Abandoned Minors
The Nevada Public Library Board of Trustees policy states that the fundamental responsibility for a
minor’s physical well-being remains with the parents of the minor. This policy is enacted because of
numerous incidents involving minors left at library facilities after closing. For purposes of this policy,
minors shall be defined as library patrons under the age of sixteen.
The Library can assume no responsibility for minor patrons on library property, who are not physically
within a library building at the time of closing.
If minors are in a building at the time of closing and have no means of transportation, the library staff
will obtain their names and addresses, their phone numbers, and the names of their parents. Their
parents will be called and told to pick up the minor, and a follow-up letter to the parents will be sent
explaining closing hours, library responsibility for the minor’s safety, and other specifics delineated in
this policy.
If the parents have not arrived to pick up their children within fifteen minutes after closing time or
could not be reached by phone, the police department will be contacted.
Acceptable Use - Electronic Information Systems
1. Customer Responsibility
a. Customers are responsible for being aware of and observing the
Library’s Internet policies and local state and federal law as they
apply to individual use of electronic systems, and are solely
responsible for violations they or their legal dependents commit.
b. Customers must show proof of identification in order to access
electronic resources.
c. Customers shall not be required to register for workstations dedicated
to accessing the library’s on-line catalog.
d. Public display or printing of offensive materials is a violation of Policy
-- Inappropriate Customer Behavior.
e. Although the library respects the confidentiality of Internet use within
the limit of its own policies and local, state, and federal statutes, it
may investigate and suspend individuals suspected of misuse and
take appropriate disciplinary and/or legal action.
f.
Acts contrary to local, state and federal law shall be considered a
violation of the library’s Internet Policy and be subject to suspension
of library privileges and appropriate penalty under law.
g. Customers assume all responsibilities for honoring copyright law.
Violations of copyright may be subject to sanction or legal action.
h. Customers who use computers for illegal activity or who destroy or
attempt to destroy hardware or software may be suspended from
using the library and shall be liable for civil and/or criminal legal
action.
i.
Customers agree to INDEMNIFY AND HOLD HARMLESS the District, its
employees and agents from any claim, demand, liability, cause of
action, suit, judgment, or expense, (including attorney’s fees),
arising out of any breach of this policy statement.
j.
Customers may not use library computers to conduct commercial
activities, i.e. operate a business within the library.

k. Customers shall be responsible for printing costs.
l.
The library reserves the right to limit inappropriate use of chat.
m. Customers may not employ Library systems for the purpose of libel,
slander, or any form of harassment.
n. The library will not install or support any hardware or software on
staff or public computers that is, in the opinion of the IT staff,
limited in scope or audience, is a potential threat to the security or
stability of District hardware or software, requires an excessive
amount of funds or staff time to install or maintain, or is not
beneficial or appropriate for use on a shared computer.
o. Customers may not install or activate hardware or software on public
computers, with the exception of storage or listening devices for
personal use.
2. Parental Responsibility
a. Parents or guardians are responsible for their children’s access,
including sites located and informational content; there are a
number of guides available in libraries to support parents in this
responsibility. The Library will partner with parents to assist them in
helping their children develop acceptable behavior in accessing the
Internet.
b. The District assumes that the vast majority of parents want their
children to have access to this important informational tool. Parents
may request that the District deny Internet access to their children
and the District will include this denial notice in the child's customer
record. Parents should understand that blocking of the Internet will
result in the child not having access to many periodicals, databases
and value added services to which the library subscribes.
3. District Responsibility
a. The Nevada Public Library provides access to the Internet as an
integral component of information delivery. Since the Internet
consists of hundreds of millions of pages, the Library assumes no
responsibility for content.
b. The Library may limit individual session times, based on demand and
shall establish appropriate registration procedures for Internet use.
c. The District makes every effort to provide continuity of service but is
not responsible for any disruptions.
d. Transaction logs, electronic mail and other information which could be
used to identify users with specific materials or subject matter are
considered by the Library to be confidential, and will not be divulged
to anyone other than the user. All users are advised that such
records shall not be made available to any agency of state, federal
or local government except pursuant to such process, order or
subpoena as may be authorized under the authority of, and pursuant
to, federal, state or local law relating to criminal, civil, or
administrative discovery procedures or legislative investigatory
power.
e. The Library shall, however, reserve the right to investigate violations
of customer responsibility.
4. Applicability to all electronic information systems.
a. Applicable sections of this policy apply to stand-alone workstations
owned by the Library as well as those connected to the Internet.
5. Non-Resident use of electronic information systems.
a. Non-residents who own property or pay annual fees may use the
Internet and associated electronic information systems.
b. Other non-residents, who show proof of identification, may use the
Internet workstations once per month at no charge; then upon
payment of a $2 per one hour session for subsequent visits.
6. Penalties for non-compliance with customer responsibility
provisions of this policy--- appeals procedure:

