written cerification" from their
physician that marijuana may alleviate his or her condition. Allows registered
qualifying patients (who must have a physician's written certification that they have been
diagnosed with a debilitating condition and that they would likely receive benefit from
marijuana) to obtain marijuana from a registered nonprofit dispensary, and to possess and
use medical marijuana to treat the condition.
Requires the Arizona Department of Health Services to establish a registration and
renewal application system for patients and nonprofit dispensaries. Requires a webbased verification system for law enforcement and dispensaries to verify registry
identification cards. Allows certification of a number of dispensaries not to exceed
10% of the number of pharmacies in the state (which would cap the number of
dispensaries around 124). Specifies that a registered patient's use of medical marijuana
is to be considered equivalent to the use of any other medication under the direction of a
physician and does not disqualify a patient from medical care, including organ
transplants.
Specifies that employers may not discriminate against registered patients unless that
employer would lose money or licensing under federal law. Employers also may not
penalize registered patients solely for testing positive for marijuana in drug tests,
although the law does not authorize patients to use, possess, or be impaired by
marijuana on the employment premises or during the hours of employment.
Approved Conditions: Patients diagnosed with the following illnesses are afforded
legal protection under this act: Cancer, glaucoma, HIV/AIDS, Hepatitis C, ALS,
Crohn's disease, Alzheimer's disease, cachexia or wasting syndrome, severe and
chronic pain, severe nausea, seizures (including epilepsy), severe or persistent
muscle spasms (including multiple sclerosis). Other conditions will be subject to
approval by the Arizona Department of Health Services.
Possession/Cultivation: Qualified patients or their registered designated caregivers
may obtain up to 2.5 ounces of marijuana in a 14-day period from a registered
nonprofit medical marijuana dispensary. 2: If the patient lives more than 25 miles
from the nearest dispensary, the patient or caregiver may cultivate up to 12 marijuana
plants in an enclosed, locked facility.

Jan Brewer on May 7, 2013 "Specifies the prohibition to possess or use marijuana
on a postsecondary educational institution campus does not apply to medical
research projects involving marijuana that are conducted on the campus, as
authorized by applicable federal approvals and on approval of the applicable

MB) for regulating medical marijuana and set the application dates for May 14

'requests to cultivate' among new cardholders in most of the metro area… because selfgrow (12 plants) is only allowed when the patient lives more than 25 miles from the
nearest dispensary. The vast majority of the Valley is within 25 miles of this new

Patients Out of Time is a patient advocacy organization with a universal
constituency. They support the rights of patients to have a legal and safe access to
the therapeutic use of cannabis. The mission of their organization, a 501 (c) 3 non-
profit, is the education of health care professionals and the public about the therapeutic

Despite continued opposition, Arizona dispensaries open for business - Last
Update: October 29, 2013 | Arizona Attorney General Tom Horne and other highprofile opponents of medical marijuana are still fighting against the will of voters,
but Arizona's medical marijuana program has made great progress since August
2012, when 98 registration certificates were awarded. The first state-licensed
dispensary opened in December 2012, and as of mid-October 2013, there are 70
disepensaries open and serving patients. Horne and Maricopa County Attorney Bill
Montgomery tried to convince a judge to shut down the program, but to no avail. In
December 2012, Maricopa County Superior Court Judge Michael Gordon rejected Horne
and Montgomery’s arguments and refused to declare Arizona’s law invalid. Visit http://www.mpp.org/states/arizona/ Horne and Montgomery aren’t the only officials who are out of touch with voters.
Rep. John Kavanagh (R-Fountain Hills) filed a resolution in 2013 that would have
referred the Arizona Medical Marijuana Act back to the ballot in November 2014.
Fortunately, Rep. Kavanagh’s resolution did not gain support, thanks in part to a
poll conducted by Public Policy Polling in January 2013 that found that 59% of
Arizona voters support the Arizona Medical Marijuana Act. Other bills that would
have chipped away at the program were defeated by the Arizona Legislature in 2013,
including a bill that would have forced onerous labeling requirements on dispensaries and
another that would have allowed law enforcement officers to seize medical marijuana
from patients without having to return it.
Despite these challenges, the program has taken major steps forward since Prop
203, MPP’s ballot initiative, passed in November 2010. The Department of Health
Services has been issuing ID cards to patients since early 2011, and patients’ access
to medical marijuana will continue to improve with the opening of each new
dispensary. 2011 legislature weakens Prop 203 | Sadly, the Arizona Legislature slightly
rolled back Prop 203’s protections with legislation in both 2011 and 2012, despite the
state’s Voter Protection Act, which was designed to prevent legislative meddling. Visit http://www.mpp.org/states/arizona/ Most recently, the legislature passed and Gov. Brewer signed H.B. 2349, a bill
banning medical marijuana on the campuses of all colleges and vocational schools in
the state. Medical marijuana advocates predict the law will be deemed
unconstitutional if challenged in court. In 2011, the legislature passed and Gov. Brewer
signed H.B. 2541, which will possibly allow an employer to fire a medical marijuana
patient based on a report alleging workplace impairment from a colleague who is
“believed to be reliable.” It will also seemingly allow termination based on a positive
drug test, which contradicts Prop 203’s explicit language protecting patients from
termination without proof of workplace impairment or possession.
Also in 2011, the legislature passed and Gov. Brewer signed H.B. 2585, which
contradicts Prop 203 by adding confidential medical marijuana patient data to the
prescription drug monitoring program, where it will be subject to “fishing

