Draft Regulations and Orders Relating to Public Bodies (Joint Working) (Scotland) Act 2014 Public Bodies (Joint Working) (Scotland) Act 2014 Draft Regulations and Orders 1 Introduction 1.1 The Public Bodies (Joint Working) (Scotland) Act 2014 establishes Community Health and Care Partnerships. In South Lanarkshire, an “Integration Board” has been established comprising four South Lanarkshire Councillors; three NHS Lanarkshire Non-Executive Directors and the Medical Director with Harry Stevenson (Director of Social Work) as Chief Officer. The Chief Officer is jointly accountable to the Chief Executives of NHS Lanarkshire and South Lanarkshire Council and will manage a joint budget. The Transition Board is preparing for the establishment of the Community Health and Care Partnership on 1st April 2015. 1.2 The Community Health and Care Partnership will integrate the current South Lanarkshire Community Health Partnership with South Lanarkshire Social Work Services other than their work relating to Children’s Hearings and the Courts. 1.3 The Transition Board has decided that the Community Health and Care Partnership will have four localities: Cambuslang / Rutherglen; Clydesdale; Hamilton and Blantyre; and East Kilbride and Strathaven – which will be coterminous with the South Lanarkshire Public Partnership Forum Locality Public Partnership Forums. Each Locality will have a General Manager covering both Health and Social Work. 1.4 South Lanarkshire Public Partnership Forum has the opportunity to participate in the consultation process on draft regulations covering how Community Health and Care Partnerships should conduct their business. 1.5 Set One of the Draft Regulations covers: - Prescribed information to be included in the Integration Scheme Prescribed functions which must be delegated by Local Authorities and Health Boards Prescribed National Health and Wellbeing Outcomes Interpretation of what is meant by the terms health and social care Prescribed functions conferred on a Local Authority officer. 1.6 It is not proposed that South Lanarkshire Public Partnership Forum comment on these. 1.7 Set Two of the Draft Regulations covers: - 1.8 Prescribed groups which must be consulted when preparing or revising Integration Schemes; preparing draft strategic plans; and when making decisions affecting localities Membership, powers and proceedings of Integration Joint Boards Establishment, membership and proceedings integration joint monitoring committees Prescribed membership of strategic planning groups (In South Lanarkshire, “Strategic Commissioning Groups”) Prescribed form and content of performance reports. The consultation on Set Two of the Draft Regulations ends on 18th August 2014. Draft Regulations and Orders Relating to Public Bodies (Joint Working) (Scotland) Act 2014 2 Meeting with Harry Stevenson, Chief Office, South Lanarkshire Community Health and Care Partnership 2.1 Jack Ferguson (Chair of South Lanarkshire Public Partnership Forum) and Derek Morgan (Chair of the Older People, Health and Care Voluntary Network (VASLan) met with Harry Stevenson and with Brenda Hutchison (his Adult Social Work Deputy) on 9th July. 2.2 Jack Ferguson explained the structure and modus operandi of South Lanarkshire Public Partnership Forum and proposed that we provided the solution to the need to provide representation of service users to the Community Health and Care Partnership at both South Lanarkshire and Locality levels. 2.3 Derek Morgan explained the structure and modus operandi of the Older People, Health and Care Voluntary Network and proposed that they provided the solution to the need to provide representation of the Third Sector to the Community Health and Care Partnership at both South Lanarkshire and Locality Levels. 2.4 We identified a need for resources for recruitment and training for the Public Partnership Forum to enable expansion to cover social care as well as health care. 2.5 Harry Stevenson agreed in principle to the above. 3 Consultation 3.1 Prescribed groups which must be consulted when preparing or revising Integration Schemes; preparing draft strategic plans; and when making decisions affecting localities - 3.2 Membership, powers and proceedings of Integration Joint Boards - - Health and social Care Professionals Users of Health and Social Care Carers of users of Health and Social Care Commercial providers of health and Social Care Non-commercial providers of health, Social Care and Social Housing Third Sector bodies carrying out activities related to health or social care A registered health professional employed and nominated by the Health Board Chief Social Work Officer A staff-side representative A third sector representative A carer representative A service user representative Chief Officer Draft Regulations and Orders Relating to Public Bodies (Joint Working) (Scotland) Act 2014 3.3 Establishment, membership and proceedings of integration joint monitoring committees (Only where a lead agency model is used – does not apply in South Lanarkshire) - - - 3.4 Prescribed membership of strategic planning groups (In South Lanarkshire, “Strategic Commissioning Groups”) - Three councillors nominated by the Local Authority Three persons nominated by the Health Board (at least two nonexecutive directors and another member of the Health Board) The Chief Social Worker of the Local Authority A registered health professional employed and nominated by the Health Board Health Board Director of Finance Staff-side representative from the Health Board Third Sector representative A registered health professional employed and nominated by the Health Board Chief Social Work Officer A staff-side representative A third sector representative A carer representative A service user representative Chief Officer Carer representative A Health Care and a Social Care Professional A representative of users of health and social care A representative of carers of users of health and social care Commercial and non-commercial providers of health and social care Non-commercial providers of social housing A representative of Third Sector bodies Draft Regulations and Orders Relating to Public Bodies (Joint Working) (Scotland) Act 2014 3.5 Prescribed form and content of performance reports. - - - - Progress to deliver on national health and well-being outcomes Information on performance against key indicators or measures How the strategic planning and locality arrangements have contributed to delivering services that reflect the integration principles The details of any review of the strategic plan within the reporting year Any major decisions taken out with the normal strategic planning mechanisms An overview of the financial performance of the Integration Authority The extent to which Integration Authorities have moved resources from institutional to community based care and support, by reference to changes in the budget spent on each type of care and support 3.6 It is proposed that South Lanarkshire Public Partnership Forum supports the parts printed in bold at 3.1, 3.2, 3.4 and 3.5 and makes the comment that South Lanarkshire Public Partnership Forum and the four Locality Public Partnership Forums can and should fulfil these functions. 4 Conclusion 4.1 The Scottish Government will issue a report on the outcome of the consultation process and will lay Regulations and Orders in the Scottish Parliament from late September.