a. The library staff may suspend customers from using the Internet or
ban them from the Library for up to two weeks.
b. Longer suspensions may be imposed by the Director of the Library for
chronic or serious abuses.
c. The Library may suspend use of Internet or stand alone workstations
for customers who are for any reason in Denial of Service Status.
d. Customers may appeal all denials to the Director and subsequently to
the Board of Trustees in accordance with policy.
7. Missouri Statutory Compliance: The District shall make provisions
to comply with statutes dealing with materials pornographic to
minors. Such procedures are enumerated in Policy: Acceptable UseElectronic Information Systems-Missouri Statutory Compliance.
Acceptable Use - Electronic Information Systems - CIPA Compliance
Introduction
It is the policy of Nevada Public Library to: (a) prevent user access over its computer network to, or
transmission of, inappropriate material via Internet, electronic mail, or other forms of direct electronic
communications; (b) prevent unauthorized access and other unlawful online activity; (c) prevent
unauthorized online disclosure, use, or dissemination of personal identification information of minors;
and (d) comply with the Children’s Internet Protection Act [Pub. L. No. 106-554 and 47 USC 254(h)].
Definitions
Key terms are as defined in the Children’s Internet Protection Act.
Access to Inappropriate
Material to the extent practical, technology protection measures (or “Internet filters”) shall be used to
block or filter Internet, or other forms of electronic communications, access to inappropriate
information.
Specifically, as required by the Children’s Internet Protection Act, blocking shall be applied to visual
depictions of material deemed obscene or child pornography, or to any material deemed harmful to
minors.
Subject to staff supervision, technology protection measures may be disabled or, in the case of
minors, minimized only for bona fide research or other lawful purposes.
Inappropriate Network Usage
To the extent practical, steps shall be taken to promote the safety and security of users of the Nevada
Public Library online computer network when using electronic mail, chat rooms, instant messaging,
and other forms of direct electronic communications.
Specifically, as required by the Children’s Internet Protection Act, prevention of inappropriate network
usage includes: (a) unauthorized access, including so-called ‘hacking,’ and other unlawful activities;
and (b) unauthorized disclosure, use, and dissemination of personal identification information
regarding minors.

Supervision and Monitoring
It shall be the responsibility of all members of the Nevada Public Library staff to supervise and monitor
usage of the online computer network and access to the Internet in accordance with this policy and
the Children’s Internet protection Act.
Procedures for the disabling or otherwise modifying any technology protection measures shall be the
responsibility of the IT Coordinator or designated representatives.
TECHNOLOGY PROTECTION MEASURE. The term “technology protection measure” means a specific
technology that blocks or filters Internet access to visual depictions that are:
1. OBSCENE, as that term is defined in section 1460 of title 18, United States
Code;
2. CHILD PORNOGRAPHY, as that term is defined in section 2256 of title 18,
United States Code; or
3. Harmful to minors.
HARMFUL TO MINORS. The term “harmful to minors” means any picture, image, graphic image file,
or other visual depiction that:
1. Taken as a whole and with respect to minors, appeals to a prurient interest
in nudity, sex, or excretion;
2. Depicts, describes, or represents, in a patently offensive way with respect to
what is suitable for minors, an actual or simulated sexual act or sexual
contact, actual or simulated normal or perverted sexual acts, or a lewd
exhibition of the genitals; and
3. Taken as a whole, lacks serious literary, artistic, political, or scientific value
as to minors.
SEXUAL ACT; SEXUAL CONTACT. The terms “sexual act” and “sexual contact” have the meanings
given such terms in section 2246 of title 18, United States Code.
Acceptable Use - Electronic Information Systems - Federal
Government Information
The Nevada Public Library will provide a free Internet access pass for Federal government information
resources available online to the residents of the 4th Congressional District including all or parts of the
Missouri counties: Barton, Bates, Benton, Camden, Cass, Cedar, Cole, Dade, Dallas, Henry, Hickory,
Jackson, Johnson, Laclede, Lafayette, Moniteau, Morgan, Pettis, Polk, Pulaski, Ray, Saline, St. Clair,
Vernon, and Webster counties.
Acceptable Use - Electronic Information Systems - Mo. Statutory
Compliance
This policy is enacted to restrict minor from gaining computer access to material that is pornographic
for minors in accordance with Sections 182.825 and 182.827, RSMo as expressed in Missouri 15 CSR
30-200.030 and 30-200-040, Public Access Computers in Public Libraries.
Definitions: Key terms are as defined in Section 182.825, RSMo.

Access to Inappropriate Material: All public access computers shall be equipped with software that
limit minor’s ability to gain access to material that is pornographic for minors or purchase Internet
connectivity from an Internet service provider that provides services limit access to material that is
pornographic for minors.
Statute and state regulations make no allowance for parental permission to use unfiltered computers,
or allowing minors access to unfiltered computers when accompanied by parents.
In using commercial filtering software, the District is making a best effort to comply with the statute
and accompanying regulation. The District cannot guarantee that such software shall function to block
all such offending materials.
Borrowing Limits
BORROWING
Occasional limits may be placed on collections in order to maintain supply with demand.
Examples may include:
Theme books during Summer Reading program
Award nominees Missouri Reader awards
Holiday collections
Science fair experiment guides
RENEWAL
An item cannot be renewed if it is currently on request. Normally an item may be renewed only two
times.
Charitable and Community Activities - Local
The library may participate in local community collections (blood donations, personal care items, nonperishable food, etc) at the library director’s discretion on a case by case basis. Participation may
include both promotion in the library and collection locations in the facility. These activities shall be of
local interest and concern only and are for the purpose of assisting local nonprofit organizations.
The Library will provide limited space within its facilities if space is available without hindering public
service activities. Such collections will be limited to one at a time and shall require only minimal staff
time. The Library shall not be liable for any loss or theft from the collections, nor will it assume
responsibility for maintenance or transportation of collections. Publicity for such collections shall not
be the responsibility of the Library.
Requests for library participation shall be submitted to the Director or his/her library staff designee.
Written approval or denial response shall be given within 15 days. Groups or organizations denied
access to branch specific collections shall have the right to appeal. Such appeal shall be submitted to

