VILLAGE OF WESTFIELD, NEW YORK RESOLUTION AUTHORIZING MAYOR TO ENTER INTO EMERGENCY CONTRACT FOR DEMOLITION OF THE PORTAGE INN December 8, 2015 The Board of Trustees of the Village of Westfield, New York, hereby resolves as follows: WHEREAS, Village Code Enforcement Officer James E. Pacanowski has condemned the structure at 18-28 North Portage Street, known as the Portage Inn, finding that it is in a state of structural collapse and ordering its demolition as soon as possible, and WHEREAS, the Chautauqua County Land Bank Corporation has assured the Village that grant monies previously obtained by it to pay for the demolition of the Portage Inn in early 2016 will cover any expenses incurred for an immediate, emergency demolition, and WHEREAS, the Trustees believe that the current condition of the structure poses an imminent danger to the health, safety, and welfare of the residents of the Village of Westfield and it should be demolished as soon as possible, and WHEREAS, the Village has obtained a proposal from Empire Building Diagnostics, Inc. to complete a controlled demolition of the Portage Inn, which will remove the immediate hazard and leave a covered debris pile to be removed at a later date, NOW, THEREFORE, BE IT RESOLVED, as follows: 1. The condition of the Portage Inn is hereby declared to be a public emergency for purposes of Section 103 of the General Municipal Law, which requires immediate action that cannot await competitive bidding as would ordinarily be required; and 2. The Mayor is hereby authorized to enter into a contract with Empire Building Diagnostics, Inc. to complete a controlled demolition of the structure at a cost not to exceed $35,000.00. 3. The Mayor is hereby authorized to take any other steps and to enter into any other agreements necessary to effectuate the immediate demolition of the Portage Inn.
