CONTRACT OF GUARANTEE FOR COMPENSATION By means of this document Contract of Guarantee for Compensation, the Contract signed by **Global Partner**, address at **location** officially represented by ** Global Partner Representative Name and ID Number** (hereafter the GRANTING ORGANIZATION), the recipient; **Steward Candidate Name and ID Number** address at **Steward Address** and, the GUARANTOR; **GUARANTOR Name and ID number** and address at **GUARANTOR Address** , all the clauses of the issued contract described below shall be considered in agreement: FIRST.- BACKGROUNDS 1.1. The beneficiary is the **Global Partner Name and Description** an Institution promoting and conducting “Practical Training Programs in Organic Agriculture” in farms along the USA through a scholarship program designed for farmers and young agrarian professionals committed to the development of Sustainable Agriculture. 1.2. The grantee is the Steward, an individual who had received the scholarship in order to participate with the Training Program, according the projects established by the GRANTING ORGANIZATION. 1.3. The GUARANTOR is a person of marital ties or of blood relation to the Steward and who guarantees compensation in case that the Steward violates the present contract. SECOND.- PURPOSE In agreement with the three parts, by this act, the GUARANTOR guarantees compensation to the GRANTING ORGANIZATION estimated at **Amount (ex: fifteen thousand US dollars **$15000.00)**, demanded, executed and charged when the Steward performs any action that violate Program agreements, his/her standing as a steward, and violates the present document. THIRD.- VIOLATIONS OF THE TRAINING PROGRAM In order to execute the guarantee described in the second clause, we consider the follow actions a violation of the contract: 3.1. Perform activities against the established program and/or without the authorization of the GRANTING ORGANIZATION or their USA partner MESA during the Training Program in the USA. 3.2. For reasons not due to outside factors beyond his/her control (failure of MESA/GRANTING ORGANIZATION, illness, etc), conclude his/her program earlier than the agreed date. 3.3. Make false claims in order to conclude his/her program earlier than the agreed date. Official documents (e.g. medical report) will be required for any extenuating circumstances to prove that the presented claims are true. 3.4. Perform activities against the laws of the United Status of America (robbery, sell or consume drugs, drive under alcohol effects, fight in public places, etc). 3.5. Be absent from his/her training activities without a valid justification or agreement of his/her Host. 3.6. Use his/her status as a Trainee to obtain benefits through illegal activities such as, smuggling, traffic of illegal substances, illegal immigration (stay in USA without authorization or a valid VISA), etc. 3.7. Any other action that the GRANTING ORGANIZATION considers to be a violation of the terms of the Program and the present document. FOURTH.- TERMS OF PAYMENT/ GUARANTEE COMPENSATION 4.1. If any of the above clauses established in section three of the present document is violated, THE GRANTING ORGANIZATION will communicate the conditions for payment procedure to the GUARANTOR (via legal letters, email or phone call), 4.2. The GUARANTOR will pay the guaranteed compensation through deposit at THE GRANTING ORGANIZATION’s bank account established in clause 4.1. In the event that payment is made is cash, the GUARANTOR may deliver payment to the address of THE GRANTING ORGANIZATION. 1 4.3. The GUARANTOR has a three (3) day time limit to accomplish the payment of the compensation guarantee. After this, THE GRANTING ORGANIZATION may take legal action to request the payment of this guarantee which may include the retention of property for sale. The GRANTING ORGANIZATION may also take legal actions against the GUARANTOR and the Steward if deemed necessary. 4.4. After the deadline of three (3) calendar days as described in clause 4.3, every extra day will accrue a penalty charge of fifty soles per day (S/. 50.00). FIFTH.- SECURITIES 5.1. On the due date of the issued agreement, the GUARANTOR must sign and return the legal contract to the GRANTING ORGANIZATION, authorizing them to execute whenever they consider necessary. This document loses validity when the Steward finishes his/her program, returns to Peru, and receives authorization from the legal representative of THE GRANTING ORGANIZATION, as named at the top of this document. 5.2. This document is only valid during the Training period of the Steward’s Program. There is no option of renewal after this period. SIXTH.- DEFAULT RULES All actions not stipulated in the present contract will be governed by laws established by the **Laws of Granting Organization Country** and any other appropriate authorities. SEVENTH.- JURISDICTION Under any discordance in the execution or interpretation of the present contract, all persons involved agree to subject to the local courts. **City, Country**, **Date** GUARANTOR REPRESENTATIVE of the GRANTING ORGANIZATION STEWARD 2