the Library Director within 15 days of original denial. The Director shall respond in writing with a ruling
concerning the denial within fifteen days.
If the Director determines that the request should be denied, a final appeal may be made to the
Board of Trustees. Such appeal must be made in writing and must arrive at the Library’s
Administrative offices no later than the 15thof the month for inclusion in the following month’s Board
packets. The Trustees shall be supplied with the final appeal language along with all findings by
management. Appeals to the Board of Trustees must be filed within thirty days of the date of the
denial finding submitted by the Director.
Copier and Printer Charges
The Nevada Public Library, by way of this document, reaffirms the price for photocopies, including
microfilm and computer printer output, at twenty cents per page.
The Library, through this policy, also affirms that the use of laser printers for direct computer output is
essential to providing new sources of information and is by nature the same end user product as
photocopier output. As such, established charges will be the equal to that for photocopies.
The District reserves the right to increase the base charge of such copies to offset the additional cost
of providing copies, including establishing new charges for color copies or other technological
innovations which have higher costs to the Library. Increases in charges necessitated by cost
increases shall be publicly posted for at least thirty days before the adoption of a new price schedule.

Denial of Service
Library service for material check out shall be denied to any person with fines owed in the amount of
$5 or more, or any person with materials which are more than 10 days overdue.
Computer services are limited by time management software and automatically denies patron access
if fines or overdues materials are accessed to patron’s account. Account must be in good standing for
computer access.
In extreme circumstances the District may work with law enforcement authorities if the person has
committed the crime of library theft as described in RSMo 570-210.
Service may also be denied for other reasons, including, but not limited to bad address, abuse of
services, failure to provide adequate identification, or disruptive behavior within the library. Specific
services, i.e., interlibrary loan, internet access, etc. may be denied as outlined in other library policies.
Library service shall be denied to family members on a case by case basis, under certain abusive
circumstances. Members of the family shall be defined as children and other minors, under eighteen
(18), residing at the same address and the parent or legal guardian of the cardholder. The situation
shall be fully documented and forwarded immediately to the Deputy Director.
Person in charge shall have the right to modify this denial of service for hardship. And shall be able to
restore library service to a patron or family if a good faith effort to return materials and pay fines is
shown, and any such adjustments will be fully documented and forwarded to the Director.

Library cardholders have the right to appeal any decisions made under this policy to the Director. If
the person is unsatisfied with the results of that appeal the appeal may be taken to the Library Board
for a final decision.
Denial of Service - Appeal
The following policy shall constitute right of appeal for denial of library services by the Nevada Public
Library.
Citizens who have been denied library service for any reason shall, after the normal course of reviews
by the Director as specified within various policies of the District, have fifteen days to appeal in writing
such denial to the Director of the Library. The Director shall respond in writing with a ruling concerning
the denial within fifteen days.
If the Director finds that service shall continue to be denied, a final appeal may be made to the
Library’s Board of Trustees. Such appeal must be made in writing and must arrive at the Library’s
Administrative offices no later than the 15th of the month for inclusion in the following month’s Board
packet. The Trustees shall be supplied with the final patron appeal along with all findings by
management. Appeals to the Board of Trustees must be filed within thirty days of the date of the
denial finding submitted by the Director.
Fines
Fines
Overdue fines are charged for items that are not returned by the due date. Fines are assessed at the
time of return of the materials. Fines begin on the day following the due date and are assessed a rate
of ten cents ($0.10) per day per item for all circulating materials except the following:
DVDs are assessed a rate of fifty cents ($.50) per day per DVD
ILL materials are assessed a rate of $2.00 per day
The maximum fine charged for overdue items is $1 (one dollar/item), except for the following:
DVDs maximum fine is $5.00
ILL maximum fine is $30.00
Damage Fees
Fees are charged for damaged items, for lost materials, and for other library products and services as
designated by the Library Board. When damaged materials are returned which can be repaired, the
cost to the library of repairing the materials is charged. The cost of replacing damaged materials will
be charged if the material is damaged beyond repair. Partial damages may be prorated, based on the
value of the material and the extent of the damage, especially if only one in a multi set is damaged.

Lost Item Fees
The fee charged for lost items will be the list price of the item plus $5.00 for processing fees
(jacket/case/labels/security materials). Refunds may be issued (minus processing fee) for returned
lost and paid items on a limited basis. The Director may exercise discretion in approving refunds.
Contributing factors include, but are not limited to the following; type of material, availability, cost of
replacement, need, subject area, condition of the material, and whether an item has already been
replaced. Fines, Fees and other charges assessed to the customer shall be calculated and deducted
from the amount of the refund.
Other Fees
Fees for other products and services may include but are not limited to the following; replacement
library card fee, returned check fee, nonresident fee of $25 per household, pass through charges to
the District for interlibrary loan services, and other miscellaneous fees. A schedule of current
miscellaneous fees shall be available in each branch. The Board of Trustees will annually review this
policy and the schedule of current miscellaneous fees.
Firearms Banned in District Facilities and Vehicles
No person who has been issued a concealed carry endorsement by the Missouri director of revenue
under Section 571.107 RSMo or who has been issued a valid permit or endorsement to carry
concealed firearms issued by another state or political subdivision of another state, shall, by authority
of that endorsement or permit, be allowed to carry a concealed firearm or to openly carry a firearm in
any building or portion of a building owned, leased or controlled by the Library.
Copies of this policy or signs shall be posted at each entrance of a building owned, leased or controlled
by the Library stating that carrying of firearms is prohibited. Any person violating this section may be
denied entrance to the building or ordered to leave the building. Any Library employee violating this
section may be disciplined. No other penalty shall be imposed for a violation of this section.

