Questions and Answers session Provision of Services for the final disposal of PCB contaminated waste from the Republic of Kazakhstan The objective of the work is to arrange for the safe, documented and appropriate stowing, transportation and disposal of PCB containing equipment; packaged, labeled, collected and stored from several PCB owners, located in different places on the territory of the Republic of Kazakhstan. Packaging, labeling and collection of PCB containing equipments will be provided by a local subcontractor (managing company of the temporary storage site) Can you confirm that all PCB equipment will be collected and will be stored at one site in Kazakhstan. It’s assumed that the temporary storage will be located in Temirtau city. Has the location been confirmed or are we to assume another location will be chosen? this would have an impact on logistics etc. What services are we to provide, and agree to? Where are we to provide them, if all packaging and associated works is to be done by local contractors what will be our role in this? The Offeror, carrying the responsibility of safe transport, is obliged to ensure that the input of PCB owners in the procedure fulfils all the requirements of the relevant legislation. PCB is a controlled waste and as such must conform to IMDG/ADR/Air/Sea etc. are your subcontractors aware of these requirements? Where does our liability start? The Offeror shall propose an air transportation route, indicating the airport, which will be used for receiving PCB wastes. Also the Offeror will be responsible for preparation all documents according to the customs requirement of export and import countries as well as investigation of all duties and taxies that can be imposed within the export of PCB wastes for which the Oferror will be responsible for. This is a rather onerous task, which we believe will take a lot of time and effort, this should in our opinion be a separate Yes, we are announcing a separate tender for selecting local company, who will do packaging, labelling and storing PCB wastes. All PCBs will be collected in one storage (Karaganda city) The storage will be in Karaganda city (this is close to Temirtau – 30 km) PCB owners will participate in the handling, packaging, labeling, weighing, storing and loading of the PCB waste in an extent to be agreed with the Offeror. The Offeror shall provide expert services in this regard, but the handling, packaging, labeling, weighing, storing and loading, will be done by a local subcontractor, hired by UNDP under a separate contract. The Offeror should control, supervise and make training for those works, also Offeror is responsible for transboundary movement (air transportation) with preparation of all required documents and final disposal. Offeror is controlling and supervising local subcontractor in terms of compliance of local transportation with local and international transport regulations (ADR) The Offeror shall take total responsibility for a whole works; separation of activities would bring to complexity and misscordination of all works. Training and oversight of packaging, handling, labeling and transport of PCB waste to centralized storage Arrange for appropriate safety training for local sub-contractor to accomplish handling, packing and labeling of PCB contaminated equipment (supervision and oversight plan should be described by the Offeror) Arrange appropriate training on transportation of PCB contaminated equipment to the temporary storage facility (point of shipment), taking appropriate health and safety precautions, in order to prevent any possible contamination at the site, as well as measures for potential spillages, leakages and/or oil containment in emergency situations (supervision and oversight plan should be described by the Offeror) We believe that this should also be a separate issue Tri-Phase could offer PCB workshops and on-site training separate and prior to collection of the PCB wastes Provision of a list of packaging material and personal protective equipment, safety equipment, cleaning materials, disposables, tools etc necessary for the packaging and transport of the capacitors mentioned in the TOR (to be procured by local subcontractor) The Offeror here will do training on site, it can be done before supervision and control works. This shall also include a plan for envisaged safety measures during packaging operations, including safety measures to avoid spills and containment during packaging operation at the site, and action plan in the event of any possible spillages and contamination. With respect who will be the Project manager and what is his/her experience of PCB removal and disposal Offeror can do site visit but is not obligatory, he can provide work plan based on information in TOR. Project Manager here means Site manager of the Offeror or Person in charge acting on Behalf of the Offeror. The transportation of PCB containing equipment from the storage site to disposal plant will be performed by air. Total amount was 80 tons. The data sheet, article 21, mentions that deadline for submission of proposals is June 9, 12:00 am. Does this means that proposals must be submitted by June 8 end of the day or should the deadline read ‘June 9, 12:00 pm’? Please clarify whether it is the responsibility of the Offeror to pay export customs duties and taxes in Kazakhstan. Deadline is June 9, 12 am Please clarify whether the local subcontractor will be acting as shipper on behalf of the Offeror for customs purposes. Customs taxes and duties in Kazakhstan will be paid by the local subcontractor and taxes in destination point are to be paid by the Offeror. Local subcontractor will act as a shipper on the basis of separate export contract between the Offeror and local subcontractor only for the customs purposes. Please clarify whether transport of waste from waste producers to the facilities of the local subcontractor will be undertaken by the Offeror or by the local subcontractor. internal transportation from sites to the storage will be done by the local subcontractor, but transportation from the storage to the airport should be done by the Offeror The financial proposal form, table A, section 4, mentions that the following document must be submitted: ‘Certification that the PCB contaminated wastes were destroyed according to the regulations by the destruction facility duly signed and stamped by the state environmental authority’. This is different from Basel Convention requirements, which states that movement document is only signed and stamped by incineration facility. Environmental authorities do not sign and stamp notification documents. Please clarify whether a duly signed notification document by the incineration facility, along with a valid operational permit of the facility, would PCB destruction certificate is required also. cover the needs of this project. Notification fro transboundary movement of waste by air transport it’s mentioned in above RFP that the Offeror will act as Notifier and shipper. It should act as importer/consignee only because, according to EU directive 1013/2006 it is not allowed for the Offeror/contractor to act as notifier and importer/consignee in Notification documentation. Notifier should be some other company/Institution. Please be so kind and clarify Please specify the quantity of 141,966 includes already drums and pallets? Purchase and payment will be done by the PCB Owners. Internal Transportation of PCBs from several cites to the storage facilities will be done by the local subcontractor which will be selected by the separate tender and transportation from the storage to the airport is to be done by the Offeror. According to the EU directive 1013/2016 can act on behalf of waste producer as an Exporter Broker. And here we would like The Offeror act as a Notifier. Local subcontractor will act as a Shipper The weight of capacitors is 141966, this is an approximately weight, total loading weight with packaging and pallets is 169101. All figures are approximately the correct figures will be clarified after packaging and weighing. The RFP for above mentioned tender refers only to 200 tons of PCB containing capacitors. It is also mentioned 107 pcs. of transformers. We would like to know if the 107 pcs of transformers make the object of this tender. According to RFP for above services, it is mentioned that: “The load-carrying capacity of aircraft should not be less than 100 tons”. The air transport offer we have is for aircraft with carrying capacity of 40 tons or less. Please be so kind and clarify if this aircraft type is accepted or not. The scope of this tender is 141966 kg of PCB containing capacitors only (please refer to the table given in the ToR). 170 pcs of transformers and 200 tons PCB containing capacitors is the overall project goal. The waste should be transported by two aircrafts but not more, as you know we have about 170 tons which can be transported by 2 aircrafts with 100 tons of capacity. The less number flights we have the better, because we would face a big risks with customs clearance and it can raise the total cost.
