Section 56 Authorisation to Discharge Trade Waste
You recently made an application to the Council for a section 56 authorisation to authorise
the discharge of trade waste into the Council’s Community Wastewater Management
System (the CWMS) from the onsite wastewater system situated on the property located at
address (the System).
The application has been approved. Accordingly please find enclosed a copy of the section
56 Authorisation issued in accordance with section 56 of the Water Industry Act 2012, which
authorises the discharge of trade waste from the System into the CWMS. The authorisation
is subject to the conditions stipulated thereon.
The Authorisation applies in respect of the System and is binding and enforceable upon the
owner and operator of the System, and any person responsible for discharging trade waste
from or into the System.
The Authorisation continues in operation until date and any application for renewal must be
submitted to and approved by the Council before this date to ensure that any trade waste
discharges from the System after date are authorised.
Take note that any failure to comply with the Authorisation and/or to discharge trade waste
into the CWMS other than in accordance with the Authorisation is an offence under section
56(4) of the Water Industry Act 2012 in respect of which a maximum penalty of $25,000 and
expiation fee of $750 applies.
The Council will conduct inspections of the System to assess compliance with the
Authorisation and in connection with any application for renewal of the Authorisation.
The Authorisation operates distinct from but complementary to the wastewater works
approval that has been issued in respect of the System. As the operator of the System you
are responsible for ensuring compliance with the wastewater works approval and the
Authorisation. . Failure to do so may result in the Council taking enforcement action in
accordance with the Trade Waste Non-Compliance Procedure.