Although the Library District observes Martin Luther King Day, Presidents Day, and Veterans
Day, the District will be OPEN for training but closed to the public.

Incident Report
The completion of an Incident Report is required for any accident, bomb threat, death or severe
medical problem, drug and psychiatric problem, earthquake, fire and explosion, power failure,
robbery, tornado, and other emergencies.
The procedure to follow in any of these events is outlined in the Library’s Emergency Manual.
Inappropriate Customer Behavior
The Nevada Public Library shall make rules necessary to ensure that problem customer behavior does
not infringe on the rights of others.
General Library Behavior Guidelines
Nevada Public Library supports the rights of all individuals to:

Use the library without discrimination

Receive friendly, courteous and respectful service

Have free and equal access to information

Have a clean, comfortable and pleasant environment

Use the library undisturbed without threat of harm, invasion of property, or
interference.
Customers are required to be engaged in activities associated with the use of a Public Library while in
the building. Customers not engaged in reading, studying, computer use or using library materials
may be asked to leave the building.

Definition of Problem Behavior
Problem behavior is any behavior which either consciously or unconsciously violates or restricts the
rights of customers or staff to use the Library.
Libraries are for everyone's enjoyment. The following guidelines for customer conduct shall be
observed in all branches and facilities operated by the Library and are essential to ensure respect for
individuals who use the Library's facilities:
Animals: Bringing any animal into the building, except an animal needed and trained to assist a
disabled or visually impaired person, or an animal that is part of an authorized Library program or
function is prohibited.
Audio Equipment: Playing audio equipment so that others can hear it is not allowed.
Bicycles: Bicycles must be parked in designated areas outside the building. They are not allowed in
entrance areas or in the building.
Cell Phones: As a courtesy to other Library users, cell phones and pagers should be kept on vibrate
or silent mode and answered promptly. Customers should speak in low tones and keep conversations
brief. If phone calls cannot be concluded quickly customers should move away from reading, research
and study areas. If the call needs to continue it should be taken outside the building. Cell phone use is
prohibited in during classes or programs.
Children: See Parental Responsibility - Unattended Minors Policy for additional information
about unattended children and disruptive behavior.
Closing: Customers should leave the Library promptly at closing time. See also Abandoned Minors
Policy.
Clothing: Appropriate clothing must be worn in the Library. Shirt, Pants, and Shoes must be worn in
the library. No swim suits.
Computer Equipment - Public PCs: In order for all Computer users to access the PCs without
disruption each computer will be limited to one person at a time. See also Acceptable Use - Electronic
Information Systems Policy.
Damages: Those who damage or deface Library materials, equipment or property will be accessed
fees. Parents are responsible for damage done to materials checked out on their child’s card.
Disturbances: Creating a disturbance that disrupts or interferes with the normal operation of the
Library, or disrupts Library customers and staff, including, but not limited to the use of abusive or
threatening language or gestures, conduct that creates unreasonable noise or conduct that consists of
loud or boisterous behavior or talking is not allowed.
Entrances: Building entrances and exits may not be blocked. Individuals may not interfere with the
free passage of Library customers or staff in or on Library premises by blocking sidewalks, stairways
or railings.
Food and Drink: In order to create a welcoming atmosphere, eating and drinking, if done
responsibly, is allowed throughout the building when seated at tables. Abuse of this privilege may
result in a request to leave the building. Beverages are not allowed near the computer areas.
Furniture (Misuse of): Customers should sit one to a chair. In order to maintain clean and attractive
Library facilities and furniture, customers may not use furniture in inappropriate ways. This includes
sitting on tables, placing feet on furniture, lying on floors or defacing walls.

Interference: Interfering with another person's right to use the Library or with the Library staff's
performance of their duties is not allowed. This includes harassment of customers or Library staff in a
physical, sexual or verbal manner, including, but not limited to, purposeful attempts to intimidate,
annoy, or provoke others by following them around, prolonged staring, or engaging in behavior that
Library Staff believes is clearly meant to mock, taunt, or bait or behavior which reasonably can be
expected to disturb other persons.
Intoxication: Intoxicated customers will be asked to leave the premises.
Loitering: Loitering on library property is not allowed. This rule requires staff to exercise discretion
with regards to what is considered unacceptable loitering behavior. In general, the determining factor
will be whether the offending party prevents others from enjoying the Library.
Personal Possessions: Personal possessions should not be left unattended in the library or at public
service points for safekeeping. The Library is unable to guarantee the security of such items.
Public Displays of Affection: Excessive displays of affection are inappropriate behavior for the
Library.
Restrooms: Misusing the rest rooms (e.g. using them as a laundry or washing facility, or defacing the
walls) is not allowed.
Running: Running is not allowed in the Library building.
Skateboards, Roller Skates and Other Sports Equipment: Customers may bring these into the
Library while they look for materials, however they may not be used on Library property. See also
Skateboarding Policy
Solicitation: See Petitioning, Solicitation and Distribution of Literature on District Property
Staff Only Areas: Customers are not allowed to enter areas posted "Staff Only" without permission.
These areas include but may not be limited to, any staff work area, including the workroom, the staff
break room, and the mechanical areas of the building.
Threats: Threatening behavior, including, but not limited to, violence, threats of violence, and
possession of weapons is not allowed.
Tobacco: Smoking and the use of tobacco products is prohibited in the Library.
Consequences of Behavior Policy rule violations
Customers who violate the rules listed above are subject to the withholding of Library privileges as
follows:
FIRST OFFENSE: Customer will be evicted from NPL and prohibited from returning for the remainder of
the day or week (staff may use their own judgment as to the severity of the offense)
SECOND OFFENSE: Customer will be evicted from NPL and prohibited from returning for a period of
one month.
THIRD OFFENSE: Customer will be evicted from NPL and prohibited from returning for a period of six
months.

