ON THE ___ day of ________, 200__, there was filed a Petition alleging the
child committed a delinquent act(s).
That the Court finds that in order to expedite
discovery and settlement negotiations, an order for pre-trial discovery should be made.
IT IS THEREFORE ORDERED that the State shall provide to child’s counsel
with the petition, summons, and notice, if in the State’s possession, copies of the
following:
[1] Any relevant written or recorded statement made by the child and the
substance of any oral statement made by the child which the state intends to offer into
evidence;
[2] Any relevant written or recorded statement made by any co-defendant of the
child and the substance of any oral statement made by the co-defendant of the child
which the state intends to offer into evidence;
[3] Books, papers, documents, statements, photographs or tangible objects which
the state intends to offer into evidence;
[4] Results or reports of physical or mental examinations or scientific tests or
experiments made in connection with the case; and
[5] Written reports of law enforcement concerning the child and the case and
statements of the victim or witnesses to the alleged offense.
IT IS FURTHER ORDERED that the child’s counsel shall provide reciprocal
discovery to the State by providing to the County Attorney, if in counsel’s possession,
copies of the following:
[A] Books, papers, documents, statements, photographs or tangible objects which
are not privileged and which the child intends to offer into evidence; and
[B] Results or reports of physical or mental examinations or scientific tests or
experiments made in connection with the case.
Clerk to provide a copy of this order to child, parents, counsel of record, and JCS.