For example, the penalty for possession of just one ounce of marijuana can be a felony
that carries a potential penalty of 18 months in jail and a $150,000 fine! A 2013 report by
the American Civil Liberties Union found that over 55% of drug arrests in Arizona are
for marijuana possession, and that blacks are 2.4 times more likely to be arrested for
marijuana possession than whites.
Also, in 2009, Arizona passed H.B. 2013, which requires drug testing for public
assistance recipients if there is “reasonable cause.” All adult recipients must answer
three questions during the application process and must complete a drug test within
10 days, if any of the answers provide “reasonable cause” of illegal substance use or if
referred by law enforcement or another agency. Recipients who test positive will be

65% of Arizona voters support removing criminal penalties for the medical use of
marijuana, according to a February 2009 poll. And voters have already passed
medical marijuana initiatives twice in the state, in 1996 and 1998. Unfortunately,
due to a technical error in the wording of these laws, they have failed to effectively
protect medical marijuana patients from arrest. The initiative that will go before
voters in 2010 will close this loophole and give patients the protection and peace of mind
that Arizonans agree they deserve.
The Arizona Medical Marijuana Policy Project (AMMPP) is a grassroots
organization devoted to passing a medical marijuana initiative in Arizona in
November 2010. Currently, seriously ill people who use marijuana on the advice of
their doctor to treat illnesses such as cancer, AIDS, and multiple sclerosis are
subject to arrest and imprisonment, simply for trying to stimulate their appetite or
alleviate their pain. We can change this. On November 2, 2010, Arizona voters could
have a chance to vote to protect Arizona’s medical marijuana patients from arrest and
jail. But voters will not have that chance unless we collect more than 150,000 valid

SUMMARY: Sixty-five percent of voters approved Proposition 200 on November
5, 1996, which included several provisions regarding prison reform and one specific
to the use of medical marijuana. The law took effect on December 6, 1996. It
mandates alternative sentencing for non-violent drug offenders, and seeks to establish
legal protections for seriously ill patients by allowing doctors to "prescribe" schedule I
controlled substances such as marijuana. However, because federal law ultimately forbids
physicians from prescribing such drugs, this statute does not adequately protect patients
from state-level criminal penalties, as do similar state laws that only require patients to
possess a physician’s "recommendation" that medical marijuana therapy may be
beneficial. Not surprisingly, the attorney general’s office reports that state physicians are
not advocating medical marijuana therapy to their patients under the law. Click here

So, while a majority of Arizona voters have passed ballot measures enacting
legislation to allow the use of medica marijuana, the laws do not adequately protect
patients nor Doctors who would prescribe it. The legislation as it is currently enacted
requires Doctors to write a prescription for medical marijuana to their patients. Since
marijuana is still classified as a Schedule 1 drug, the FDA effectively forbids Doctors
from doing so. Subsequent ballot initiatives to correct the legislation have thus far failed.

former presidents Gerald Ford, Jimmy Carter, and George Bush signed a letter