Customer's right to appeal Denial of Service
Customers who have been denied library service may appeal this decision.

In addition to the rules listed above, the violation of any federal or state statutes or local
ordinances on the premises of the Nevada Public Library will also be regarded as a violation
of NPL rules.
On Nevada Public Library’s premises, no person shall:

Commit an assault or battery upon any person.

Engage in a fight.

Steal or take property not his own.

Deface, destroy, damage or remove any property not authorized by NPL.

Engage in any indecent or obscene conduct or make any indecent exposure
of his or her body.

Use, give away or sell any controlled substance.

Possess a weapon unless authorized by state law.

Remain in the building after regular closing hours, except by the invitation
of Nevada Public Library.

Break any federal or state statute, or local ordinances that disrupt library
operations.
Consequences of Statute or Ordinance violations
Persons who violate the statutes, ordinances and rules listed above are subject to the withholding of
Library privileges as follows:
FIRST OFFENSE: Library privileges will be revoked for one year.
Or Nevada Police Department may be contacted to trespass the patron/person from property
permanently.
The Director or their designate will notify patrons whose library privileges have been revoked by
means of written correspondence via certified mail to the involved patron's last known address.

Interlibrary Loan
Nevada Public Library participates in the interlibrary loan network which allows libraries to supplement
their collections by borrowing materials from and/or loaning materials to other library systems.
The District’s policies are governed by the National Interlibrary Loan Code as specified below. Each
library participating in the Interlibrary Loan program is allowed to develop guidelines governing the
use of their own ILL system. The following code has been developed for the Nevada Public Library.
BORROWING
Requests for ILL will be made through OCLC First Search once a patron has completed a request form
for ILL materials.
Interlibrary loan due dates are specific for each transaction and restrictions are determined by the
lending library. Materials may not be renewed.
There is a fine of $2.00 per day per item for overdue items.
An individual patron may only request an item twice. When repeated requests are made for a specific
item, the district will consider it for purchase, based on the collection development policy. The district
will accept only three title requests per individual at one time. Patrons will be responsible for any
charges made by the lending library for ILL items. ILL privileges may be suspended if the patron fails
to pick up a requested item, returns an item late, or loses an item.
The library will provide ILL services for non-resident cardholders but not to temporary cardholders.
The library will not accept subject requests; specific titles must be requested.
LENDING
NPL will lend materials to other libraries under the same conditions and terms as borrowed.
However, the following materials will not be loaned:
Microfilm and microfiche
Reference items
DVDs
Newly acquired materials owned less than six months
At the discretion of the district, other individual items may not be loaned.

Interlibrary Loan, Denial of Service
ILL privileges may be suspended if a patron fails to pick up a requested item, return an item late, or
loses an item. Repeated abuses may result in a permanent denial of ILL services.
Failure to pick up a borrowed ILL item may result in denial of ILL services for 30 days. A second
occurrence may result in denial of ILL services for 6 months. Repeated occurrences may result in
denial of ILL services for 1 year.
Failure to return a borrowed ILL item may result in a processing charge of $25 plus the cost of the
item as billed by the lending library, and overdue fines up to 30 days. These fines and fees will be
charged to the patron’s card. Denial of service will be in effect for failure to return items on time.
Constant abuses of the ILL services may result in a permanent denial of ILL services. Constant abuses
include failure to return ILL items on time, and/or, failure to pick up borrowed items, and/or loss of an
ILL item.

Library Cards
Possession of a valid library card in good standing, i.e. not in "denial of service" status, is required to
borrow materials from the Nevada Public Library, access its electronic resources as well use the
Library’s public PCs unless other policies and/or agreements provide exceptions.
Each card application must include:

permanent address of residency (P.O. Box only is not proof of residency)

birthdate of applicant (used to differentiate between people with same
name and for distinction of responsibility for minors)

signature of responsible party (a parent or guardian's signature is required
on a Library Card application for a person under the age of 16)
The signature of an adult constitutes an agreement to abide by rules set forth by the Library regarding
use of the card and signifies responsibility for any fines, fees, damages, or loss of materials which may
result from the card's use.
The Library retains the right to modify the limits for certain individuals and organizations when it
deems appropriate to reduce potential loss.
The Library shall issue various types of cards to accommodate the public's needs.

INDIVIDUAL (PERSONAL) CARD
An individual card shall be issued without charge to:

Any resident of Nevada, MO, living within city limits, upon request with
appropriate identification. A place of residence, as defined in the Revised
State of Missouri Statutes, means the place where the family of any person
permanently resides and the place where any person having no family
generally lodges.

A parent or guardian's signature is required on an application for a library
card for a person under the age of 16. Appropriate identification of the
parent or guardian is required when responsibility is assumed by such
person.

A person age 16 and over applying for a library card assumes such
responsibility on his or her own signature.

