THE GREAT LIBYAN JAMAHIRIYA The General Popular Committee Decree of the General Popular Committee No 253 of 2005 Regarding the Creation of the National Commission for International Humanitarian Law The General Popular Committee, Having reviewed Law No 1 of 1369 regarding popular conferences and popular committees and its executive regulation; the Great Green Document for Human Rights in the Era of the Jamahiriya; Law No 20 of 1991 regarding the enhancement of freedom; the Law on Financial Regulations of the State Law No 11 of 1425 regarding the restructuring of popular control and its amendments; And based on memorandum No 595 of 25/11/2005 of the Secretary of the General Popular Committee for External Communication and International Cooperation Decided Article (1) A commission named "National Commission for International Humanitarian Law" shall be created and shall have its main headquarters and legal center in the city of Tripoli. The Commission may establish branches in all parts of the Great Jamahiriya, with the approval of the Secretariat of the General Popular Committee. Article (2) The Commission shall be composed of the following: 12345- Secretary of the General Popular Committee for Justice (President) Representative of the Secretariat of the General Popular Committee (member) Representative of the General Provisional Committee for Defense (member) Representative of the General Popular Committee for Justice (member) Representative of the General Popular Committee for External Communication and International Cooperation (member) 6- Representative of the General Popular Committee for Public Security (member) 7- Representative of the General Popular Committee for Higher Education (member) 8- Representative of the General Popular Committee for Culture (member) 9- Representative of the National Center for Educational Planning (member) 10- Representative of the General Authority for Planning Health Care (member) 11- Representative of the General Institution for Popular Information (member) 12- Secretary General of the Libyan Red Crescent Society (member) 13- Representative of the Foundation Ghaddafi for Charitable Associations (member) 14- Representative of the General Bar Association (member) 15- Nine figures with expertise in international humanitarian law to be selected by the President (member) The competent secretary or his deputy shall issue a resolution to designate representatives of general bodies. Article (3) The Commission shall be competent to: 1- Set strategies, plans, and executive programs in the sphere of implementation of IHL in coordination with competent bodies; 2- Study IHL conventions; prepare the necessary legislative proposals to adapt national legislation with provisions of these conventions; undertake academic researches and studies to develop IHL; 3- Prepare and execute plans and training programs to raise awareness of and train on IHL; 4- Suggest agreements with counterpart bodies, regional and international, to cooperate and exchange expertise, visits, and information on the implementation of IHL; 5- organize national, regional and international seminars and forums to introduce IHL and means of implementation of its provisions; 6- Coordinate between national bodies concerned with the implementation and dissemination of IHL provisions; 7- Monitor violations of IHL provisions, document them, and suggest means to remedy them; 8- Enact the necessary measures to promote the implementation of IHL and disseminate IHL culture; 9- Prepare data and statistics on the plans of the Commission and other bodies to implement provisions of IHL. Article (4) The President of the Commission shall be responsible to supervise and follow up the conduct of work within the Commission, particularly: 1- Calling the Commission to convene, preside over the meetings and endorse its proceedings; 2- Suggesting and presenting financial allocations to the Commission; 3- Issuing resolutions regarding professional matters related to the Commission's staff; 4- Any other responsibilities mandated by the Commission or included in its regulations. Article (5) The Commission shall have a general coordinate to supervise the conduct of daily work; he shall assume the necessary competences to achieve the objectives of the Commission, particularly: 1- Suggesting the Commission's regulations , its administrative, financial and technical systems; 2- Preparing financial and administrative reports of the Commission; 3- preparing the Commission's accounts and presenting them to the President; 4- Executing and following up resolutions and recommendations of the Commission or its President; 5- Informing about the Commission's activities and follow up news about its activities in different media and taking the necessary measures in this regard; 6- Providing the Commission's needs to undertake its activities. 2 Article (6) The Commission's financial resources shall consist of the following: 1- Annual allocations from the Public Budget; 2- Unconditional donations that the President accepts. Article (7) The Committee may open one or more bank accounts in banks operating within the Great Jamahiriya to deposit its funds Article (8) The Commission shall have financial allocations to cover its expenses and programs. A resolution from the Secretariat of the General Popular Committee shall identify those allocations upon a proposal from the General Popular Committee for External Communication and International Cooperation. Article (9) A sufficient number of administrative employees may be delegated or seconded to the Commission to help it in undertaking its tasks. Article (10) Decisions and recommendations provided for in items 1-4 of Article (3) of this Decree shall not enter into force except after their adoption by the Secretariat of the General Popular Committee. Article (11) The General Popular Committee for Financial and Technical Supervision shall verify and revise the Commission's accounts according to provisions of the aforementioned Law No 11 of 1425. Article (12) This Decree shall enter into force as from the date of its issuance, and competent bodies shall be under an obligation to execute it. The General Popular Committee 18/12/2005 3 4
