For the purposes of Section 266 of the Building Act 2000 and in accordance with
regulation 16 of the Building Regulations 2014 and regulation 13 of the Plumbing
Regulations 2014, I determine that the expertise and qualifications required for the
certificates described, are set out in Schedule 1 (building work) and in Schedule 2
(plumbing work).

Definitions
In this Determination:
‘Accredited’ means a person who is accredited as building practitioner under the
Accreditation Scheme in the Building Act 2000;
‘Accredited person - bushfire hazard’ means a person accredited under the Fire
Service Act 1979 to analyse bushfire hazards in bushfire-prone areas.
‘Certificate IV in on-site domestic wastewater management’ means the
qualification 39105QLD Certificate IV in Domestic Wastewater Management, or an
equivalent qualification;
‘Certified Professional Soil Scientist’ is an accredited professional who has
achieved the Professional Standards for Soil Science, set by the Australian Society of
Soil Science Inc;
‘Chief Officer’ means the person appointed under section 10 of the Fire Service Act
1979;
‘NPER’ means the National Professional Engineers Register;
‘On-site domestic-wastewater management system’ means a system for the
management of waste water that is a disposal or treatment system servicing one or
more blocks within the scope of AS/NZS 1547 - 2000 On-site domestic-wastewater
management and includes associated land application system and collection wells;
‘PI insurance’ means that a practitioner’s scope of work is covered by a policy of
Professional Indemnity Insurance, either in the name of the practitioner or in the
name of their employer. The indemnification of officers and servants of the State of
Tasmania provided under the State Service Act 2000 Ministerial Direction No. 8 of
1st July 2003, satisfies the requirements of this Determination.
Note:
Descriptions of the categories of Accredited Building Practitioners and their scope of
work may be found in the Scheme for the Accreditation of Building Practitioners, July
2008, as amended. Regardless of the Scope of Work allowed by the Scheme for the
Accreditation of Building Practitioners, the Building Act 2000 requires that any accredited
building practitioner must only act within their area of competence.