Acceptable identification may include, but is not limited to utility bill,
postmarked mail, etc. dated within past 30 days along with picture
identification.

A non-resident who pays city property taxes in Nevada, MO upon request
with appropriate identification and proof of tax payment. Acceptable
identification may include, but is not limited to, a valid driver's license,
utility bill, postmarked mail, etc., along with picture identification.

A non-resident taxpayer may designate additional family members living at
the owner's primary residence as associated users of the same card for
which the cardholder will assume responsibility.
Responsibility:
A parent or guardian's signature is required on an application for a library card for a person under the
age of 16. The parent or guardian thereby assumes responsibility for any fines, fees, damages, or loss
of materials which may result from the use of the card. Appropriate identification of the parent or
guardian is required when the responsibility is assumed by such person. A person age 16 and over
applying for a library card assumes such responsibility on his or her own signature. Acceptable
identification may include, but is not limited to, a valid driver's license, utility bill, postmarked mail,
etc. along with picture identification.
Limitations:
Each card shall be limited to a maximum of five (5) books on it at any one time.
Each card shall be limited to a maximum of one (1) DVD on it at any one time. This policy will replace
the previous policy of the DVD circulation limit of two DVDs per household. Card hold must be present
to check out materials.
ORGANIZATIONAL CARD and/or BUSINESS CARD
A card shall be issued without charge to any organizational entity, profit or non-profit, located within
the city limits of Nevada, MO upon request with appropriate documentation and identification.
Responsibility:
A card application must be signed by a responsible person within the organization, such as an owner,
manager, or fiscal officer. The corporate entity shall assume responsibility for any fines, fees,
damages, or loss of materials which may result from the use of the card. Appropriate documentation

and identification may include, but shall not be limited to, a business license, certification by County
Clerk, 501 C listing, IRS Determination Letter, or other legal documents.
Limitations:
Each card shall be limited to a maximum of 30 items at any one time. These values may be lowered at
the applicant’s request in order to reduce potential liability.
NON-RESIDENT CARD
A person, who does not reside in Nevada city limits, does not pay property taxes in the city of Nevada
and does not qualify for any of the library cards previously listed, may obtain a non-resident card.

An annual fee of $25 per household membership per 12 month period will
be assessed.

Applicant may designate family members living at the owner's primary
residence as associated users for which the cardholder will be responsible.
Responsibility:
Same as stated for an individual (personal) card.
Limitations:
Each card shall be limited to a maximum of 5 books/1 DVD at any one time.
SCHOOL (K-12) CARD
A card shall be issued without charge to any public, private, or parochial K-12 school located in Vernon
County upon request with appropriate documentation and identification.
Responsibility:
A card application must be signed by a responsible person with the school such as the Superintendent,
Director, or building Principal. The school shall assume responsibility for any fines, fees, damages, or
loss of materials which may result from the use of the card.
Limitations:
Each card shall be limited to a maximum of 30 items at any one time. These values may be lowered at
the applicant’s request in order to reduce potential liability.
There is a limit of one library card per school building.
The physical library card must be presented for check-out of physical library material.
A school card may be used to demonstrate the Library’s electronic resources. However, the card may
not be used to logon multiple computers to access the Library District’s electronic resources at the
same time. The card number may not be distributed to students or anyone outside of the school’s
faculty or staff.

TEMPORARY CARD
A temporary card may be issued to an individual residing temporarily in Nevada, MO.

Card shall be issued for a period of up to 90 days.

The cardholder shall provide identification and proof of permanent residency
as well as proof of temporary residency.

Acceptable identification may include, but is not limited to, a valid driver's
license, rent receipt, postmarked mail, etc. along with picture identification.
Responsibility:
Same as stated for an individual (personal) card.
Limitations:
Each card shall be limited to a maximum of 2 books OR 1 DVD at any one time.
TEMPORARY CARD: Cottey College Student
A temporary library card may be issued to an individual who resides at Cottey College
Card shall be issued for a period of up to graduation date.

The cardholder shall provide identification and proof of permanent residency
as well as proof of temporary residency.

Acceptable identification may include, but is not limited to, a valid driver’s
license, rent receipt, postmarked mail, etc. along with picture identification.
Responsibility:
Same as stated for an individual (personal) card.
Limitations:
Each card shall be limited to a maximum of 5 items or materials valued at $250 borrowed on it at any
one time. These values may be lowered at the applicant’s request in order to reduce potential liability.
OTHER CARDS
The District may establish other types of library cards with differing limits for the purpose of providing
services to other libraries, homebound residents and institutions. In addition, internal library cards
may be established to effect services among and within branches.
REPLACEMENT LIBRARY CARD FEE
There shall be a fee for replacement of a library card. This charge may be waived for extenuating
circumstances and hardships. The replacement charge is based on the actual costs incurred by the
Library in supplies, personnel, and other miscellaneous costs.

Loan Periods
The Nevada Public Library shall have a standard loan period of two weeks for all circulating materials
with the following exceptions:
DVDs have a one week loan period.
Interlibrary loan items shall be loaned for two weeks provided the lending library has allowed sufficient
time for return of the items. Shorter loan periods may be required in order to process the material for
return on the date specified by the lending institution. ILL staff will use discretion in setting those loan
periods.
Loan periods may be adjusted for high demand items.
Electronic and or downloadable materials may have varying loan periods based on vendor/supplier
requirements.
Loan periods may be extended to accommodate vacations and other anticipated absences from the
area. Loan periods will not be extended for items that are on request by other borrowers.
Reference items are not considered circulating materials.
General Use of Library Meeting Rooms
The purpose of this policy is to insure an orderly, peaceful and efficient use of library Meeting Rooms
so as to accommodate and provide equal access to library customers.
Personal events, including but not limited to birthday parties, play groups, wedding receptions, and
reunions are not considered appropriate use of Library Meeting Rooms.
Modifications of Meeting Room rules may be made for the Library District or its partner organizations.
The Library District reserves the right to adjust room assignments based on scheduling needs. Library
District sponsored programs shall receive priority in the event of a scheduling conflict.
1. Purposes, objectives, or views of customers reserving Library District
Meeting Rooms shall in no way be announced, advertised, or displayed so
as to suggest that the organization, its mission, beliefs, or purposes are
endorsed by the Library District or its partnering agencies.
2. Customers shall be responsible for vacating the Meeting Rooms within the
timeframe indicated in their room reservation.

3. Use of Meeting Rooms must be concluded in time to vacate the room in
advance of the regularly scheduled facility closing time; typically fifteen
(15) minutes before the close of the facility.
4. Meetings must be conducted in a quiet, orderly manner.
5. In accordance with Library Policy, customers reserving the meeting facility
will insure that meeting attendees respect the common use areas of the
library.
6. In accordance with Library Policy, parents may not leave children
unattended while using the meeting room facilities.
7. All Library District facilities are smoke-free and the use of tobacco products
is prohibited.
8. Light, non-alcoholic drinks and refreshments may be served, so long as the
premises are left clean and orderly.
9. Customers using the Meeting Rooms shall be assessed for damage to, and
excessive cleaning of, Meeting Rooms. The use of tacks and permanent tape
is prohibited.
10. Kitchen and food preparation facilities will not be made available to
organizations using the Meeting Rooms.
11. No materials, equipment or furniture belonging to Library Customers may
be stored on Library District premises. The Library will not assume
responsibility if materials, etc. are left on the premises.
12. Customers using the meeting facilities will hold harmless the Library for
injuries and accidents as a result of carelessness.
13. Due to the public nature of Meeting Rooms, reservation requests shall not
be protected as Library User Records, as described in Library Policy, but
treated as public documents.
14. Library staff reserves the right to enter all meetings held in Library District
facilities.
15. Unless specifically outlined above, All Library Policies shall apply to the
use of the Meeting Rooms.
When conflicts arise between the proposed use of the Library’s Meeting Rooms and regulations
presented in this policy, the Board of Trustees of the Nevada Public Library shall have the final
authority in granting or refusing permission for use of the rooms.
Parental Responsibility - Unattended Minors
The Nevada Public Library shall not be liable for children left unattended in the libraries or on its
property. Children must be attended by a parent or responsible child care provider while in the library.
Parents are responsible for their children’s behavior in the library.
Petitions
This policy establishes regulations controlling petitioning, soliciting, and distributing literature to
employees or customers on Library property.

Persons are prohibited in engaging in the personal distribution of literature and or solicitation of library
employees and customers in Library buildings and grounds with exceptions noted below. Government
agencies that disseminate information in District buildings pursuant to the approval of the Library
Director or his designate are not engaged in petition, solicitation or distribution of literature as defined
in this policy.
Employees' distribution and solicitation for charitable activities and bulletin board displays are
regulated by different policies. Limited exceptions for petition, solicitation or distribution does not
constitute endorsement by the District.
Petitioning, solicitation and distribution of literature is allowed in the following circumstances:
1. Inside a library, petitions are allowed only in the context of scheduled
meetings in library meeting rooms. Petitioners may not stand outside the
library meeting rooms.
2. Petitioners may stand outside library buildings on Library property in areas
designated by staff, away from entrances, but must not impede traffic, or
pursue customers. Literature may be distributed at locations designated by
staff outside library buildings on library property in areas designated by
staff, away from entrances, but must be done in a matter that does not
impede traffic.
Posting
Depending on available space, the Library may offer bulletin boards or display tables or racks which
offer community information. Postings may be of a civic, educational or cultural nature with other
information being posted within the limitations of space available.
Bulletin boards, tables, and racks may be cleared on a regular basis to conserve space. Clearing
schedules shall be determined by the branch manager at each location.
The Library does not pre-approve postings, but may remove any deemed unsuitable. The Library
assumes no responsibility for any inappropriate use of posted information.
Posting - Political Signs
Posting of campaign or political signs on buildings or grounds owned by the Nevada Public Library shall
not be allowed.
Privacy of Library Circulation Records
1. The Library User Records of the Nevada Public Library are confidential
regardless of source of inquiry.
2. Library User Records shall not be made available to anyone except pursuant
to such process, order, or subpoena as may be authorized by law, or in
response to a written request of the person identified in that record.
3. Upon receipt of such process, order or subpoena, consultation shall be made
with the Library’s attorney to determine if such process, order, or subpoena
is in good form and if there is a showing of good cause for its issuance.

4. If the process, order, or subpoena is not in proper form or if good cause has
not been shown, insistence shall be made that such defects be cured before
any records are released. (The legal process requiring the production of
Library User Records shall ordinarily be in the form of subpoena duces
tecum (bring your records), requiring the librarian to attend court or the
taking of his or her deposition and may require him to bring along certain
designated Library User Records.)
5. Any threats or unauthorized demands, (i.e., those not supported by a
process, order or subpoena) concerning Library User Records shall be
reported to the Director of the Library and to the Board of Trustees of the
District.
6. Any problems relating to the privacy of Library User Records which are not
provided for in the above five paragraphs are to be referred to the Director
of the Library District.
7. For purposes of this Policy, “Library User Records” is defined as any
document, record, or other method of storing information retained, received
or generated by a library that identifies a person or persons as having
requested, used, or borrowed library material, and all other records
identifying the names of library users. The term "Library User Records" does
not include non-identifying material that may be retained for the purpose of
studying or evaluating the circulation of library material in general.
Reference - Directory Information
The Nevada Public Library shall offer directory information assistance as a part of normal reference
service. Limitations shall exist in providing the service via telephone and other electronic means,
thereby restricting the availability of such resources to residents of Vernon County.
The Library District will provide access to local city directories to in-library users. The Library shall
restrict telephone directory assistance for specific names, addresses, and telephone numbers only to
Vernon county residents and businesses. Except for emergencies, staff will not provide "near-bys",
e.g. names, addresses, telephone numbers of close-by or near-by locations, over the telephone.
Reference Service - Fax
The Nevada Public Library shall provide reference service via fax to district card holders, residents,
taxpayers, governmental agencies, institutions and businesses upon request.
The District will fax up to 10 pages of material per transaction. Documents of more than 10 pages
may be sent at the discretion of the staff. There will be a charge of twenty cents per page for material
transmitted. Fax fees = $3 / 10 pages Fax to toll-free numbers will not be charged. Fax to utility
companies to establish residency or for financial purposes will also not be charged.

Skateboarding
Skateboards and roller skates may not be used within property owned by the Nevada Public Library.
The Library shall not be liable for injuries incurred by skateboarders or skaters. Library staff may call
the appropriate police agencies in order to enforce this policy.
Signs informing the public of these restrictions shall be placed on property.
Staff Materials Borrowing
All employees of the Nevada Public Library, resident or non-resident, shall be allowed to borrow
materials and make normal use of the Library’s facilities and services.
Employees shall not be charged fines for materials borrowed. However, all materials taken shall be
charged in a manner allowing identification of the borrower. Employees must follow the same policies
related to check out, renewals, due dates, and reserves as Library customers. Any abuse by
employees of library services shall be subject to disciplinary action.
Temporary Closing of Branches
The Director shall have the authority to close individual branches of the Nevada Public Library when
necessary, including, but not limited to construction, power outages, and weather.
It is the policy of Nevada Public Library to close if Nevada R-5 schools close due to road conditions.
Video Media
Videocassettes and DVD's are available for home use to all library cardholders of the Nevada Public
Library.
Borrowers assume responsibility for damages to, or loss of video media, and/or video media cases.
Borrowers will be charged the original list price for media not returned or for any damaged beyond
reasonable repair. Replacement cost of the case shall be charged according to the current replacement
cost list available in each branch.
Since the cleanliness and condition of individual patrons’ equipment cannot be controlled, the District
assumes no responsibility for damage done to equipment by media.
The Library District holds that it is not in "loco Parentis". It is the responsibility of a parent or legal
guardian to determine which materials their minor may use. All library cardholders may borrow video
media according to this policy. However, because of widespread public acceptance of the MPAA
ratings, movie productions rated “PG-13”, "R", or "NC-17" by the MPAA are restricted to cardholders
age 17 or older. Cardholders age 13 and up may borrow video media with MPAA rating of “PG-13”.
Media rated “R” or “NC 17” by MPAA will be indicated on the media case and circulating sleeve. These
materials are restricted to cardholders age 18 and up. (rev. 1/22/15)

Employees of the Library District shall make a good faith effort to restrict use according to this policy.
However, library employees shall not be held responsible for failure to enforce the restricted use
portion of this policy.
Wi-Fi Services
1. The Library District does not guarantee Wi-Fi.
2. The Library's wireless Internet access service is unfiltered. By choosing to
use this free service, patrons agree to abide by all applicable Library District
policies.
3. The Library does not guarantee the security of patrons' computers or data
while they are using the District's wireless connection.
4. The Library assumes no responsibility for the safety of equipment or for
laptop computer or other wireless device configurations, security, or data
files resulting from the connection to the Library's wireless access.
5. The Library reserves the right to limit bandwidth on a per connection basis
on the wireless network, as necessary, to ensure network reliability and fair
sharing of network resources for all wireless users.
6. Users may not extend or modify the wireless network in any way. This
includes adding access points or installing bridges, switches, hubs, or
repeaters. The Library reserves the right to remove or disable any
unauthorized access points.
7. Printing to the library printers is not available from wireless devices.
8. Library staff is not able to provide technical assistance and no guarantee
can be made that patrons will be able to make a wireless connection.

Young Adult Services
Nevada Public Library shall have an area devoted to Young Adults (YA) – teens approximately between
the ages of 13 and 18. This area is designed to provide a bridge between the Children’s area and the
Adult area. Materials in this area will include, but not limited to popular and award-winning books,
audios, magazines and graphic novels. All items in this collection are marked with “YA”. The materials
in the Young Adult area have more mature content than the material in the Children’s area.
Parents and/or legal guardians are responsible for the use of the YA collection by their own minor
children.
Through internal and external training the District will develop staff familiar with YA materials to assist
teens and parents as they search the YA collection. The Library will offer programs designed especially
for teens to encourage use of library resources. Programs and activities will be designed by staff to be
age appropriate, to appeal to teens, and to explore the diverse resources available to them in the
library.
